Some good news for the internet gambling industry, it turns out that 1st Technology suffered a major defeat in court recently. Point-Spreads.com has obtained a letter from the United States Patent & Trademark Office that dismisses 1st Technology's request to vacate a re-examination request of U.S. Patent No. 5,564,001. A copy of the USPTO ruling can be found here. Apparently the USPTO felt the declaration of Scott W. Lewis was improper and it will be expunged from the official file which is currently under review for the validity of the method patent in the first place.

So what does that mean? While it does not get Bodog back their domain names, 1st Technology cannot use the method patent to extort money from other internet gambling companies while the validity of the method patent is under review by the USPTO.

By using the US legal system to secure "royalty/licensing" payments for their method patent, 1st Technology has really been a major cause of damage to beleaguered internet gambling industry over the last several years. 1st Technology has used U.S. Patent No. 5,564,001 to obtain "royalty/licensing" payments from various gaming operators that were not in a position to fight the attacks. While this is great news for operators currently being attacked by 1st Technology, it will not help Bodog get their domain portfolio back.

This latest ruling by the United States Patent & Trademark Office brings the 1st Technology method patent one step closer to being overturned.

While this is great to hear, its not over yet. Point-Spreads.com has also learned that the state of Kentucky has been monitoring the way 1st Technology was able to successfully grab the Bodog domain names and has put a plan in motion to seize other gambling operators domain names. Here is a copy of the motion to seize domain names filed by the State of Kentucky this past Friday.

Internet gambling operators using United States based registrars to hold their domain name portfolios better look into transferring those domain names to a registrar in jurisdiction that licenses gaming companies fast. It is unknown at this time if Kentucky will be successful in its attempts to seize the domain names. Point-Spreads.com will continue to monitor this story as it unfolds.

Interesting...seems they have managed to list most all of the MG and RTG casinos, did notice though that 3Dice was not on that list, curious if 3Dice has registered theirs under another jurisdiction...other than a United States based registrar...

Oh, for craps sake....

Intimidate, coerce, extort... Wonder what wiz at the DOJ helped think this one up?

This looks more like harassment than anything. What's the point? Just to make things a little harder for the casinos? Isn't that harassment?
1. to disturb persistently; torment, as with troubles or cares; bother continually; pester; persecute.
2. to trouble by repeated attacks, incursions, etc., as in war or hostilities; harry; raid

FRANKFORT, Ky. - Kentucky's pro-gambling governor is looking to make sure all bets are off for more than 140 online gambling Web sites that operate in the state known for the world's biggest horse race.

Gov. Steve Beshear said his administration has asked a Franklin County Circuit Court judge to give the state control of 141 gambling Web site domain names. Beshear said he's looking to restrict Kentuckians' access to Web sites with names that include some of the most popular gambling sites for U.S. players: bodoglife.com, doylesroom.com and fulltiltpoker.com.

A hearing is scheduled for Thursday before Judge Thomas Wingate.

Beshear believes Kentucky....

But David Stewart, a Washington, D.C., attorney who is an expert in gambling law, doubted that Beshear's strategy will work.

"This is -- forgive me for being blunt -- a stunt," Stewart said...

Well boys and girls I just got word that a ruling has been handed down and the 141 .com domains are to be forfeited.

It's a sad day when things have to come to this extent.

Oh, it's far from over. I'm going to laugh when this gets overturned and Kentucky has to pay some sort of restitution.

Hello All-

I was wondering if anyone here knows anything about this:

I received an urgent email from Star Partners saying:

URGENT NOTICE

Due to the Kentucky Court ruling on the seizure of online gaming domains we have had to take urgent steps to our websites domains.

The following domains were affected by the courts ruling:
We have brought the following domains online to replace the .com variant in the interim until we gain clarity on the situation.

Kentucky seeking to seize 141 gaming domains

Date: September 23, 2008
By: Marylou

The governor of Kentucky is seeking to block residents from accessing 141 online gaming sites which include Full Tilt, Doyles Room and Bodog. The hearing has been set for this Thursday.

Steve Beshear, Governor of the Commonwealth of Kentucky, is determined to protect the states horse racing industry at all costs and to rid Kentucky of internet gambling, both poker and casinos, which he describes as leeches on a recent press conference: Unlike casinos that operate on land or on riverboats in the United States, these operations pay no tax revenues, provide no jobs and yield no tourism benefits. They are leeches on our communities.

