Spammer! 2 accredited casino affiliates spammed me 1 hour apart: Sun Palace & English Harbour

Tonight I received TWO different spams promoting TWO different ACCREDITED casinos.

In BOTH cases, live chat brushed me off.

The English Harbour rep's exact words were 'what do you want me to do about it?'

The first one promoting Sun Palace Casino came from affiliate id #24470 and is written to deceive, making one think it came from the casino itself and includes personal info.

Not surprisingly it traces back to the same server that The Virtual Group uses and there are many scam/spam sites also registered to the same IP address.

P.S.

I have included some information on our Certification and Fairness Policy. Since December 2002 Sun Palace has paid out over $17 Million in winnings. To ensure absolute fairness and full function of the system including its ongoing accuracy, a sophisticated RNG (Random Number Generator) is utilized. The software carries an official Certificate of RNG Evaluation from TST (Technical Systems Testing), a respected Accredited Testing Facility and principal consultants to major gaming regulatory bodies worldwide including in Nevada.

TST performs RNG Evaluations with a special emphasis on the distribution and unpredictability of the RNG application. TST has verified through mathematical and statistical analysis that the RNG distributes numbers with sufficient non-predictably, for distribution and lack of bias to particular outcomes. Furthermore, the average payout percentage, which is the percentage of total winnings to total wagered amounts, is reviewed on a monthly basis to ensure our system's on-going randomness and fairness. For your added protection, we maintain a complete audit trail of each individual transaction for all the games that you play. At your request we would be pleased to make these files available to you for inspection.

Sun Palace uses the credit card services of Park Lane Services Ltd., ensuring secure, fast and easy online transaction processing. Park Lane Services Ltd. is a multinational firm that handles thousands of secure online transactions every day. It is of the utmost importance to us that you are completely confident and comfortable with all your transactions while playing at Sun Palace. Thank you.

I have tried contacting them repeatedly, and I am having NO success.

They have ignored all emails and live chat STILL have the same ignorant attitude.

Plus, these emails are all written in away that seems to be coming from the casino itself.

According to the Accredited Casino Rules:

Marketing Standards
Must not use false, misleading or deceptive advertising.
Must not spam, and must take appropriate actions against any affiliates or any third parties who do spam

Which they are NOT doing.

For the third day in a row I have attempted to contact someone at English Harbour regarding this spam.

Today, they made their OFFICIAL POSITION be known:

Nina: Hi
Nina: Is it possible you can give us a detailed explanation of your issue so I can put you through a supervisor or manager?
you: I have a problem with an unscrupulous affiliate whois spamming
Nina: About Spam e-mail there is not much we can do for you unfortunately as we do not send it out we are unable to control the spam traffic.
Nina: We do not send them out, and since we are not the ones sending it out we are not able to stop it. Please accept our apologies.

you: okay...keep that particilar attitude. As a Casinomeister accredited casino you are REQUIREDto obey the rules, that include: Marketing Standards Must not use false, misleading or deceptive advertising. Must not spam, and must take appropriate actions against any affiliates or any third parties who do spam
you: as you are NOT willing to obey these rules,I will forward a copy of this chat transcript to the owner to review your status

Some of the rules the Casinomeister have posted in order for a casino to be considered accredited include:

Must be able to take care of any player issue swiftly and professionally.

Must not spam, and must take appropriate actions against any affiliates or any third parties who do spam.

It's been FIVE DAYS since this spam began. I have contacted EH via email and live chat more than a half dozen times, and I have been ignored or rebuffed every time.

Must have a representative (who can walk and chew gum at the same time) listed in Casinomeister's forum.

So not only doEH not care about this spam, they don't even have a rep here anymore.

I think it's time that this casino group LOSE it's accreditation status.

Here's your "smoking gun". This is DIRECTLY initiated by the casino, and NOT from an affiliate. This is a large email bulk marketing company specialising in running bulk mailing campaigns for many online casinos. The casino in question must have made a contract with this company in order for the emails to be sent. Limited personal information may also be passed to this company because they also provide some services to existing players, such as promotional emails. Cross marketing is also a possibility, getting a player at one property to play at another. This is how you can be addressed by name, even if your email address does not contain it. It seems the casinos are interested in results, and do not concern themselves too much with how they are achieved, which appears to be through spamming in these cases.

