Any casino trying this sort of term against affiliates should be blacklisted everywhere in my view.

I know, but its targeted at UK, someone could quite easily argue its 50 euro though if they ever tried to charge someone the fee

I'd dump any affiliate program that tries to include this term. I'm happy to ensure we work hard to prevent any breaches and I'm confident we're way ahead of the market. But £50k fine with the decision being made be the benefactor confident? No. Ultimately we'd refocus the business outside of the UK before agreeing to these terms if they became that widespread. This is entirely predatory.

There is no way they would ever be able to enforce this in a UK court. It's an unfair contract term. They could insist that you put in your review 'this casino pays in 5 minutes and has a higher payout rate than any other casino in the world' and fine you 50k if you refused, I am confident no court would ever enforce such a blanket term.

Every casino who brings in terms like this should be blacklisted, Sky's '6 per month' quota got them blacklisted at most sites, I'll bet theres not a single affiliate who lost 50k due to that.

Totally agree - it's the same as my opinion on these 'we can change any term and any time and your only choice if you don't agree is to abandon your historic earnings' - I don't think that term is likely legally enforceable either. But any program that is prepared to try and add this 50k term is making very clear what they think of their partners.....

Yep I agree 100%.
Bet365 have closed my account, which I am extremely annoyed about as I complied with everything, was even talking to my affiliate manager at the time they sent the contract out, I didn't get the email, he resent it and I returned it in less than an hour, but closed the account as I didn't return it on time, but they are still paying for existing customers, just not any new ones (as long as no clicks are registered, which isn't a problem for me!)

Or else surely just contact your affiliate manager and they will get you going again? I don't agree with that £50K fine at all. No way in hell that should be allowed to put in such crazy fees or rules.

Would be fair though if the exact fine the provider would end up getting was put onto affiliate, if it really would come to that. But of course within fair limits like maybe a smaller amount and if happens again would be higher. (not sure how to word it proper sorry).

BUT in one way that is for their affiliate program as well to check that their affiliates are doing things correct.

How about someone helped affiliates instead and forces ALL affiliate programs to have in their terms and condition, that in case affiliate program shuts down early or close someones account who has not been in breach with terms and conditions, that affiliate will be entitled to still be paid Revenue for life or a lump sum of average calculations up to £50K as max.

Your account [xxxxx] is currently suspended because you did not reply in time to the bet365 Affiliate Policy email we sent to you on 5th October 2017.

As a responsible operator, we must ensure that we can work compliantly with all affiliate partners.

To ensure such compliance, we feel that it is necessary to reduce the number of affiliate partners that we have. It is with deep regret that we are therefore sending you this email as notice of the termination of our affiliate marketing relationship with you with immediate effect and require you to immediately remove all bet365 promotion.

We apologise for any dissatisfaction in advance and want to be clear that our decision is simply to ensure that we can continue to meet our legal and regulatory obligations in a focused and streamlined way.

Notwithstanding this termination of our affiliate marketing relationship with you, we recognise and appreciate your hard work during our relationship and, subject to the below and as a gesture of goodwill, will therefore honour your revenue share payments for customers that you have already referred to us.

Despite the fact that our affiliate marketing relationship with you has ended, you will be able to continue to login to your account in order to check your balance and make withdrawals of these funds.

We appreciate that your current affiliate balance is negative; however we are hopeful that at some point in the near future you will accrue a positive balance and will therefore be able to withdraw.

To enable you to receive commissions from customers that you have already referred as outlined above, we will need to verify that you have removed all promotion of bet365 from your sites/channels and you will have to ensure that clicks from your advertising do not appear within any of our future reports.

Please note the £50 minimum withdrawal requirement will still apply due to costs associated with payment processing.

If or when we are in a position to enable you to promote bet365 again in the future, we will of course be in touch and would hope that at that time you would be willing to work with us again.

Please respond by the 5th January 2018 with the following:

- Formal confirmation that you accept the terms above.

- Formal confirmation that you have removed all bet365 promotion and exposure from all of your website(s) and marketing channels and that you will not promote bet365 in the future without our express authority to do so.
If we do not receive a response from you by the deadline and/or we find that you have breached the above then we will withdraw our goodwill offer to pay the commission on referred customers outlined above and you will not be entitled to any such payments.

Once we have your reply and have verified that you have ceased promoting bet365, we will advise on how to process your withdrawals moving forwards.

I checked with a friend yesterday who is a lawyer at a London firm and you can add a paragraph to the legal terms page on your affiliate site about checking the accuracy of promotions via the casino's t&c link (which each casino now has to provide).

If you include this then the affiliate (you) are not responsible as you are covered by your own legal T&C and meet ASA guidelines by linking directly to the casino terms.

Also, I highly recommend a ASA audit. It's ranges from £1000 to £2500 per affilate site but gives you complete piece of mind and certification in case of any future bullshit from rogue affiliate operators:

We were already in the process of adding this term - seems an easy to do disavow at least some responsibility.

Yes, was speaking to their Aff Manager in Berlin and he didn't seem too happy with what was about to happen in regard to UKGC Rules and affiliates and the steps they were going to have to take. The big casinos such as 365, SV, Coral etc. can afford to dump affiliates as their revenue proportion from them is far less than it is for smaller casinos new entrants to the market.
