What would you do if someone registered a different tld for a primary domain youve had for 4-5 years? For example you have casinomeister.com and some unethical piece of s__t registers casinomeister.net and embarks on a linking campaign to benefit off of your hard work based primarily on your success?

I think we would all agree that it wasnt an innocent mistake - no?

It's called "cover yo' ass". This is something I went over during my talk at the CAC in Amsterdam.

If it's your business name, notify the webmaster of the wrong-doing and also contact the affiliate managers that the wrong-doer is promoting. Most managers that I have dealt with are quick to unplug an affiliates account because of these sort of under-handed means. In the mean time, if it's worth it to you - trademark your business name.

Casinomeister is being trademarked in North America - the 25 EU countries, and Russian Federation. Anyone grabbing up casinomeister tld's would be obliged to hand these over to me. And webmasters with tlds with similarities to mine might find themselves legally bound to do the same thing.

There is a guy selling the casinomeister.info page right now, and he may not know it or not, but if anyone buys this from him, they can sue him for whatever he charges for it. I haven't told him yet - I'm going to let him find out the hard way

Now that people who used to depend on PPC traffic are going SEO, a lot of this stuff is getting worse and worse.

People are coming up with new ways to steal and cheat all the time.

It is getting to be essential to keep up with the SEO boards.

Quite possibly since you offer a radio/video show that qualifies as product, but I would think that most affiliate based portal sites would not qualify for a trademark. Most portals can be and are protected by copyright laws and many might be eligible for service marks. I would recommend you consult with your legal teams to determine which if any is applicable for you.

As you have surely noticed by my recent postings on your board, I am growing more and more irritated with unscrupulous speculators in this industry. It gets really personal really fast when someone directly infringes upon something youve worked so hard at for numerous years to make successful. Things like this are not honest mistakes they are intentional and are perpetrated by the lowest form of Webmaster.

I was notified a few weeks ago that someone registered the .net of a popular .com domain that we have operated for three years. We notified this Webmaster just three days after they registered the domain it still had the GoDaddy landing page up. We inquired about their plans for development and cautioned them against progressing their plans any further.

This low life opportunist, a member of the seemingly unethical group GPWA totally ignored our request, just a few days later placing a one page site up linking to a popular casino. We have contacted the casino, the affiliate program, and our legal team to pursue an expeditious resolution to this matter. Its a shame that it has to come to this its even a greater shame that people who work in this industry can be so unprincipled.

I can tell you one thing - Vegas just might get really ugly this year. I think its far past time to toss out the garbage and start cleaning house.

The best defense is a good offense. Webmasters should be naming their businesses something unique - something original which have the possibilities to be protected by trademark. Not to do this will only invite others to jump in and weasle some traffic off of your site. I believe the actual damage (traffic theft, etc.,) is minimal - but it's the ethical fall from grace that pisses people off the most.

Yes, I totally agree its best to choose a name that you can brand, something unique that does not consist of keywords just because they are. In cases such as my example above using your name and in instances such as mine its clear that originality is something these morons do not possess. Its obvious that theyre unethical opportunist who, IMHO have no place in this industry!

Again, I concur with your assessment that the traffic they will receive as a result of registering this domain will most likely be minimal. At the same time however I have no doubt that they registered it for that very reason in an attempt to benefit off of our success. The fact that they may not get much traffic in my opinion does not in any way diminish the unscrupulous activities.

As you know from above someone had registered the .net to one of my popular .coms on April 1, 2005 ... I found out that they were a member of GPWA now get this shit!

.info - April 5, 2005

I guess GPWA is out to show they dont care about other webmasters The OWNER OF GPWA - IS listed as the registrant of the .biz and .us !!!

You might understand how upset I am, but you truly dont know. Its like they are throwing stones at my storefront, trying to set my business on fire, you know what kind of things happen when people attempt to sabotage others businesses?
