Based on the 1935 copyright registration, Warner claims that the United States copyright will not expire until 2030, and that unauthorized public performances of the song are technically illegal unless royalties are paid to it. In one specific instance in February 2010, these royalties were said to amount to $700. In the European Union, the copyright of the song will expire on December 31, 2016. The actual American copyright status of "Happy Birthday to You" began to draw more attention with the passage of the Copyright Term Extension Act in 1998. When the U.S. Supreme Court upheld the Act in Eldred v. Ashcroft in 2003, Associate Justice Stephen Breyer specifically mentioned "Happy Birthday to You" in his dissenting opinion.

Somt other interesting facts you may not be aware of. In China, giving a gift of a clock for a birthday is considered bad luck. The most common birthday in the us is October 5th. I guess that means a lot of Americans 'get busy' around the Christmas holidays :) Globallyt the popular date is in August.

A poor investment.

Whilst technically worth $5 Million, performances of the song tend to be on the spur of the moment, so unless they have a squad of "secret music police" gatecrashing every event that looks like a birthday party, they are going to struggle to collect enough to cover their investment, let alone the cost of enforcement.

With a single month's royalties estimated at $700, this does not even cover the wages of ONE snoop, let alone a whole squad.

I have heard the song performed in Mc Donalds when they have a children's birthday party laid on, but one has never been raided by the police to check that permission has been granted to sing "Happy Birthday" to some 4 year old.

It is also worrying that some company can just randomly pick a well known song who's origins are vague, and just say "It's ours now", and profit from it for decades. Copyright exists naturally in a work, it does not necessarily have to be registered.

How about someone goes over to Summy HQ and ask "have you registered that nice lobby sofa?", "no?", "Fine, it's mine now, I'll take it as soon as I register the warranty".
