Based on the assumption that your story can be checked out, then the licensee is in breach of the rules. There should be no way to reactivate an account that is SE'd for 5 years or to open another under the same licence, before the expiry of said SE. Bets should be void if this is spotted. I would recommend a PAB in this case:

Could I still raise a complaint? As I have continued to discuss the case on this feed? Plus what are the chances of getting my deposits back without the need to go to the UKGC? Or in fact my own solicitor?

But he agreed for the account to be re-opened with the casino saying they would not void any winnings. With him agreeing not to challenge his deposits

If they get a penalty it's almost certain he will get paid, that happens pretty much every time the UKGC give penalties for this type of thing, so there is clearly precedent for that to happen.

I have been told by somebody recently that this should not have been allowed to happen and they are in breach. It appears that some people think this is fishy? Not sure why.Okay i know what the rules are these days on self exclusion but were they the same a couple of years ago.

You're missing the point, the casino should have stopped him, then he wouldn't be saying 'I WANT A REFUND'. There are numerous rulings by the UKGC to show a refund is the correct course of action, if you don't like it go and complain to them. It's even worse in this case as they 100% knew he was self excluded and actually lifted a self exclusion, which is probably one of the most stupid things I have ever seen a casino do. They are still doing it as shown by the chat above (not excluding from all platforms) which is EXACTLY what 888 were fined 7.8 mil for.
@paul7388 the rules were the same back then, the 888 ruling predates this by a few months