There is another company with a similar address operating from the same place that is more focussed on mailing existing players. They are close enough to be sharing information "off the record", not that there is much in the way of regulation of this kind of activity in Belize. Companies can operate with considerable secrecy, a bit like Swiss banks, which is why they go there.

If this is true and this spam is coming directly from the English Harbour group, then this is grounds for IMMEDIATE REMOVAL FROM THE ACCREDITED LIST

It would be, but a greater level of proof is needed. This company is rather secretive, and it's activities are only obvious to players because there address is "everywhere". I had thought only MGS casinos were using them, and English Harbour isn't MGS.

Being based in Belize, they can easily claim that what they are doing is perfectly legal, IN BELIZE, even though to the rest of us it goes against the various anti-spamming laws.

The way they have set up the operation, different domains, and odd looking sender addresses, is how many spammers work. The difference is that they try to cover their legal asses by adding their company address to the email, which they probably think gets them off the hook as far as spamming goes.

To show that this is directly commissioned by the casino, you would have to show that no affiliate is involved, which means no valid affiliate tracking is used when downloading and registering from the suspect email. This requires a knowledge of how the program tags affiliate links, and how this differs from any tagging for direct marketing campaigns.

It seems that players are entirely dependent on the good will of the casino to control spam, if the casino wants to spam, we can't stop them.

The industry are just making a long term problem for themselves through their limp attitude towards spam. They make quite a bit of money through inaction against spam, and it seems that only load and insistent complaining gets results. The long term problem is that increasing levels of spam are driving players to take direct action, rather than wasting their time fruitlessly trying to convince the casino to quit spamming them. The threat I have seen recently is that players are simply reporting the inbound spam to SpamCop, and telling the casino they will be doing this if they are spammed after requesting not to be. The long term effect is that their domains will be added to the blacklists used by major email providers and ISPs. WE can already see this with casinos, and this site, simply giving up and telling members that certain email providers will no longer be allowed in the registration process since it has become impossible to deliver LEGITIMATE emails because their content (or domain server) has been blacklisted as spam. AOL was the first, but then the problem spread to Yahoo and Gmail. Although the result is less spam, it also means never receiving GENUINE emails, such as requests for ducuments, or deposit offers. This hurts the industry by giving loyal players the impression that CS "never answer emails", or they are "never asked for documents or told about offers". email providers are also being more aggressive because spam clogs the service, and they need to protect it for the majority of users who do NOT use the services normally associated with bulk spam, such as Viagra, cheap software, and online casinos.

Okay...let's investigate:

..and, of course tracing the site finds:

So who are they coming from? Does the name Randy B White mean anything to anyone?

I would like to let you know that we are trying to make contact with the affiliate to ensure his unsubscribe links are working properly and reiterate the fact that English Harbour does not condone spamming.

Also just a note, emails directly from the casino brands would come from promotions@CASINONAME.com , this is one way of confirming if its an affiliate or the casino marketing team.

Thank for your support.

What a fu^%$*ng joke.

It takes you EIGHT DAYS, 5 live chats and countless emails just to get 'we are trying to make contact with the affiliate to ensure his unsubscribe links are working'

That's it?!?!?!?!

Two low-life criminal spammers, and all you are willing to do is 'try to make contact' instead of doing the ethical thing, which is to immediately close the affiliate and casino accounts and confiscate their commissions?

Not only have you guaranteed that no English Harbour property will EVER get my business, but I reiterate my stance that:
ENGLISH HARBOUR HAS CHOSEN TO NOT FOLLOW THE CASINOMEISTER GUIDELINES REGARDING ACCREDITED CASINOS AND SHOULD HAVE THEIR STATUS STRIPPED IMMEDIATELY

lol
i agree with the fact spam is very iritating.
i also agree that the english harbour group should be questioned more vividly on this, but they are not the only ones doing this.
i might even say that at least they reacted here, albeit late, and not really satifying.
however it seems to be a complicated matter, with all the redirects, ip-cloaks, fake addy's etc.
i wouldnt be to sure of where in the end these mails exactly come from.
if you do however have found the direct sender, isnt it possible to report them to some instance?
i also read here and there that you guys here have ways of sending spammers
to their own hell, or have i misinterpreted the "this ip will be treated with the proper respect/attention" comment?
i still know nothing specific on this topic, but i would like to learn more:
the previous weatherman posts were somewhat claryfying, so ill continue to follow the thread:)
hope you get those guys to stop or drop

OK if a PLAYER seriously violates the rules, what do you do?

