I agree with you 100% there. But if I was six feet tall and wearing frilly panties and they allowed me to play $900 and only enforced the ruling when i won, that is wrong.
Also if they are keeping $8000 and quoting Indiana laws then an Indiana court should rule on the interpretation of those laws.
Kiss casino are only qualified to rule on the interpretation of their own laws (T's and C's).I agree their rule says no one under the age of majority in the jurisdiction in which the player resides, but it is not up to the casino to rule whether he broke the law there. only once it has been ruled that he broke the law there can they enforce that rule.
If he did break the law he was aided and abetted by the casino as they continued to provide the means for him to gamble even after he had told them where he lived and how old he was. They knowingly paid winnings to a 'minor' even though they wouldn't let him cash it out because they'd rather keep it themselves.

Bottom line is they ripped him off
 
De facto, when Bryan says "It's strictly up to them, but enforcing it would be their upcoming or downfall," he's right - that's the way of this largely unregulated business.

But it will cost them dearly, of that I am sure.
 
We all need to make sure it does cost them dearly. This is an absolute disgrace... Just pay the man!!! I've introduced a whole load of people to online casinos, even in the short time I've been playing. I'll be making sure this lot get none of it.

Is there some way they can become 'Super Rogues' -with full on front page rogue status :D

I hate it when people don't play fair. I'm always absolutely gracious when I lose, I expect casino's to be too. The ironic thing is, he'd have no doubt played at least some of his winnings back through if he's anything like me! Maybe even all of it... and Kiss would still get the kudos. As it stands, their reputation seems to be lower than low....

Disgraceful.

Whoa! Given their pattern of behaviour it was only a matter of time before they went south, but this comes a little earlier than I had anticipated.

I wonder if Giant Vegas is also closing?

All I can think of to say is "Good riddance to another RTG dud."
 
Actually, when he signed up (and like other players registering at RTG casinos) he checked the box agreeing he was of legal age. He believed he was...but he wasn't. This is the information that the casino had - that he attested that he was of legal age.
They say 'Player is the age of legal majority in the jurisdiction in which Player resides'

Kiss is closing

Per an e-maill yesterday Kiss is closing as of the 22nd.
I guess we can kiss it good bye, including this discussion.
However I tend to agree that prior to this whole problem there was every warning sign that this was a potential problem.
I guess that's why they call it gambling. And our your friend learns you can not win every one.

Likewise with RTG they will probably just try an new name.
 
If this thread influenced Kiss Casino's closure then good. I still feel sorry for the poor guy who lost $8000 though.

IMHO it is thanks to this message board that there arnt many more rogue casinos out there.

That's the beauty of this forum. Even though montana ruled in favour of the casino,this could not stop players from exiting this lousy place. We should continue to band together and hopefully other casinos will start behaving themselves.

So I typed giantslots.com into my browser - and was immediately redirected to a gay porn site :eek2:

Andrew, unfortunately it's no good pointing out what other casinos do, or the confused situation in the USA on the legal standing of Internet gambling. Montana is in Panama City, Kiss and Giant Vegas are Australian owned but registered in Costa Rica and the T&Cs in question are theirs...not some other RTG powered casino's.

PS: It would be informative to know how many "losing" 18 years olds remain on the books here.

So much for the Montana dispute. I wish I could say this was a matter of opinion and there are two sides here, but there really isn't. Kiss is rogue and the Montana dispute process is bogus.

Which means if you are playing in an RTG casino, there is a high level of risk.

When the U.S. finally bans internet Gaming I will just laugh. They have it coming.

Things like taking this persons money and then not paying will just provide additional fuel to the fire. And this new breed Republican Party who owes their dominance to evangelicals are not exactly known for their tolerance.

Look for disgruntled players to start providing key senators and congressmen with links to threads just like this one.

Also most of the christian be in vegas on the slots, they have buses full of sisters going to vegas. I even know pastors kicking in vegas

Though Kiss is gone I think the group is still operating GiantVegas. E-mails from this group seems to be kind of heavy as of late. (I could be wrong on the relationship though). Anyone playing KISS since early this year was flirting with trouble.

In my opinion the US would be better trying to control and tax internet gambling verses banning such. Think of the play and respect if onlines were governed and regulated by a US based gaming comission like Neveda is? If I had my choice of playing in some backroom or in casino that is regulated as such the choice is simple. Taxes would be focused on the casino's profit/handle with the players having the obligation of reporting winnings as we all do today. Online mutual betting today is legit in the US and appears to contirbute to some minor growth for the sport of kings. (check out You Bet traded UBET NASDQ)

Though the first approvals would be for the Bush cronies.

Bush allegiance is to the religious right and they won't be big on online gambling - which they will quickly link to online porn.

The advantage to limiting gaming to Landbased is obvious. It provides jobs. It helps the overall economy. The tax revenue is still there. And it is easier to control.

Those that have invested billions in building huge casino hotel complexes have money too. I don't think they are going to lobby hard to share their customer base with overseas competition.

But mostly, thanks for bringing this thread to the top again. I see no reason to let Kiss/Giant Vegas/Montana off the hook. The biggest disappointment to me was with the Montana resolution process.

Alot of pastors, sisters and brothers of the church be gambling, they love to run to vegas or to the indian casinos. They cant stop porn, pot or gambling.

Bush need to step back if he thing he going to control my money.
