Casino took my chips?

Hey,

So, I was playing blackjack in an Australian casino at a $25 table when an Asian man started to harass me for gameplay, I was playing third base and he took exception to a few of my decisions and informed me I wasn't much of a player or a man.

So I threw my glass at him (short scotch glass) and it just bounced onto the carpet but I was soon ejected by security and my chips were still at the table, they wouldn't let me back in or give me the money for them because I apparently 'spat' on one of their guards while they were ejecting me ( who wouldn't!!!! ) ..

I now have no record of even betting & the casino wont return my calls, what do I do?

Who can I sue for this?

Absolutely. Sue.

Hire the most expensive lawyer you can find, and take it all the way to the Supreme Court.

After that, come back to the forums and tell us all about it. I could do with a good laugh.

At the moment I am considering starting a legal donation fund to bring a huge lawsuit against this casino as well as obviously starting a website to shame them into giving me back my $320.

I will also launch a PIB complaint today.

I will fight this all the way to the Supreme Court of Australia & if need be the Governor General.

It's not the $, it's the principle but I also want my $ back.

Your actions were out of line but it does not justify the Casino confiscating your funds. Taking someones money because they were involved in a fight or argument is theft.

I would suggest that you write a letter to Management and request your money. If not, you could possibly consult a lawyer.

I am sorry, Nate, but I disagree! This guy threw a glass at someone, that is called assault. He should be grateful that they didn't have him arrested.

I would like to see him sue. It would be quite amusing, IMO. He might get more than he bargained for, in the way of fines from the court from a frivolous lawsuit. :D

You have to be kidding , you come here looking for sympathy LOL
I wouldn't be surprised if you are not barred from all land base casinos in Australia. I do hope they have the same sort of security they have in Vegas. There you would be in a book of person non grata..
You should try and contact the casino, apologize for being an a$%^%$hole and try and find that asian player and apologize to him for your uncivilized behaviour

Seriously dude, that's no way to behave in a casino - or anywhere else for that matter.

But on the flip side I don't think they have the right to take your cash from you. If I ran the casino I'd be giving you your money but banning you for life. No offence... :p

While it is quite horrendous that you acted in such a way, I am not so sure that anyone has the right to keep your money.

Lets say I was having a private poker game at my house and someone got out of hand, threw glasses etc etc, and then my hired security :D had to take them out and remove the from the premises. Would I be within my rights to keep that persons money at the table? Of course not, well unless it was my husband.... It wouldn't be ok for me, and its no different for any casino for that matter.

Just sayin....

May be the casino kept the money to help pay for the doctor's visit for the security guard you spat upon. In my little corner of the world, when you spit on a person in/during an altercation is it considered a form of assault with a deadly weapon.

Good luck with your lawsuit, let us know how you made out....

It seems the casino decided to keep the money, but not press charges. If the OP were to sue, the casino would probably lodge a counter claim. The OP would easily win their money back, BUT the casino would win some damages for the security guard, and the disruption. This would most likely be more than the money taken from the table.

The OP would be better off letting the licensing authority deal with this matter, and avoid going to court.

What seems odd is that the behaviour of the Asian player before this incident was ignored by the casino security, and this fact is what drove the OP to take the matter into their own hands - albeit the wrong way.

The OP should have left the table, and made a formal complaint to the casino about his being harrassed at the table by another player, and the casino doing nothing about it. This would mean that the casino had LOST a customer because they allowed another customer to get away with aggressive behaviour. They may then have offered the OP something to compensate them for the inconvenience, such as a free room, meal, or show - in the hope that they would calm down, and return to the games later on.
Surely there was another Blackjack table available in any case.

More like Attempted Assault. The only time the Casino could have him arrested is if the person he threw the glass at decided to press charges. Spitting on a Security Guard may hold water for a charge, however; I do not think that the Casino would want to waste the Courts time for a petty offence.

Keeping money, because someone tossed a glass, spat or swore at you is not good practice. It could be compared to an individual being rude to CS and the Casino holding the funds (It has happened).

In any event, I do not doubt that the Casinos intention was not to profit from throwing the OP out, but in making a point. Im almost certain he will be reimbursed if he follows the correct channels.

Om second thought , why was it necessary for the OP to distinguish that the harasser was Asian? Did it add any relevance to the complaint?

Of course.

He is a racist so-and-so and obviously considered that attacking an Asian was OK.

I couldn't be bothered, but someone might want to look up the terms of entry for Crown Casino as it may well mention forfeiting chips on the table under certain circumstances.

it is common for chinese or maybe asian bj players to criticise other players who draw cards when they are at 12-14 against the dealer's card when it is 3,4, 5 or 6. they call it a chance ie the dealer busts when drawing 2 high cards in succession. i also feel irritated by these people and occasionally give them a piece of my mind but wont resort to violence.

Uhm.. possibly because they are renowned for being aggressive little men with small ding-a-lings!!!!

Some progress to report:

I have contacted a solicitor to start legal proceedings against the casino involved for the return of my original chips & some punitive damages totaling some $15,720 for the emotional distress of being physically ejected from the casino.

I will report as the case proceeds.

You've just turned a sensible conversation into a racial, generalising and discriminatory one. Seriously... You are out of line.

This is why race can be relevant in such cases. Asian players also have other customs, such as wanting to peek slowly at the cards in Baccarat. This is why we get many "Asian rules" variants of some casino games.

However, common practice does not make something OK. Verbally berating a player just because they play differently to oneself is bullying, and can be considered a "verbal assalt". The OP's problem was that he rose to the bait, and made the first move of a physical assalt.

From the postings, the OP comes across as aggresive himself, and something of a "bully", yet this is exactly the kind of behaviour he couldn't take when it was done to him.

Oh, I know he will get his money, but...... The problem with so many people in this world is that they pay no consequences for their actions at times. That is wrong.