1) Confiscate his withdrawal, making the PLAYER justify himself?
2) Pay him whilst attempting to make contact with him to advise him that his play is currently in breach of the rules, and that he will not be paid IF HE DOES IT AGAIN.

I believe affiliates get paid monthly, so there is room for compromise. BLOCK all further payments UNTIL you have SUCCEEDED in making contact, AND the affiliate has either confirmed they have done nothing against the rules, or has paid some kind of "fine" for the money made from the spam.

A punishment short of a full ban could be the untagging of ALL players found to have been recruited through spam, this would ensure affilates do not derive long term benefits from spamming, but would also allow for the option of rehabilitation, rather than an immediate ban. There are some occasions where casinos will give a player the benefit of the doubt, and take a similar stance of rehabilitation, BUT it seems affiliate are ALWAYS given the benefit of the doubt, whereas players are always presumed guilty, and have to FIGHT even to be granted the option of rehabilitation because they made a genuine mistake, rather than deliberately breaking the rules.

The content and deceit seen with some of this spam makes it CLEAR there was no "genuine mistake", it was a deliberate attempt to profit from a spamming campaign, often quite a sophisticated one.

Simply telling players this:-

Also just a note, emails directly from the casino brands would come from promotions@CASINONAME.com , this is one way of confirming if its an affiliate or the casino marketing team.

....is a complete load of bollocks, showing how little you know about the technical side of the subject. Spammers ROUTINELY "spoof" the sender address so as to appear to come from valid casino email addresses, and spam WILL appear to come from promotions(at)casinoname.com - but this will be because the spammer has spoofed the header so as to make the email look legitimate. A better indicator is the content, and casinos have to cooperate. Simply put, they should include content that ONLY the player and casino can possibly know. For existing players, this is often their casino account number, which is one thing that should NEVER be passed on by the casino to ANYONE. Using their name only doesn't work, spammers can get hold of this, and can make the content look as though it was genuinely intended for a specific person. Older email addresses were imposed by ISPs, and often took the form "firstname.lastname.nnn(at)ispname.com". Spammers simply look at the recipient address, and make an educated guess at the name, and with this type of address, they get it right.

I have seen PROOF of this, because I am sometimes addressed by spammers as,

Dear Vinyl,

Dear Mr Weatherman

Dear Vinyl Weatherman.

Simply put, they have software attempting to work out my actual name from my email address used in many internet forums. In this case of course, it comes out as complete rubbish, and makes spam detection VERY easy:)

It is far easier for spammers to find out the names of persons working at the casino, making it VERY easy for them to create a fake signature to make the email appear to come directly from the casino.

Now, what about when you have an email address that does NOT contain your name, AND it contains something personal about you that can ONLY be known by the casino concerned, or something that has to be known ONLY by industry insiders. Add to this, there is NO AFFY TAG, so no way for a spammy affiliate to be rewarded for recruiting a player.

1) WHY would a rogue affiliate do this, there is no way they can be credited for the referral without a tracking tag?

2) How ELSE can there be payment for such a spamming campaign.

the most obvious answer to both 1) and 2) is that the spam is the resulot of a "direct media buy", rather than through an affiliate. The marketing company is paid an advance fee for promoting the casino, and thus no tracking tag is required. There MAY also be a special landing page set up to receive inbound click throughs, thus enabling stats to be formed to assess the performance of the campaign.

The EH spam looks more like a "direct media buy" than the work of an affiliate (unless they are a large, well resourced one). The landing pages are hosted on emv3.com, seen in quite a bit of spam. It's a hosting and marketing company's server, and a company that takes a rather liberal attitude to policing the behaviour of users, which is why so much spam goes through them. I think this was earlier shown to be a server belonging to "elabs", a prolific spammer dressed up as a direct marketing company.

Cynics might suggest that the inability to contact the affiliate responsible is because there isn't one, it's a media buy gone out of control.

Hey English Harbour:

The spam hasn't stopped yet!!!
