Ohio man sues casino after $35,000 in winnings stolen

A US man has sued a casino in Columbus, Ohio, after he was robbed at gunpoint of thousands of dollars of blackjack winnings at his home later.

David Hayes, 29, says in a lawsuit two armed men entered his bedroom and demanded $35,800 (£23,400).

He says the Hollywood Casino Columbus should have paid him in a cheque and failed to keep his address and other personal information confidential.

The casino argues Mr Hayes lost the money because of "his own negligence".

Of course this is just my opinion, but it totally sounds as if either the clerk and the security guard, or one of them were involved in a possible scheme...

If the security guard told the clerk, maybe casually, after she inquired what David Hayes had said to him, all the information would be available to alert accomplices as to where to go, and what to expect.

Or, the security team used camera footage (the moment where the clerk held up the piece of paper for Mr. Hayes to confirm) and made sure their security guard asked "the question" to acquire additional info..

OR...maybe i read to many detectives lately:D

When you get a "hand pay" in a casino, they have to ask you if you want cash or cheque. If they didn't ask, the guy should have told them that he wanted a cheque. Who leaves a casino with $35k in cash? I'd be extremely paranoid if I was walking around with that kind of money on me, especially when I'd leave the casino.

Anything over $1k and I start watching over my shoulder.

Whether he was paid on floor or at the cage... it takes a while to count out that many hundreds and gives plenty of people time and opportunity to take note of the player ... there are too many eyes around for anyone to safely walk around with that much cash. Deny me a check? That cashier or attendant better find me a freaking supervisor. Like online casinos, they're rather give you cash hoping you'll blow it all before you leave (kind of like leaving a withdrawal reversable for days on end). If it's a hand pay, the attendants fear they won't get a tip if they get a check for you. You refuse me a check, no tip anyway -- AND I talk to a supervisor.

Back in 1996, I had won the Carribean Stud jackpot, it was just ove 204 thousand dollars. When I won, almost the whole casino was standing around the table. The pit boss called security, 11 security guards showed up. Made everyone stand 10 feet from the table except me and the other 2 people playing at the table. When we were done at the table, all 11 escorted me to the cashier. I had to wait until the cashiers were done with the customer they were waiting on, then they shut it down except for the cashier I was going to. Again no one was allowed to be closer than 10 feet from the cashier except me. The only words spoken by the security gaurds were "Congratulations".

When we were at the cashier, EVERY SECURITY GAURD TURNED THEIR BACKS TOWARDS THE CASHIER. And, the cashier spoke very softly. And all other cashiers were removed from the cage, only the casino execs were in there besides the cashier. And they watched her every move. They asked for my ID, social security card and another form of ID, like a credit card with my name on it. All of those were given to the cashier. Her next question, Would you like a check or cash. I said I would like 3 grand in cash for the tip and the rest in a check.

After we were done there, the security guards took me over to a VIP guest services office, where there I was asked if I would like a free room or and escort home. I said I would like the free room. They offered me to keep the check in thier safe until I left the next day. The next day when I checked out, I was then offered an escort to my home, I asked if I could have one to my bank, and they called the NYS State Police and I was escorted to my bank to deposit the check.

I even asked for the cards I was playing with and I was told I could have them but it would be atleast 4 weeks until I can get them because they had to be inspected to make sure they were not marked in anyway. I did not touch any of that money until I got those cards. I knew I had not cheated but you always here stuff like they found a mark on a card blah blah blah.

There is no excuse for this guy not asking for a check, or for an escort. I am sure the casino would have held the check until the next banking day too. I feel bad for the guy, I am sure he never thought anything like this could happen. It maybe an inside job, and I hope they catch the SOB's that did this, but if it is cash that was stolen, I am sure it is long gone.

That was a very interesting story! Thanks for posting.

You left a $3000 tip to the dealer? Did you ask someone how much you should leave? It's one thing I'd not know, how much tip you should leave when you win a huge sum of money with a live dealer in a casino.

How much of it was left after tax? Can you deduct the tip before tax? Otherwise the government double dips and taxes the same $3000 twice.

I left what the pit boss said would be good, (I aslo had another thousand or so at the table for getting the royal and I left that too)because at that time I was new to gambling. I had to pay tax on the whole 204 thousand, after all taxes were paid, I got about 116 thousand. Not to shabby on a 16 dollar bet (five for the bet, and 10 for the backbet and 1 dollar for the jackpot).

