Its just because in the PAB rules it states that i shouldnt had mentioned my case here in forum. But from start i never thought that i would end up getting my winnings confiscated :(

But i am going to fill in the PAB now, will prob take a long time. I want to make sure i do it correct and with all information as well :)

Unfortunately the bonus terms and conditions cannot be waved. The terms are clear that you cannot withdraw before you have made the £20 deposit. As the terms have not been met, the balance has been confiscated as all wagering is void.

This can not be a rule for confiscating my win??? i have been in contact with casino every day, but not had any reply to my email sent just after wagering was completed.


i'm starting to lose faith in a lot of casino's these days,(sadly i have just started promoting some, I'm really starting to think maybe its not such a good idea.)

Where has communication between casino's and players gone?

From what the OP has said albeit YES he was trying to see if he could get the $250 Bonus without the $20 deposit.

He had contacted live chat and emailed them on several occasions. WHY not then can't someone say HOLD on champ you need to make a $20 Deposit before you can have that $250 Bonus!

Instead they tell the OP the docs are in order etc etc etc.

Do they not tell him deliberately to then turn around a laugh and say WELL you did not do this so no moneys for you.

The silly thing here is the fact a player is turned off & will not return. I understand if some out right breaks T&C i fully support a casino doing what ever it is they do as these people make it harder for the rest of us.

A silly mute point is the fact in there own T&C they say "contact us and we will be glad to help"

I do understand the player has some responsibility but where does the Casino's (not just this casino in particular) start & when should they take none.

Obviously we don't know the full story i'm just going by whats posted here.

I agree this is ridiculous. Sure, asked a withdrawal first but he did have the intention to deposit if needed. The casino could have easily just put a hold on his request until his deposit was in. Very childish to snatch his money and say "sorry, you didn't abide the rules". There was no abuse whatsoever.

Besides, this term is probably for that specific promotion because on the T&C on the casinosite don't mention a deposit requirement (or I have missed it):

No Deposit Bonus (where offered) Terms And Conditions
1. No deposit bonuses (where offered) are only available to new Real Players.
2. Because NO purchase is required the total winnings on all NO-DEPOSIT bonuses are limited to $/£/€/AUD/CAD250 (or local supported currency) maximum. Should the player win in excess of $/£/€/AUD/CAD250 the excess will be removed from the players account before fulfilling the cashin.

Guys, there's a PAB on the table so let's wait and see what the casino has to say for themselves before we sent out the lynch parties, no?
 
The PAB is complete. My decision was to support the casino and reject the OP's claims against them.

My decision is primarily based on emails the casino people received from the OP: from the very beginning it was clear he had no intention of depositing and he constantly made reference to the good things he could do for them here on Casinomeister if they saw things his way. This is unacceptable and unsupportable behaviour. Case closed.
 
Well, as in so many other cases I am sure we do not have the whole story but i just dont understand why people have to bring up Casinomeister in livechat and emails with the casinos.

I'm on Casinomeister, have you heard of Casinomeister, Casinomeister is very popular, it would be great for you to be mentioned on Casinomeister and I'm on Casinomeister so I could mention you on Casinomeister ...
is a whole other thing.

Of course I'm not actually quoting the OP and he may not have been aware of the effect of his statements, but I trust you get the idea.

One thing is what the casino has told You another thing is that i suddenly now get accused for "blackmailing" ??? :mad:

I have allready sent a long email to Casino La Vida which i have asked support kindly to forward to pitboss. Also spoke on live chat when i deposited the other day (they gave me 111% on top of my 20£ deposit) so got 42,20£ to play with, i told in chat i did not wish to play with the bonus and kindly asked to get it removed, but Kim took them off and added them to cash balance instead, which i off course told, because would not risk any problems ;) But that was very kind, allthough i did loose them anyway, but happy and appreciate how kind "Kim" was in support. I didnt want to talk about my case on there, but Kim was very friendly, so had a long chat.

But again i havent heard answer from my email for days.

Excact same thing happened, when i sent them emails BEFORE and after i won the 250£ .

Will it be ok for me to post my emails i have sent to them? and also answers.

I have never had answer on my first and 2nd email. Where i allready in my first email tell them that i would like their REP to contact me etc... i cant see blackmail in that, in 2nd email i was asking about the issue with depositing....