The Kentucky lottery and horse racing industry generate millions upon millions of taxable dollars the Kentucky lottery alone generated sales for $778 million in the fiscal year 2008. Beshear is determined that none of those dollars get diverted to poker or casinos, especially those outside of the state. The Associated Press reported: Beshear said Kentuckians are likely spend tens of millions of dollars on illegal Internet gambling sites each year money that might otherwise go to Kentuckys horse tracks, charitable events and the state lottery.

Judge Thomas Wingate will preside over the Thursday hearing, when he is expected to decide the fate of these domains. If Beshear gets his way, all 141 domains will be blocked to Kentucky residents.

Below is a list of the endangered sites as reported by the Gaming Intelligence Group. We will feature more on this issue as soon as there are new developments.

Reply from David Brickman at the Jackpot Factory

Hi everyone.

David Brickman here, from the Jackpot Factory Group.

From what weve heard & read in the news, the Governor of Kentucky, Steve Beshear, has decided to try and freeze the domains of online casinos in an effort to drive them out. This is a fairly aggressive and zealous move which will set a precedent for the internet. Most operators are already moving their operations over to either a UK or EU domain.

IF the sites suddenly stop functioning players will be unable to access their current version of software including the flash casinos. They will need to re-download from a new domain provided by the casino. There is no reason to re-download now since Microgaming still has to provide operators with new software. MGS is making all necessary preparations to deal with this issue.

Not more than 30 minutes ago, I heard from MGS insiders that they are fairly confident this ruling will be reversed in a hearing set for tomorrow.

I will do my best to regularly post news & updates as well as field any questions but please be patient since were all kind of busy here. :)

I don't see how this will stand. Some of those named are legitimate business in their own countries.

Now maybe the Kentucky Governor should follow the Chinese or Saudi governments and just start blocking all the websites he doesn't like... He could start by banning the websites that criticize him for this stupid waste of the tax payers money.... Then he could end up banning his competitors websites because they support online gambling...

Haven't we had enough, of these religious freaks in politics trying to FORCE us to live the way they want? What the hell ever happened to the RIGHT to pursue Happiness or the RIGHT to live and believe the way you choose?

You can always let the Democratic Governor of Kentucky, Steve Beshear (son of a Baptists Minister) know how you feel about this.

Here is his contact form.

I sent him a email telling him just what I thought of him and his actions... He is acting completely UN-American.

As a Texan, so far our gov. hasn't decided to play King yet. And I really don't think he has the balls to try it.

However, if someone can tell me what we can do to stop this crap, I would appreciate it. It doesn't matter whether we vote or not, we will get the pres. that the electorial college votes on, just as the democrats got the presidential candidate that the super delegates and old guard wanted. We, as Americans, have lost all of our rights that were guaranteed by the Constitution. They have slowly been removed by our governing body and sooner than later, we are going to be just like some of the other nations where the general populace have absolutely no say in the government.

I vote, I write letters for what it is worth. It doesn't matter. What has happened to a government by the people, for the people?

It truly amazes me how bending of the freedom charter and law changes happen in the U.S to suit the means, I love the "leeches" term that was used ,gambling is gambling, it is all lecherous. If I am not happy with a store due to service or lack of quality product I go somewhere else, it would be against the so called law to shut down the competition, but not with online gaming. Not so much the land of the free anymore!!

Un - American?

I don't know about that. Only last week I saw a poster on the Yuku/EZBoard network get reported to the FBI :eek2: - He had been globally banned from their network and subsequently signed up new accounts. Which peed off the Yuku helpdesk somewhat.

It seems since the inception of the Patriot Act, more and more freedoms which US Citizens have been used to enjoying are slowly being eroded.

Yes, it's pretty scary. Right now, you could go call the FBI (or better yet, Homeland Security) and tell them you think someone's a terrorist and they will make that person's life a living hell. I doubt they'd even ask for any proof.

Patriot Act = Guilty until proven innocent.

I totally agree!
As a American, they are working on my LAST nerve here!!
I think our goverment & everyone involved.. should start cleaning UP their OWN back yard, before they start working on OURS!!

Damn! I think I made a wrong turn somewhere here in America and ended up in long ago Soviet Russia's policies!

Our Freedom of Speech, our choices and what have you.. are slowly being flushed down the Ole' Crapper, by our own people!

Will NOW get off the Soap-Box for a time :p

WHAT IS CONFUSING ME IS....

I found a post here at Casinomeister that a member [Jetset] had posted on Feb.23, 2008 about a Land Casino operator donating $1 Million Dollars to get Steve Beshear elected. Now that was a bad investment...OR was it? If people can't gamble online???

