Can i still start small claims procedure if they refuse to accept my legal letter?

Don't trust hermes tracking its terrible. Why was it back at your local depot 7 days after you sent it?
Also, they might not accept letters by courier.
Where did you send it? Did you ask them for the address to serve legal documents?

Just send it by email, ask live chat which email address to send it to, screenshot & print it. Print off a hard copy of the email, and any response(s) - auto or not.
The same day post a copy, first class, with proof of posting to their legal team or head office.

That will suffice for a claim.

I sent it too 2 Wellington Place address. I told them i am taking legal action but they just ignore me after sending this response.

As a final response has been provided to you we will no longer engage in further discussions with you.

They have my balance. Clear case now not accepting letter and i can't send by email as they are not discussing anything. Can i file the small claims procedure now what happens to the letters from them do sky do this on purpose.

You can send by email and post. They don't have to discuss it with you, they just need to get it. Proof an email was sent with a back up of proof of posting at the post office will suffice, as I stated.

I believe they are moving from WP next year, so there might not be a full compliment of staff there now,

Just send an LBA by first class post. Service is deemed effected one working day after postage if sent by first class mail. Courts don't use recorded delivery - far too easy to reject "uncomfortable" letters by that method.

I feel duly qualified to comment on Hermes as I'm indeed still waiting for a delivery myself.

Whilst not high up in the realms of legal importance like the OP's parcel, my heart sunk upon the realization that Hermes are the carriers of my item, which I believed I was due to receive yesterday!

Imagine having to rearrange my entire Lockdown day for this. But apparently it's due today, hopefully before Midnight



Given this company's 'service' I'd rather have Herpes next time to be fair
