Hi

I have been removed of my winnings of 21,550 euro after a casino told me that martingale strategy was not allowed on their site.
They have refereed to the following clause in their T&Cs.
"9.4 In the event that we suspect fraud or fraudulent activity on your part or if any of your payments are charged back, and in the event of suspected card counting in any of the live games, we will have the right to withhold any amount from your account which is in excess of your original deposit, and if deemed necessary by us, to initiate any legal proceedings to collect any payments owed by you."
So based on the conversation I had with their fraud and payment manager, I had cheated them by using martingale strategy and I knew about the strategy.

After spending a lot of time on Google searching about this strategy, you are suppose to play small and double every time you loose until you win. That is the martingale strategy and nowhere online I found this strategy was illegal. Yes some casino do not accept it and some actually promote it as it is not proven that it is 100% guaranty win.

So now comes the real issue, when a casino does not accept the "Martingale strategy" or any other strategies they will have to put that in their Terms and conditions. Once I confronted the casino with rules or laws that proved that martingale is not illegal, they came up with a link of a forum where it says martingale is not allowed .
After several request to provide any link that proves the martingale is illegal or not allowed on their website, they gave me the clause from their T&Cs.

After a long fight in their live chat, I was told that if I contact them again regarding this matter, I will be banned from their live chat.

Few days passed and found that they have modified the clause 9.4 which they used for me to remove my winnings.
Here is the new clause:

9.4If we suspect fraud or fraudulent activity on your part or if any of your payments are being debited, and in case of suspected card account in any of the live games, we would have the right to withhold any amount from your part. account that exceeds your initial deposit and, if we deem it necessary, initiate legal proceedings to recover the payments you owe.
When a player tries to win by abusing the Casino unfairly, this includes using strategies such as martingale, doubling deposits in case of losses or similar strategies. The Casino reserves the right to confiscate winnings and winnings on current or played bonuses. We will take the necessary actions if this behavior is of course proven. It is also forbidden to use tools such as robots, software or other assistants, programs or techniques that distort the game and advantage unfairly the player.

Now I would like to add few more clause that they broke just for me.
14.3 Any material changes to the Game Rules and Terms & Conditions will be emailed to all registered customers and highlighted on the homepage of the website and mobile application as well as on the rules page.

No emails were sent to customers, again the server logs will prove that. So any future player using that strategy will see their money gone as they have not emailed their customers about their new T&Cs.

14.4 Any customer visiting Cbet.gg website after a rule change will be met with a screen which requires the customer to acknowledge receipt of the information and does not permit the customer continue further into the website until they have done so.

No screen were given where we have to accept the new T&Cs. Again customers will get a surprise.

Every time a website change their T&Cs, they have to put a date at the end of the T&Cs . That is missing too from their site.

So I want to know if casino can get away with this scam ?
Also if someone could show me the right direction to get my money .

The company details:
www.cbet.gg
License number: # 365 / JAZ accreditation GLH-OCCHKTW0702102019
It s a curacao casino.

Kind Regards
Malik

Curacao - alas there's little comeback in that flaccid jurisdiction.

I have amended the title to reflect the nature of the complaint, to 'won't pay my winnings' rather than 'stole' them. Accusing casinos of theft doesn't help in any possible future arbitration.

I do however have some sympathy if they did indeed change the terms after the event, a sure sign of a dodgy casino.

If this is the case then consider using the PAB service here, I know one or two of the 4 main Curacao licenses do try and cooperate, whether 365/JAZ is one of them, I'll tag @maxd for you - he will know for sure.

But why would you even play there, is what I'm thinking.

If I scroll down on a site, and see curacao licensed, im out.

Like every person should.

I have never used a site to play in my life, I was referred by a twitch streamer.

Dunover thanks for the advice, I have sent a complain to Curacao gaming license authority.

Kashation said:

I have never used a site to play in my life, I was referred by a twitch streamer.

Dunover thanks for the advice, I have sent a complain to Curacao gaming license authority.

Name and shame the streamer

I don t blame the streamer as he use the site but for small bets, I used it for bets like 6k on E-Sport match and used the roulette a few times.
I know that I have a strong case but the question is " I am gonna get paid" even if they are proven wrong.
Btw I have all the screenshots of their T&Cs before and after modification.

If a Streamer is affiliated with such a dodgy casino then, the streamer should also be willing to help players that sign up through him if issues arise. If he refuses or doesn't respond, then out with the streamer's name.

wow, no way that "strategy" is illegal. Or is there something I am missing?
I have lost 10+ blackjack hands in a row multiple times...

lol @ edititing the t&c after they confiscated the money.
You have a rock solid case, imo. To bad the casino is dodgy as hell.

This casino also have a withdrawal limit of €1500 each day, and €10k a month.

Good luck, OP!

I thought you sat for many weeks betting €20 a hand and building that €20k balance - like _really_ really grinding the martingale system.... but you actually went full rage monkeytilt, 4 hands - won - and Cbet confiscates your winnings. Hopefully the casino come to there senses and pay you your winnings. This is hilarious.

No, like I said I did not even know there was a strategy called martingale. I did go full rage monkeytilt.

but I have some update from them, yesterday a twitch streamer was offered 1000 euro from Cbet to play and promote the site for at least 30 mins.
The streamer managed to loose 1000euro in 7mins by using the martingale strategy, he then calls the staff and tells him that he made a mistake and lost all funds in 7mins by using martingale. So here I thought the guy will be banned. But instead he gives him another 1000euro and ask him to stick to slots this time.

I mentioned that on AskGamblers today and they replied “ this was not withdrawable money” so T&Cs vary for them.

I don t get it, I get my winnings removed and called a “fraud” when I did not even used a martingale and he gets a extra 1000 euro when he used the martingale .

That should be enough to tell you what kind of operation this is. Also that its not withdrawable money means the streamer plays with fake money.

Start to watch reputated streamers, playing at good, known casinos.

Hi

I am here to give an update on the case. The casino have no provided evidence against me therefore the case on AG site is closed as unresolved.

Kind Regards

You say if you see curacao licensed your out hence I give you newly accredited casino bitzstarz. Curacao licensed. Said along they dodgy.

And that's why I always say, read the T&C's before you play!

As you mentioned they had already standing in their terms that strategy is not allowed and you played with a strategy (even if you were unaware of that which is hard to proof) so in this case the casino is in their right and will this be more your own mistake due the lack of getting info before playing. Next to th if they change the T&C's (something which casinos always do on a regular base) this doesn't mean that they changed it only because of your case. As it was already stated that they didn't allow strategies in the first place.

Don't get me wrong though, I would be pissed as well when something like that happened to me but it's just how it is and they are in their right and nothing to blame. Unfortunately you found this out the hard way.

I had a similar kind of experience with a different MGA licensed casino over a 30k win which was never been payed and neither casino meister or the MGA was able to solve this. So it's not to blame the curaçao license either. MGA is just the same in my opinion based on own experience.

I hope they will at least refund your deposits (most of the time's casino's doesn't do that and have even in their terms that they don't have to) as a sign of goodwill. This will also indicate if they are at least fair/human and understand the situation for you personally or that they are really that bad as you are trying to show.

He clearly said the clause was modified afterwards and that the terms did not state it being not allowed previously. The clause only said initially that fraudulent activity is not allowed and well, how is Martingale fraudulent? The strat is hardly a surefire way to win unless you have literally infinite amount of money. Furthermore their terms are scammy and dubious.. The clause states that in the event of a loss, depositing double the previous amount is not also allowed... Wtf does that even mean? How can you prohibit that?

There are many other as dubious terms as that.