Where is it You have to risk Your own funds when its a NO DEPOSIT bonus???
You need to deposit 20£ for fraud/identity issues, and can then withdraw 270£ straight away anyway? so where is it a player has to risk his own money???

Only thing there was requested was a deposit of 20£, which i can see now in the backlight, that i was in a big rush to recieve my winnings as quick as possible, but i did all i could to ask casino about the rules, if i could withdraw, if all docs was provided.

Also can someone explain how another player or other players can withdraw 250$ winnings WITHOUT a deposit???

I have no problem in risking my OWN money... i think the several casinos i have VIP status can proof this.

Also tried winning on a Rival casino on a no deposit, where i also was short on money that time, and asked the same way.....nothing wrong in that??
I also deposited several times on that casino after i recieved my winnings.

But what are other players here's view on this? It surely cant be fair this??

Ive checked my account at La Vida, and can see the 250£ comes up as "work in progress" now, so maybe there is still hope? allthought because i had the small free amount i am happy about that, so its not really 250£ but 227,80£ :rolleyes:

I managed to get hold of the 20 pounds, but only with a ukash voucher because a friend lend me, i played on party casino, managed to play a bit and withdraw the money to moneybookers, so i actually managed to have the 20 pounds ready for the deposit, i have also contacted the casino several times. Also i almost cancelled the withdrawal on the night, but thought worst thing can happen is they just put my withdrawal on hold, and then i would make the deposit.
So cant see anything wrong in that. Yes my mistake was asking for withdrawal beforehand, but still not see it confiscation my winnings.

I also asked MaxD to send my last email, had no reply. Which it states in the PAB, that i have a final saying. Which will be sent to casino.

I told you I would forward a final message from you to the casino if you provided one. This was the actual text:

I do not believe the PAB process says anywhere that you have "a final saying" except insofar as the "final message" mentioned above. Please point out where it says otherwise.

Insofar as the blackmail issue goes this was my text to you on that subject:

That is and remains true, AFAIC. In your first two emails to Support you mentioned Casinomeister by name four times and made at least five offers to post on the site for them, say good things, help get them customers, etc, if they could and would "make me happy".

This may not sound like blackmail to you but it very much does to me. And the casino people read it the same way. If you are innocent then I'm sorry but you were either very naive or very careless in your emails. If nothing else I strongly recommend you learn from this and NOT do it in the future.

Yes maybe the email would sound a bit like i am fishing etc... trying to promote them and talk about casinomeister...

But main reason was also that i STILL had NOT got answer from 1st email , also been on livechat...

So of course i still wanted to mentioned it.

I have NOT had any answer at all from this, despite also been on livechat, where i was promised from James i would get answer...


So in bottom of this.....before You all just judge me that ive been blackmailing the casino, which i dont feel is fair, i only "asked" if it was possible...

Did they say they will allow you to withdraw without even depositing? Wow, cool. I hope you really get it. Coz some other online casino sites will not allow it. After all, a $20 deposit will be worth the $250 you will be getting. :thumbsup:

Hi thanks for giving Your input. And Yes i can see in backlight that sending my emails despite it was ment good, that it was stupid. If i had not sent those emails, and just waited to i got paid from work on the 26th., then done a 20£ deposit and then withdrawn 270£.
YES that would had made me a fair player LOL , its really a joke. They have also changed the terms in why they confiscated and would not pay me.

No matter what, i still do not feel they are in their rights to "confiscate" the winnings like that, also look at i have never had any replies back from my emails.
Why did i not at least get a quick answer back that they did not like my email, or at least a straight answer NO we will not allow this, and will require the deposit first.
That would had been ok, main reason was i got frustrated for not getting any answers.....

Just a shame that the few people who was backing me up in here, suddenly turns their back, because of what Max has posted. That i was a blackmailer etc..... i really dont get what this has to do with it all anyway. I had WON the money so what? I made mistake mentioned casinomeister couple of times.... BUT NOT the 4-5 times constant as MaxD also pointed out.... shows again that Casino La Vida just wants to get around with some kind of term, so they dont have to pay out, a well deserved win on a NO DEPOSIT bonus.
I am gutted to say the least.

