The Online Player’s Union (OPU) has the following statement on their website:


“Online Players Union is an independent watchdog (directory) and information service not (*owned by) any casino or sports book.”

It has come to my attention that Pump Poker, and Money Pump, is owned by Damian Dunlap, owner of the OPU. The dot com for Pump Poker uses a “domain by proxy”. The dot net is registered to Damian.

If you were to go to the OPU at this time, Damian and the staff are heavily promoting Pump Poker, yet they are acting like they don’t know who owns it and just happened to find this awesome poker site/casino/sportsbook and rave about it. Why are all of the moderators acting as shills for Damian? Why all of the deception and secrecy? It appears that some of the staff from the OPU are posing as staff for Pump Poker also.

I believe that it is a real conflict of interest for a (self-proclaimed) watchdog site. I’m very concerned about the reasons for the deception.

Beware of Pump Poker and beware of the OPU.

Ummm....have you ever heard of a media buy? We promote several casinos and poker rooms. But because we bought the .net domain name, all of the sudden we are guilty of something sinister???

That's a very serious statement IF it is true, but I don't see it substantiated anywhere in this anonymous post, which imo reeks of a vindictive motive.

DD and I have personally never hit it off, and never will but I find this sort of cloaked accusation distasteful and unfair to say the least.

The fact that the accuser does not have the guts to come out into the open with it helps me discount the claims he (or she?) makes.

Let's pretend for a moment that Casinomeister and staff all have signatures promoting 32Red, and 32Red staff come here to thank Casinomeister and staff for all of the business being sent their way from this site (that is what is going on at the OPU with Pump Poker).

Then a "whois" is done on 32Red and we discover 32Red is registered to Bryan Bailey. It would all be cool? No one would question anything or be upset at anything?

Things would sit better in my mind if Damian and staff had just "fessed up" and told the members that the OPU (or Damian himself) owned or were part of Pump Poker.

By joining the Money Pump 247 Affiliate Program, you agree to be bound by
the following terms and conditions set out in this agreement.

1. Grant of Promotion and Distribution License:
1.1. Money Pump 247 the Referral Company the non-exclusive, non-transferable
right and license to advertise, market and promote the Service ("Promotion
Rights"), in accordance with the terms and conditions hereof. All other
rights and licenses not expressly granted herein are reserved by Money Pump

2. Obligations of Money Pump:
2.1. Money Pump shall retain the right to provide the Service in any form Money Pump deems appropriate; and retains the right to change or cancel any part of the
Service, at any time and in any manner Money Pump deems appropriate, without prior
notice to the Referral Company. However, any strategic change of policy
towards Referral such as cancel any part of the Service at any time shall be
made with prior notice to the Referral Company.

2.2 Notwithstanding the terms of these Terms and Conditions, Money Pump shall not be
held responsible or liable for any loss of income, or loss of the ability to
produce income, incurred by the Referral Company; even if such losses should
arise from the inability of Money Pump to deliver the Services stipulated in these
Terms and Conditions for any reason whatsoever, whether Money Pump is at fault or
whether a third party is at fault.

2.3 Money Pump reserves the right to modify these Terms and Conditions at any
moment.

3. Obligations of The Referral Company:
3.1. The Referral Company shall employ its best efforts to actively and
effectively advertise market and promote the Service as widely as possible
so as to maximize the benefit to the Referral Company and to Money Pump 247.

3.2. The Referral Company shall only engage in advertising, marketing and
promotional efforts which do not violate any law, and which reflect
positively upon the business reputation of Money Pump 247(Pump Poker). In particular, the Referral Company agrees to market the Service in a manner that is consistent with the
content and style of the Service. In connection therewith, Money Pump shall have the
right to review and approve (approval shall not be unreasonably withheld)
the manner and methods of advertising, marketing and promotion used by the
Referral Company in connection with the Service.