Is Governor Beshear going to cancel the Kentucky Derby this year too? I quess it is not gambling this man finds offensive.. he just wants to dictate how citizens gamble...there is a lot of money involved in all this political rangling .... You don't think this is all about someone lining their pockets do you? :smilewink:

Kentucky contributions

--------------------------------------------------------------------------------

POLITICS AND MONEY - A VOLATILE MIX

Land casino operator defends contributions to Kentucky politician

A political row is gaining momentum in the US state of Kentucky over a $1 million "contribution" by a land casino owner to a political group that worked to elect a pro-gambling governor in Kentucky, reports Associated Press this weekend.

The casino owner, William Yung III, has essentially placed a huge bet that newly elected Governor Steve Beshear will be able to get the state's long-standing prohibition against casinos lifted, the article claims.

Yung has been forthright about his contribution: "I make no apologies for helping get Steve Beshear elected," he told The Associated Press in an interview. "I've got a First Amendment right to spend my money any way I want to spend it."

Governor Beshear is proposing an amendment to the state constitution that would allow up to seven casinos to be built at Kentucky horse tracks and five others in communities along the state's borders with Indiana, Ohio, Tennessee and West Virginia.

That many casinos, he said, could generate $600 million a year in tax revenue for a cash-strapped state government.

The proposal is a long shot in a Bible-belt state where lawmakers have rejected numerous other casino proposals over the past decade. If it passes, Yung would open a casino on a northern Kentucky site he bought just last month for $7 million.

"Absolutely, we're gambling on it," Yung said. "We don't know if it's going to pass or not."

Yung's $1 million contribution went to the Kentucky political group Bluegrass Freedom Fund that ran devastating television ads capitalising on the former governor's legal woes. Internal Revenue Service records show Yung's contribution accounted for a third of the $3 million the group spent during the Governor Beshear's race for the governor's mansion.

"I have done absolutely nothing wrong. Steve Beshear's done nothing wrong. Nobody associated with us has done anything wrong," he said. "It's just pretty sickening politics."

Yung's generosity included a $10 000 donation to help pay for Beshear's inaugural party on the Capitol grounds. Casino opponents claim he is using his riches to buy his way into a new and potentially lucrative market.

Political contributions of $1 million or more are becoming common in state-level elections, said Rachel Weiss, spokeswoman for the National Institute on Money in State Politics.

Beshear, who raised and spent about $6.8 million on his campaign last year against former Governor Ernie Fletcher, insists Yung's contributions bought him no favours. Yung would have to apply for a casino license just like anyone else, Beshear said.

"It would be naive for anybody to believe that a $1 million contribution to a fund that helped elect a pro-casino governor is not going to position the contributor in a favorable way," said John Mark Hack, head of the antigambling group Say No To Casinos.

After Beshear took office in December, Yung's privately held company, Columbia Sussex, paid $7 million for a site in northern Kentucky to build a casino. Yung called the property "prime real estate" that he can easily resell if Beshear's casino proposal flops.

Yung's company owns 13 casinos and 80 hotels in the United States and beyond, pulling in revenues of some $3 billion a year.

Governor Beshear had made legalising casinos a centrepiece of his campaign against former Governor Ernie Fletcher, a Republican who had been weakened by political scandal. Beshear pulled off a lopsided victory, and claimed it reflected broad-based support for legalising casinos.

Casino opponents, however, say Beshear's victory was the result of distaste for Fletcher, who, along with 13 associates, was indicted in 2006 for alleged violations of state hiring laws. Fletcher pardoned his associates and reached a deal with prosecutors to have the charges against him dropped.

"Donald Duck could have run against Ernie Fletcher and been elected governor," Hack said.

It's not an inconsistent policy. The Kentucky governor seems concerned with protecting local gambling (primarily horse racing) from foreign competition, rather than eliminating gambling for moral/religious reasons. The land-based casino owner who helped get him elected likely supports the governor's current actions.

Betting on the horses is not considered online gambling. Churchill Downs own a large number of the racetracks in the US and have their own betting site. Magna Entertainment owns a large number of race tracks and have their own betting site. Both Magna Entertainment and Churchill Downs work together and are partners in some tracks. Kentucky is working toward getting slot machines at their racetracks as are most of the other horse/dog tracks in the US. TVG has an online betting site and HRTV, owned by Magna, also has it's own betting site.

Now go figure that Kentucky would be trying to close down online casinos.
