I have just seen this on Gaming Intelligence, not good to end up being arrested for playing on a non German licenced Casino site

Germany’s controversial State Treaty on Gambling has suffered yet another blow after a court ruled that authorities may not prosecute players for gambling on unlicensed sites.
Last week's decision overturns the original ruling by the Munich Regional Criminal Court, which had said that Section 285 of the German Criminal Code (Strafgesetzbuch) could be interpreted to mean that no individual may be involved in illegal public gambling.

This was seen to set a precedent under which online casino and poker players could be prosecuted, as the State Treaty prohibits these activities.

I think that something was lost in the translation of that article. Section 285 states simply: "Whosoever participates in a public game of chance (section 284) shall be liable to imprisonment not exceeding six months or a fine not exceeding one hundred and eighty daily units." It's been like that for a long time.

What needs to be defined is what is considered "public" gambling. And what is considered unlawful. If Germany and Malta maintain free trade, then I would extrapolate that a Maltese license would be considered legally binding. Again, this is more fodder for the lawyers and bureaucrats.