Really interesting story, did the casino do much to tempt you back in to the casino after your big win?

Till this day, I get a free room at the casino once a month, 50 dollars a week in free play, and I am always getting things in the mail for free dinners. The thing is, I have never played Carribean Stud again, at this casino or any other casino. And that is no lie. When I go to the this casino every week, (it is about 20 to 25 minutes from my house) I take 50 dollars of my own money also. So I play with thier 50 dollars and my own 50 dollars on the penny slots. Quite a few times now I have walked out of there winning money, and sometimes I lose. Can't win everytime right?

The free room I get is my date night with the hubby, so it is nice. We got to dinner sometimes see the show they have that night and gamble a little. But to us, it is night out that is not far from home incase something happens with our daughter. But like I said it is a night out that is not expensive, and close to home.

I've been playing in casinos for a long time now but this is the first time I heard of tipping the Cashier Cage attendants. Tip the dealers and the drinks person, yes, but attendants? Never heard of that. Is this a normal thing to do, tip the Cashier attendants?

Thanks for sharing that great story Lhofsdal!

At Holland Casino you can have your winnings transferred to your bank account, quite convenient!

IMO This should be a standard practice provided the amount is in excess of a minimum to be decided by the casino. This applies for tourists who go to overseas casinos as well. The casino could charge a small fee but as you stated its more convenient and much more secure too. Allegations of money laundering may be a problem though.

here, at the cashier, there's tip jars/boxes at every window - I dump my coins in them after cashing out.
And I and most people I know tip whoever pays ya when they come to your machines for a hand-pay, like a runner in bingo after a big win

Great story Lori. Did a geomancer not tell you 2013 is your lucky year? I would luv another story from you but if you don't want to make the trip an online Jackpot will still be nice. Don't be greedy, a $50K JP will suffice this time. Remember to tip me though.

Thanks for the laugh! But to be frank, I have pretty much given up on line gaming. To live in the US it is not worth the hassels. After reading some of the threads here, I am not missing it either. But if the time comes and I do win another JP, Chu you will be the first to know, and I will tip ya for the good luck you sent me!

I find it shocking you pay tax on gambling in the USA. We used to have a 9% betting tax up until 1991 or something, whereby you could pay 9p in the pound on your bet, and NOT pay tax on the winnings. If you didn't pay the stake tax, you would be liable to have it taken from your winnings at 9%. So you could gamble with the tax lol....
We have never paid tax on slot/lottery/football pools winnings. To do so would leave the government (under the way taxes work here) open to paying tax back on my gambling losses - i.e. I work and pay 20% income tax. I take home 1500 pounds a month. I lose 500 gambling therefore I can claim 100 pounds tax rebate (20%) on my losses IF the government takes tax on any winnings. You paid 40%+ of your win in taxes - that is extortionate.
Is there no way to offset this if you lose? I can't believe the USA has to suffer one-way only gaming tax? Jezze, even the Mafia would take less.

Here in the USA, the Federal Tax is 26 or 28% and State tax is 16 or 18%(It is different for each state, some states like Florida do not have state taxes on gambling wins) . Combined total taxes was about 44%. Nothing you can do about it, pay the taxes or go to jail... I chose to pay the taxes lol.

You can claim losses upto the amount won that you are claiming on your taxes, BUT you have to be able to prove those losses if you ever get audited on your taxes. And the IRS (internal revenue service) has upto 3 or 5 years to audit you.

Here in the US of A , at any B^&M Csino , any winnings of $1200 is taxed not on the profit but on the amount as long as its 1200 or more. and that is in addition to trhe statetaxes. The casino demands you sign a piece of paper which is equivalent to w2. That is why some VP machines in Vegas has some winnings a $1199.

Now a question! You play video poker anf play DBLE Bonus .which is a little over 100% if played correctly. Playing the dollar machine at $5 , a Royal Flush pays $4000... You may be down about $800 ( for argument sake}when you hit the royal. So you are happy but wait you pay 25% on $4000 , so for this session you are only ahead $2200.

Doesnt this effectively reduces the RTP on this game? Uless one is a professional gambler who keeps precise records, my contention is that it does not pay to play the maximum (as recommended) Its better to play $400 /spin and if you hit the ROYAL you get only $1000 and thats tx fee I am a match major by profession but never calculated the odds

I wnder what the vp purist think of this?
