Thank you for posting this, catrina. Seems the feds are after the payment processor (Web Merchant, LLC).

Being the resident paranoic, I can't help but wonder...

How did the DoJ get records of your transaction(s) (bounced check)? And would cooperation with the Feds be an admission of 'guilt'? While most of us here don't think gambling online is illegal, the DoJ and the FBI do.

The only way I can figure it, I closed my bank account shortly after the check bounced. I covered the fee's, but I closed the account because they started refusing my deposits to casino's. I contacted them and asked why my deposits were being denied and they said they implemented new software to deny gambling sites. Thats telling me how I can spend my money. So I closed the account.

I think my uptight, babtist, bible thumpin bank turned in my banking records to them because of all the internet transactions for a few years.

I have no worries, and I am not about to stop my right to gamble. I just buy prepaid visa's.

I did email the folks that bounced the check and sent them copies of the letter and told them I wanted paid after 6 months or I might fill out the questionaire.

They said my check was mailed july 7th, lol

We will see. I still have no intention of giving anyone, information of my personal interests.

They are probably making a case that the payment processor is violating the UIGEA.

You can either:

1) Respond, and hope that's the end of it. Be 100% honest and accurate if and when responding. If you bend the truth, you could get into trouble.

2) throw it in the garbage and wait for an explicit ultimatum - which may never happen. Agents get busy, work piles up, and may not follow up... unless you throw it back at em in which case they're going to have to pay attention.

I'd probably do #2 and wait and see what happens. Most stuff like this goes away on its own.

Plus, I wouldn't want to admit in writing that you have been violating the law unless there is no choice... if you give it up too fast, you could be essentially subjecting yourself to a conspiracy charge.

I would consult a lawyer before responding and not respond unless you get a follow up.

I think this sort of thing is going to get more commonplace... look out folks!

I do not and never will support any govt. intervention in any activity that I deem as none of thier buisness.

Again, if this shit starts up here at any point...they can all kiss my ass. This whole thing needs a good front page story, and lots of coverage. I still think there are way too many people out there who aren't even aware of what's going on. Surely, even some non-gamblers would be offended and appalled by how far this whole issue has been pushed by the DoJ? They are like rabid dogs over it. It is scary.

THEY ARE REALLY TRICKY!

First of all, they must know already that you tried to cash the check. Also, the bank probably did report it as they are required to.

Secondly, I wouldn't do anything! Just wait and see if they send another request.

If they file legal proceedings attempting to compel you to provide the information, consult an attorney.

Lastly, do you live in Utah? If not, if they take legal action against you they would probably have the offices located in your state handle it.

I wouldn't take this matter lightly, alot of the info they seek could be used against you, leading to an IRS investigation, etc.

If they contact you by phone, take the 5th (I don't recognize this company, I don't recall ......etc.

First thing, talk to a lawyer that is knowledgeable about this UIGEA issue, even if it costs you a few dollars... and I would do it fast.

I would also contact your elected Representatives and let them know how happy you are that the DoJ got your personal information from your Bank without your permission, thanks to the misnamed "Patriot Act", that requires Banks to report All "suspicious" activity to the Dept. of Homeland Security.

The Patriot Act laws are so Draconian that I once got reported by a Bank to Home Land Security for coloring up (changing up) some money. I had $3000 cash in $5's, $10's, $20's and $50's and I wanted to change it all up to $100's, I went into a local bank to do so and got reported to Home Land Security by the Bank... The Bank employees were even apologetic and embarrassed for having to report me for changing up money... But I still got reported.

If the recipient doesn't reply with answers to their questions, s/he is refusing to 'cooperate' with the DoJ investigation. If s/he does answer, she's incriminating herself. What a crock of shite.

Unless it came Certified or registered mail, toss it. They appear to be fishing, and they are hoping you are angry enough about the bounced check, that you will help them out. The cost of helping their "investigation", might not be apparent just yet, but I would bet their will be a cost in the future.

A letter in the mail, is just that, a letter in the mail. A summons to appear, or a DOJ investigator knocking on your door, that would be a different story. Both could happen. At this point, I personally don't think you have anything to worry about, especially if you don't plan on cooperating.

I'm in the same boat as you. Huge wins, but huger (is that a word? it is now) losses. In theory, you have to claim all your winnings as income, and then itemize your losses separately (but not more than the amount you won). If you always took the standard deduction, which for me has always been the better option, you won't be able to do that if you itemize your losses.