3.3. Notwithstanding the approval by Money Pump given in accordance with section 3.2
of these Terms and Conditions, Money Pump shall under no circumstances be held
liable for--and the Referral Company shall indemnify, defend and hold Money Pump
harmless against--any and all claims asserted against Money Pump by reason of the
Referral Company's marketing and promotional efforts.

The Referral Company shall bear all costs and expenses incurred in
connection with the advertising, marketing and promotion of the Service;
including without limitation, all costs directly related to marketing.

3.4. Multiple Accounts: You are only entitled to set up one (1) Affiliate
membership account (Account) with each casino, represented by GW. You may
use your Account in connection with as many domains and/or websites you own
or otherwise have the right to use. GW reserves the right to allow an
Affiliate to maintain multiple accounts on a case to case basis.

3.5. The Terms&Conditions are subject to change at anytime and it is the
responsibility of the Referral Company to be aware of the latest rules and
regulations as applicable to their commissions and payments.

4. Compensation:
4.1. The Referral Companys compensation is calculated based on the Program
(CPA, REVENUE SHARING, FIRST POST-UP or OVERALL DEPOSITS) as set forth in
the following table.

4.1.1 CPA PER SIGNUP (MARKETERS CHOICE)
In this program we pay our affiliates based on each depositing player. Below
is the table of payout in this program

CPA
Up to 25 players per month - $10
26-49 players per month - $25
50+ players per month - $75

Please also note a player is only considered a depositing player should the
player deposit and play through the deposit. This is to protect Money Pump 247 from
potential fraudulent activity. Money Pump 247 reserves the right to withhold commissions
from the affiliate should the affiliate bring in 'problem' players or commit
fraud.


4.1.2. REVENUE SHARING (CLASSIC COMMISSIONS)
In this program we share the profit made by the winnings from the customers
with our affiliate.

Customer Net Losses
Up to $15,000 - 5%
$15,001 to $50,000 - 15%
$50,001 and greater - 20%

4.1.3. FIRST POST-UP - (INITIAL DEPOSITS)
In this program we share 5% of your players first deposit.

4.1.4. OVERALL DEPOSITS - (MONTHLY DEPOSITS)
In this program we pay our affiliates based on total affiliates deposits
during the month. Below is the table of payout in this program.

Up to $75,000 5%
Over $75,000 10%

4.2. "Net Loss" - shall mean, for any given calendar month, the total amount
of the referred Customers losses in the client's websites less the players'
winnings, less bonuses paid to customers by the clients and less any
customers charge backs.

4.3. Negative balance: Money Pump 247 reserves the right to review all Negative Balances
on a case to case basis for determination of pay amounts. Money Pump 247 also reserves
the right to withhold partial or complete payments in cases of Fraudulent
Player Actions, Charge backs, and other specific instances, where
intervention is required.

4.5. Money Pump 247 shall pay the Referral Company each month for services rendered
during the preceding calendar month.

Payment shall be made prior to the 15th working day of the following month.
If the amount of compensation for one month is less than US $200, the amount
shall be made available in the succeeding month (when the accumulated amount
is greater than US $200).

4.6. Money Pump 247(Pump Poker) shall have the right to withhold any and all payments to the Referral Company if the Referral Company is in breach of these Terms and
Conditions.

4.7. In cases where an affiliate is also a player, Money Pump 247 reserves the right not
to pay an affiliate for their personal losses.

4.8. Money Pump 247 may reverse any commission paid to Affiliate, and subtract said
commission from future payments to you, if Money Pump 247 receives a charge back on a
transaction from any customer referred by the Referral Company.

4.9. We have and reserve the right to pass on any Fraud Costs to Your
account.

4.10. Money Pump 247 reserves the right to change the Terms & Conditions at any time,
for any reason.

5. Term of Duration and Cancellation:
5.1. Money Pump 247 has the right to cancel the Promotion Rights with immediate effect
if with the Referral Company is in material breach of these Terms and
Conditions. Such breach includes, but is not limited to, situations when the
Referral Company engages in advertising, marketing, distribution and
promotional efforts that would impair Money Pump goodwill and business reputation,
or would expose Money Pump to legal liability.

