Whould you consider this email as misleading? I was quite surprized it has come from an accredited casino, you do expect this kind of email from less reputable casinos.

lavida.jpg

According to the email I have been selected as this weeks winner of £3,000.00, but it links to a bonus page so technically I've won nouthing :p

You have won €3000 of play money, and you have one hour to win up to €100 from it. To claim this, you have to deposit.

This is a highly misleading way to advertise the standard new player free play promotion, and it is usually Casino Rewards that advertises like this. If Mark is your name, this is targeted by someone who has your personal info, at least your name associated with your email address. This means that somewhere you have signed up with your name and email address has sold your details on. It is usually a website, less common for a casino to sell on the details, but it has happened.

Have you got an account at Red Flush?

This is certainly misleading as it tries to make you think you have won €3000. In fact, it isn't even a €3000 bonus, it is purely play money in a special promotional game, and there is no way you can convert it into withdrawable cash as you could were it a true €3000 bonus.

It is also misleading to personalise it as something that you have won, when in fact EVERYBODY can "win" this €3000 if they are not already a player at La Vida.

Maybe pass this to the ASA to see what they think about the text of this advertisement. The ASA now cover internet advertising.

Yeah got an account at red flush I think that's why I've proberly got the email. Think I'll try claim the 3000 the email states I've won via live chat later see what they have to say, could be quite amusing.. I'll look into the advise youve given thanks

Yeah I've got the same spam from Casino Lavida, 'personally' addressed to me and telling me I have been selected as this week's winner.

I have an account at Red Flush which I haven't logged into for months, never registered at Casino Lavida.

I made my decision about Red Flush (and thus any casino in their group) months ago, they properly messed me around on a small withdrawal and then demanded a phone number from me to 'finalise the process' and then used that phone number to make an unsolicited marketing call to me.

They don't belong on the accredited list IMO.

My chat with "Live Chat" regarding my 3000 prize :p

Georgios: Welcome to the Casino . How may I assist you?

Me: hello i receieved an email saying that i have been selected as this weeks winner and have been awarded 3000, i clicked the link to claim it but it hasent been credited to my account

Georgios: Can I have your user name please?

Me: ***********

Georgios: One moment please

**5 minute wait**

Me: Georgios?

Georgios: One moment please

Georgios: Mark welcome to the casino

Georgios: please note that with the 300O offer, its all the bonuses we offer combined that total 3000

Georgios: To claim your 3000 free you will first need to need to register a Real account with the casino and then complete each of the following steps to ensure that you get the most out of the 3000 Bonus Offer.

Georgios: On your first deposit:
• Get 100% up to 100 on your first purchase AND 50 complimentary spins on Riviera Riches video slot Plus 500 Free Loyalty Points

Georgios: 500 Free Loyalty Points
On your second deposit
• Get 25% up to 200 on your second purchase Plus 50 complimentary spins on Gold Factory video slot

Georgios: On your third deposit:
• Get 50% up to 200 on your third purchase

Georgios: On your fourth deposit:

Georgios: Its a great offer

Georgios: Please feel free to take advantage of the great 3000 offer

Me: ahh so its a bonus offer I havent actually won the 3000?

Georgios: Its 3000 bonus with all your deposits made

Me: The email made it look like I have won 3000 with lines highlighted like "you have been selected as this weeks winner" - "you have won:" and "to collect your 3000 click here" I think that was a little misleading of your behalf as i was lead to believe that this was a prize i won at random not a bonus offer.

** Another 5 minute wait **

Georgios: I apologize for that

Georgios: Its 3000 in bonus with your deposits made

Me: Thank you for your time Georgios, but due to the email and its hidden conditions I don't feel I would want to play at the casino as you have to put trust into a casino that if you win they would payout and the first email I have recieved from you's contained lies so the trust is just not there but thankyou for clearing things up for me

** No response after my last entry **

Eh:confused:

100 + 200 + 200 + 125 = 625

Where's the rest:confused:

I have submitted my complaint this morning, it takes 3-5 days for them to look at it so I'll post their response when I get it.

I have also sent a PM to the redflush rep on here to see if they have any comments although I don't know if they look after LA VIDA?

Hi

Thank you very much for bringing to our attention all your concerns relating to our promotional offer .

This is one of many different mailers used to market our casinos and I think in this circumstance it’s a case of our marketing guys trying to be a bit too creative in selling the 3000 free offer. We fully understand any concerns and will look at changing the wording so there is no confusion as to what the recipient is getting by the way of the offer

The 3000 offer we have on Casino Lavida is not only applicable to your welcome offers , but also applies to other daily offers which would be available once a new player has completed all the step-up welcome offers as the player then qualifies for our midweek and weekly offers , affording a player well over 3000 in total bonuses.

