Malta licensing of online poker site exempts players from paying tax

Kudos to Dutch online poker pro Freerk Post, whose running fight with the Dutch tax authority Belastingdienst has ended in success, with the taxman withdrawing an appeal against an earlier positive finding for the player.
Post filed against the tax authority last year, challenging an attempt by Belastingdienst to levy tax on player winnings achieved on Pokerstars.eu on grounds that the operator was licensed in another European Union member state — Malta — where gambling is not taxed.
The courts found for Post and his legal team, but the tax authority lodged an appeal in the Amsterdam Court of Appeals, which on reconsideration it withdrew this week.
Commenting on the Post victory, Pokerstars said that the court's findings have established that a player can win on PokerStars.eu without having to paying tax on winnings.
"This confirmation is great news for affected players who can play on PokerStars with the knowledge that the tax status of PokerStars.eu has been confirmed," a spokesman for Pokerstars parent Amaya Inc. said.
Malta exempts gambling and betting wins by players from taxation.