5.2. Upon the cancellation of the Promotion Rights, the Referral Company
shall immediately return to Money Pump any and all materials, over which Money Pump has a proprietary right, that are in the Referral Company's possession and/or in
the possession of the Referral Company's agents, servants and employees. The
Referral Company shall also immediately remove any hyperlinks and materials,
over which Money Pump has a proprietary right, from the Referral Company's web site
and/or the web sites of the Referral Company's agents.

5.3. If the Promotion Rights are canceled, and the Referral Company is not
in default of these Terms and Conditions, the Referral Company shall have
the right to continue to receive a Referral Percentage on referred Users who
continues to utilize the Service after being referred to the Service by the
Referral Company during and up to four months from the day of the
cancellation.

5.4. Users that utilize Money Pump facilities and services and all information
relating to such Users shall remain the property of Money Pump at all times.

6. Account Statements:
6.1. All payments due to the Referral Company shall be made on or before the
15th working day of each following month, and will reflect payment for
services rendered the preceding month. Statements may be adjusted by Money Pump from
time to time to reflect overpayments, player charge backs and/or credits or
underpayments to consumers by Money Pump.

6.2. The Referral Company shall have the facility to monitor the Referral
Percentage and the payments in real time using an online monitoring system
at a secure web site.

6.3. Should the Referral Company dispute a payment received, the Referral
Company has 60 days from the date of receiving said payment/s within which
to lodge a claim or to challenge the amount paid. Should there be no
objection raised within this period then the amount tendered will be
regarded as accepted and no further claim/s will be entertained.

7. Exclusivity, Non-Competition and Ownership of Service name:
7.1. The Referral Company agrees, understands and acknowledges that Money Pump 247 may enter into Agreements of this type with third parties to promote the Service
or a similar version thereof.

7.2. The Referral Company has not paid consideration for the use of the
trademarks, logos, copyrights, trade names, or designations belonging to Money Pump,
and nothing contained in these Terms and Conditions shall give the Referral
Company any right, title or interest in or to any of them.

7.3. The Referral Company acknowledges that Money Pump own and retain all copyrights
and other proprietary rights, as well as any software supplied by Money Pump, in all
of the foregoing. The Referral Company shall not assert any claim or
interest in or to any trademark, trade name, copyright, service mark or logo
belonging or licensed to Money Pump, or do anything to adversely affect their
validity or enforceability. This includes any act or assistance to any act
that may infringe, or lead to the infringement of, any software copyright.

7.4. Without limiting the generality of the foregoing terms, the Referral
Company shall not itself attempt, or assist any third party in attempting,
to register any trademark, trade name or other proprietary right with any
governmental agency (federal, provincial, local or otherwise) or with any
other entity or authority, without the express, unequivocal and unambiguous
prior written consent of Money Pump or Pump Poker. The Referral Company shall not attach any additional trademarks, logos or trade designations to the Software; and
shall ensure that none of the trademarks (or any variations thereof) appear
in any portion of the Referral Company's name, or any name under which the
Referral Company conducts business. The Referral Company shall not affix a
trademark, logo or trade name of Money Pump to any non-Money Pump 247 product. The Referral Company shall not alter, erase, deface or overprint any notice of
proprietary rights on anything provided by Money Pump 247.

8. Confidentiality and Non-Disclosure:
The Referral Company and Money Pump each agree that each may have access to, and
become acquainted with, Confidential Information of the other. The Referral
Company and GW each specifically agree not to misuse, misappropriate or
disclose any such Confidential Information, directly or indirectly, to any
third party.

9. Representations, Warranties and Indemnity:
9.1. The Referral Company warrants, represents and covenants to Money Pumps that it
has all necessary rights, licenses, permissions and business permits; and
will comply with all applicable laws, rules and regulations in connection
with promoting the Service to Users.

