What's REALLY bad about this whole affair is the LYING and COVER UP, which went RIGHT TO THE VERY TOP (i.e. RTG themselves).
The operator LIED about them needing a 48 hour offline period in order to upgrade. RTG MUST have known at some time that they had actually ceased operating, yet kept quiet about it whilst players and affiliates attempted to make contact without success. When complaints started coming in via CDS, they simply brushed them aside by saying "xxxxx is no longer operating", yet there is STILL no official press release about this.
It's not even just a case of them ceasing operations either, they have BAILED on their obligations, and have used to server upgrade and outage as cover to buy themselves some time to "do a runner", making it harder for them to be pursued.
RTG have NOT simply "done nothing", they have ASSISTED the operators by keeping secret the fact that the server upgrade was a lie, and that they had really ceased operating.
They could simply have gone bust, but did so in a highly questionable manner, NO calling in of liquidators, contacting creditors as to what is happening, and how they should claim what is owed. They also had a head start if their idea was to "do a runner" WITH THE MONEY LEFT IN THE COMPANY, which is ILLEGAL in almost any country you can think of.
When MGS were in a similar predicament with TUSK and Eurolinx, they had NO money held "in trust", BUT, they DID at least make official statements regarding what they knew, which made it clear what had happened, what players should do, and eventually, who they should be contacting (the liquidators). RTG have said NOTHING so far, and now it is too late.
Players who deposited by credit card though at least have a chance to recover SOME money through the card companies, and since it now looks like a case of the operator having gone bust, the door is open.
