Kiss Casino Ripped me OFF

I gambled on Kiss Casino and now they are unwilling to pay me my winnings. I won $8000 dollars at blackjack and now they are saying they are not obligated to pay. They are saying this AFTER I received an email that stating my certification for withdraws was approved. They state that since I am 19, they do not have to pay my winnings. However, they sure accepted $900 dollars from me with no problems, even though Im 19. If anyone could help with this issue, please let me know. All other players beware that they are dishonest and cheat their players out of the money they rightfully deserve. Im going to be placing this on every message board that I can find to show that they are frauds!!!!!!! Im also going to be starting a website Link Removed ( Old/Invalid) . Interesting because this is what they have to say about players' age in their T&C:

By using the Games software, Players agree to be bound by the following

1. Player is the age of legal majority in the jurisdiction in which Player resides.

Now, I guess that depends on they define as "legal majority." Being that you list Indiana as your home, is it 18 when you can vote, smoke cigarettes and enlist in the armed forces? Or 21 when you can drink alcohol?

You might try Montana disputes for this one ...

EDIT: How about this little tidbit in their T&C as well??!?

Any player that posts misleading or false information in respect of their treatment or posts information that brings the casino into ill repute stands to have their account closed and or winnings confiscated.

These Giant Vegas and Kiss Casino people have appeared here before on player complaints - there are management contact email addresses in the other thread.

I would try arguing the age of majority case with the top man, a guy called Brian Goodman in Australia. I think the group name is Vegas Magic Group. If that is unproductive I would go the Montana Overseas route.

Grateful if you would keep us advised here.
 
yeah, the manager (or owner) of kiss casino is listed on this thread. i forget her name though. do a search on this forums for "kiss casino" and read a complaint by dirk diggler called "kiss casino trying to pinch... from me". I believe she responded on that thread.

Try contacting her. If that doesnt work, you could try montana or pitching a bitch on here.

As far as the 19yrs old thing goes, its nonsense. Anything over 18 is fine. They took your bets and you won. You are not 12 years old, your 19. They must pay you.
 
Ive seen a good few excuses by shady casinos not to pay winners but this really takes the pi$$.

If he entered his date of birth when registering and then they allowed a deposit then WTF right have they got to deny him his winnings. If that was me I would seek out their office and do something illegal and im not joking.

If you have already done this, I wouldn't hold my breath waiting for Goodman to cooperate with you anytime soon. It may have been better to attempt a resolution before trashing them. This may cause difficulties with a Montana complaint, too. But...it's your money and your business.
 
Don't think this will do you any good. In fact, every casino operator out there reading this knows that you are considered a "minor" in the state of Indiana.

When you signed up at the casino, you certified that you were of legal age, didn't you? Yeah, I know, it sucks. You can go to Iraq and get your legs blown off, but you can't play at kiss casino (or any other casino for that matter). You should have checked into this before hand.

Some of the other young members out there may want to check into this as well.

At least they are willing to give you your deposit back :D
 
Would they have given back his deposit had he lost? They would have never said:Although you played with us and lost we will return your deposit because we shouldn't have allowed you to play in the first place.The problem arised only when he won.It's like saying:I will let you lose your money but you ain't got no chance to get paid if you win.Ridiculous!!!.Kiss casino you better off kissing your casino bum :puke:

The term "minor" means a person less than twenty-one (21) years of age.

Hence lacypuff not "being of the age of legal majority" as Kiss requires.

However, what about the other piece (about players who post on boards about Kiss may have their winnings taken) from their T&C I posted?

I have taken the web page down and am going to first wait on a reply from Mr. Goodman. If I do not hear of anything then I will be reposting the web site. I read through the Montanta's claims dispute form and it states you have to be 21 to submit a claim. Which of course I'm not therefore, I do not know how I can use them as a way to communicate.

Their terms and Conditions states, By using the Games software, Players agree to be bound by the following:
1. Player is the age of legal majority in the jurisdiction in which Player resides.

Being 19 in Indiana gives you the right to do the following: buy lottery tickets, play bingo, buy cigarettes, play internet based games, and die for your country. The Terms and Conditions does NOT state, That the players age is the legal majority for gambling or casinos in which the jurisdiction in which the Player resides. After talking to the Customer Support Center they are stating that is an assumption.

I agree - they should never have accepted his application for an account and deposit in the 1st place.

Surely it would make more sense to auto-lock new players accounts under a certain age (i.e. 21) until it is known whether it is legal to gamble in the jurisdiction they live.

lacypuff - you could always get an underage friend to join them, lose $8K and then demand it back if that would make you feel any better ;) (actually that would be a very interesting experiment to see if they do stand by their terms.)

Agreed Bryan,except for that last sentence. I think it is a must that the deposit should be returned,not whether they are willing to otherwise it will mean they can forfeit your deposit anytime once they prove that you have not complied with their Ts and Cs. Talk about the benevolence from the casino.

Mind you, it deals specifically with alcoholic beverages and higher education, but it's a loophole that the casino could use to indicate they believe you to be a minor, even though you are 18.

Minor Dispute

According to Indiana Law and the Officer that I just spoke to in Posey County, anyone that that is 18 years and age and older is considered an adult and is prosecuted as an adult under the court of law. Anyone under the age of 18 is considered a juvenile/minor. I received this information after contacting the police department. Matter of fact this is phone number that I called.

Instead of calling the Posey County dispatcher, I'd call a lawyer and ask them if you are considered a minor in respect to gambling. And then explain what happened. We could go back and forth all night on this one. The casino obviously feels you are considered a minor in your jurisdiction, and they are right to an extent. But there is no reason to split hairs on this one.

And an after-thought. Let's say you contact this lawyer, and he/she states that you would be considered a full-fledged adult, able to gamble your brains out in any casino in Indiana. Do you think Kiss casino would take this information into consideration? Perhaps understanding that a 19 year old is of the "age of majority".

I don't think so. Looks like you've burned all your bridges here.
 
I believe that you need to be 21 to play in any casino in the US. I seem to remember signs to that effect in every casino I've visited.

Interesting story along the same lines. In Connecticut about a year or so ago, there was a guy playing Caribbean Stud progressive at Foxwoods Casino. He was dealt a royal and had his $1 in the slot for the $170K+ progressive jackpot and 'won' it. That was until they checked his ID and found that he was under 21. He was given back his stake and escorted out the door without the $170K. Last I read, he had a lawyer suing them, but I doubt he got anywhere with it.