Wish someone could tell me what to do, Casino La Vida wont even answer that last email, only sent that standard answer.

Ridiculous. The casino should return the funds for the player to continue wagering. Now that the issue has been made clear I definitely side with the player here.

Now that this is same as subject. Can anyone tell me where it states in Casino La Vida's terms that all winnings will be confiscated if a deposit is not made before a withdrawal attempt in case of a No Deposit bonus as a new player? I am not only asking in regards to myself. But also if we take other casinos.
I cant see any legal rights to confiscate and take winnings from a player no matter what. I would say that its a bit the same as when we are talking about withdrawal before bonus wager has been met?
What i mean is that a player should always have a chance to fulfill requirements etc.. It would be allright to withheld winnings, but confiscate no way.

But i feel i deserve a chance to defend myself for all the things that MaxD has posted about me. First of all i am NOT a blackmailer and second of all i did never ask members at THIS forum to post on my behalf. I was in talk with another member in private that was all. But the way MaxD closed the thread by saying that i was now trying to contact other members is direct lie. So i wish to get my name cleared by this. @PaaskeDKnowUK: posting your crap in other threads is called "thread hijacking", is a violation of the Forum Rules, and you've been given a short ban for it. Do it again and you will get you booted off the forums for good.

By the way, that's the second time you've called me a liar in the forums. I have said nothing that I don't have direct proof to back up. Imagine how well disposed I am toward you and your issues just now. :axeman:

I never got a chance to reply to the other Casino La Vida thread before it was closed, so Max has Kindly allowed me to post my thoughts on this subject.

First off, I would like to say that I 100% agree that Paaske handled the whole situation rather poorly (intentionally or not). And the matter of him using Casinomeister to pressure the casino into paying him on his terms was also in bad taste and IMO looked silly on his part.

That being said....I am rather shocked at the casinos actions, and equally shocked that more members here do not see how this is not borderline ROGUE behavior here from an ACCREDITED casino.

Just going by what I have read in the thread, it appears to me that the casino based their decision on not paying Paaske on whatever was said in the email exchanges. At least one person (Mallorca) stated that they were paid $250 on this no deposit offer....and were not required to make the $20 deposit. How is this fair?? It also seems that Paaske was in contact with support on more than one occasion, and was told that his withdrawal would be processed shortly.

The reason he was not paid was because he failed to deposit BEFORE he requested his withdrawal?? How can this not be construed as a FU clause? Even the shadiest casino would more than likely return his balance to his account, and send an email stating: Sorry, but per our terms you are required to make a minimum deposit before cashing out. Please make a deposit and request your withdrawal again. Am I not right here? I have been gambling online for seven years and its entirely possible I would have even missed this. All Rivals require you to make a minimum deposit before cashing in. I did this myself on more than one occasion. Neither time did I deposit before making the withdrawal. Someone please tell me what difference it makes? A player gets excited about beating the WR, and happily makes a withdrawal....entirely plausible to miss the point of making a minimum deposit.

What we have here is that apparently you have to follow steps 1,2,3 to cash in here....if you miss a step, or do one out of order...they have the right to confiscate your winnings????? This is not bonus abuse or fraud....its a TECHNICALITY, in my opinion. Also, if you read the term (and I am reading as what was pasted in the thread).....

This was highlighted in Paaske's email. Where does it say....Players need to make a minimum deposit of $20 before cashing out or all winnings will be voided????

Look at it this way, what if a casino has a term worded this way: Before a cashout can be made, we require that a faxback form be on file. So what happens if I make a withdrawal....then go and get my docs/faxback form in order? Will my winnings be void because I didn't go from step A to step B
in that order? Of course not.

What if I sat down at a blackjack table and started winning, and got a little drunk and started getting boisterous? Casino might ask me to leave...but certaintly would not take my chips from me!!!

Do you see what I am getting at? Paaske didn't handle himself properly, and this has cost him his winnings because of an unfair term that apparently wasn't applied to all players. This is unfair and unethical in my opinion. The casino did not like him, and found a reason not to pay him.

Accredited casinos must:

*have a clean history of fairness towards their customers
*not implement terms that can be construed as unfair towards the player

I am sorry but this is wrong on so many levels, regardless of Paaske's behavior. That should not be cause to confiscate his winnings
