They seem to be officially dead now. Their website has been giving errors for a while!
It may be the influx of players which caused their servers to crash. I still havent heard from the ombudsman, they take a while!
Since this happened, the banks lost a case in the house of lords, they were attempting to get a ruling that they could refuse claims for purchases made outside the UK, but the lawlords would have none of it
The only trick remaining is to say they classed the transaction as a "cash advance" rather than a purchase. Many card companies have artificially done this by claiming gambling transactions to be an "advance of cash", however, this has yet to be rested as "fair", since the "cash" is advanced to a merchant, not the customer, and is done through the credit card processors, not via promotional cheque, indeed, card companies do not, for the most part, even levy the usual advance fee.
Banks are known for taking these disputes "to the wire", but fail to turn up if it gets to court, thus ensuring judgement in the customer's favour without any legal precedent being set. If the amount is significant, and the Ombudsman gets you nowhere, it is worth a try, it will cost 55 if you fail provided the amount is under 5,000.