9.2. The Referral Company agrees to indemnify and render Money Pumps harmless against
claims, liabilities, causes of action, damages, judgments, costs and
expenses arising out of, or in any way connected with, any breach or alleged
breach by the Referral Company of any representation, warranty or agreement
contained in this Section 9, or elsewhere in these Terms and Conditions.

However I am concerned that an organisation such as the OPU which is designed to represent players, should be truly transparent, and there should be no hidden motives or agendas.

There are a number of coincidences here , which I would like to see clarified by either Damian or Mark.

What is the true nature of the relationship between the OPU and Pump Poker?

Also why is the ownership information for Pump Poker marked as private? Surely a trustworthy and transparent operation with nothing to hide would not need to hide this information from prospective players.

Why were the domains pumppoker.com and pumppoker.net registered on the same day - if there was no prior discussion between the OPU and Pump Poker how did Damian know that this domain extension was available? They are also both on the same nameserver.

The evidence points to a link between the two organizations - the question is why would they not just transparent with their members instead of handling it as they have.

I think that is remarkable but not conclusive. Remarkable enough for a further and more specific and clarifying denial from the OPU, perhaps.

You seem to be doing a lot of work on this, Heerlen - is your interest purely casual or do you have an axe to grind in this like the instigator of this thread?

There was a post a little earlier asking some pertinent questions for clarity, and perhaps Mark would return and address those points, which in turn would presumably give the lie to the anonymous people at work here?

It takes very little time to do a whois search. I love a good mystery!

As far as the axe to grind question, I don't really care for DD and I am disappointed because I thought that the OPU was going to be something good for the gambling industry and unfortunately, it isn't turning out that way. Other than that though, I don't give them much thought.

Re. misspellings: Spammers use them all the time to pass through filters, like most all of us know all too well.

Also, site owners often use them in SEO efforts or at pay per click engines to get those visitors who misspell what they are searching for in the search engines.

Both people could have copied some text to post that was originally purposefully misspelled.

This thread has obviously been instigated by someone who wants Damian's axx, Damian has certainly offended a lot of people. Because of that, I take it with a grain of salt, or maybe a whole salt shaker.

As far as the facts regarding pump poker, it does look like Damian might have a hand in it to some degree or other.

There are all kinds of creative deals regarding financing and ownership of poker rooms as well as all other gambling properties.

Due to the special situation with the OPU, this financial relationship does need to be made transparent now, if there is one.

I just wish I didn't have such a bad taste in my mouth about the motivations of the original poster.

Yes,i know thats true.....The only person i've seen spell it like that though is Damian....and Ashley is the manager of Pump Poker isn't she?I just found it funny she has the exact same error.I guess she must have copied the post from him.I'm happy the original poster brought this out in the open myself.

While the motivations of Suzecat were suspect, (she's the OPU's shill for Virtual Casino's Danny, and OPU had just lost Fortune Lounge as a sponsor), there were still some legitimate concerns in the thread. Maybe it will help you to focus on the legitimate concerns that were raised?

That is absurd. Suzecat has been a member of the OPU since we were on ezboard. She is free to say and do as she wishes. Ask her, and she will confirm, she is not a paid staff member of the OPU. Nor is she a shill for Virtual ANYONE.

Ummmmm.....no. We "Lost" NOTHING. But by making that statement, you identy has become quite obvious. The OPU still has an affiliate relationship with Fortune lounge. The contract you are speaking of, was with slick street marketing. But you already knew that didn't you?

This is interesting. Yes, that post did change my view of things.

You know, media buyers can be a chatty sort.

I am sure I am not the only person who is aware of the smear campaign carried out against the OPU at various media buy places.

It is very difficult to keep secrets in this industry.

Now I am quite sure this is part of the same smear campaign.

I think the OPU should just ignore this stuff - ain't nobody's business but their own.