We hope this sheds some light on this matter

So why not just be straight up, and write New players can take advantage of up to $3000 in deposit bonuses? Otherwise, it's as bad as a telemarketer calling you up for that great free cruise (pending your purchase of a timeshare, but we don't tell you that til after you come and try to claim it)

Not a one-time issue

I do not think I have ever received a clear and fair promo email from this group, only ones like this. Fortunately I do not get further emails any more. Furthermore I was being told over the phone that I photoshopped my documents after I submitted those (the very same documents which were accepted by other casinos without problem, and at the end at this group as well). Not my cup of tea.

Thank you Isha for taking the time to read through the tread and reply, but to me I think its alittle more than your marketing guys being too creative.

The email stated I had won 3000, when clearly that wasn't the case. I still carn't work out how the offer still works out to 3000 in bonuses.

I was a little disapointed by the live chat operator as they didn't seem concerned that the email sent to me was clearly wrong, I would of expected at the very least for them to say that they would forward my concerns to the relevent department so it doesnt happen again.

The problem is that you have tried to quantify an indeterminate figure. You have arbitrarily stated $3000 even though the regular player offers are likely to continue for as long as the player plays.

The welcome offer itself is a mere 625 in quantifiable bonus cash, and even that has not been "won", as "winning" something implies it is yours to keep, whereas bonus cash needs to be played first. Further, in order to claim this "win", deposits substantially greater than $3000 are required along with a wagering requirement. This is not too dissimilar to the scam letters that claim you have won a prize, but that you have to pay a series of fees in order to release it. The ASA may see this similarity, but not be familiar enough with this industry to understand that pretty much anything given away for free is a bonus chip, and not cash.

The text even implies that there is only one winner per week, and this week it is you. In fact, everyone who has not yet played at La Vida is "this week's winner", and even those who are not in receipt of this mailer could get the $625 welcome offer.

Given that the UK government are only a couple of years away from tightening the rules, the time for operators to change their ways is now, where such complaints generate a "don't do it again" from the ASA, as opposed to a yanking of a secondary license by the Gambling Commission.

I had a look at the ASA website last year, and they have ruled against a number of online casino mailers and adverts that breach the code. Currently, enforcement is not easy as they are based offshore, but with secondary licensing, such lapses could be dealt with by an absolute ban on advertising into the UK through the removal of a secondary license. The current system allows any operator licensed within the EU, or in a whitelisted territory, to advertise through the UK media, a very valuable privilege for the operator.

Update

Just recieved this email (so they haven't forgot about my complaint)

Hi Mark,

Thank you again for contacting the ASA, and for providing a copy of the email referred to in your web complaint form.

Just to let you know that we’re still assessing the issues you raise and will be in touch again when there is further information. You should hear from either myself or one of my colleagues shortly. From the information that we have, it seems as though Great Heights is indeed the company responsible for Casino La Vida.

Thank you for your continued patience.

Kind regards,

David

More lies and spam

3000 in my account, apparently. And it's addressed personally to me.

According to the blurb, it's a maximum of £625 in bonuses across four deposits, where the hell does '3000 in your account' come from?

More dishonest spam from this group!

They haven't learnt then?

I got a letter back from the ASA today, they have taken up my complaint and have started a formal investigation. They have asked Great Heights Ltd t/a casinolavida to comment.

I will scan a copy of the letter later for those interested.

They haven't learnt then?

Thing is, I don't even have an account at Casino LaVida, so it's IMPOSSIBLE for me to have '3000 in my account' as per the subject.

This is basically just an email offering a four-part SUB at Casino LaVida, which I'm getting because I've had an account at Red Flush for years.

I don't mind that in and of itself, cross-promotions from different casinos in the same group I have no issue with.

However, the main text is blatantly misleading, it says 'SIGN UP AND RECEIVE $/€/£ 3000 FREE' but that will not happen, if I sign up I get absolutely nothing, if I deposit I get a 100% bonus up to a maximum of £100. I then have to deposit three more times to get more bonuses and all four added together only make £625.

I really don't know why this group is still accredited.

I will scan a copy of the letter later for those interested.

I'd be interested to see that, cheers :)

They're still at it.

Is it worth lodging a complaint with CM? Surely accredited casinos can't systematically send out deliberately misleading/lying spam emails, long after the fact it's been pointing out to them that they're sending out lying spam?
