Pleased to say that a withdrawal which was actioned SIX months ago from Boyle Sports was finally received today. They somehow lost the money, yet couldn't find it until they ran a payment trace last week.

They refused on no less than four occasions to open a official complaint (by e-mail and postal mail) - it was only the threat of a small claims court last week which prompted them to pay.

An official complaint will be made to the UK Gambling Commission in due course as they refused to deal with customer complaint and provide a reason why the process took too long.

Their final e-mail today:

--

As discussed with you last night, I have processed a same day bank transfer for you for the £<REMOVED>. You should have those funds later today.

I have also looked into why the funds could not be found and the reason it seems to be is because the funds should on our side and on our back office as successful and when that was checked we could not do a trace on it as it was not 10 working days. I understand that you did contact us several times after that and more should have been done and I apologise for this as it could have been resolved much earlier for you.

Unfortunately there is nothing that we can do for you in monetary terms for the charges you incurred on your bank.

If there is anything else we can help you with, please do not hesitate to contact us. We will be happy to help you.

This is unacceptable and also one of the worst apologies I have ever seen. Six months to resolve a payment issue from such a big sportsbook is not on IMO.

Yes there is. Small Claims Court. Another weasel disclaimer.

Glad you was paid, 6 months? Way to long, 6 days all that is needed at max to see where any funds have gone,

Its not like it was an uncrossed post order and valid for 6 months & waiting to see if it was getting cashed, I would not of been to happy, Even if a complaint to the UKGC I doubt it would go far, They would use an excuse to say they was not licensed with us at that point or some rubbish

"making you whole" is bread and butter when it comes to the small claims court, and this would include covering the associated costs directly and even indirectly incurred due to the error, and in pursuing remedy. There was suddenly "something they could do" after 6 months of "nothing we can do" over the original amount.

Refusal to deal with a formal complaint would be a breach of the UK licencing rules, so it's well worth mentioning this to the UKGC as a licencing breach (which they DO deal with) as opposed to an individual player complaint, which they will refer to the ADR specified in the terms for the casino/sportsbook.

Losing a customers money "in the system" is a pretty serious matter in itself, irrespective of whether the complaint about it was dealt with appropriately. There should always be a proper audit trail for all transactions between provider and player, one that can trace where money has ended up when it appears to have vanished.

I am sure "The Sun" Would love a small column about your story with Boylesports. I would contact them and mention about your bank charges etc. And you had to take them to small court also took 6 months is a disgrace. And yes I would chase for compensation and sure a nice column in The Sun would help on that. As that newspaper seems to like posting small stories sometimes :)

what a joke

6 months is a long time in bankroll years. Id be going nuts at them after 2 weeks .longest wait i had ever was about a month and it was only 50 dollars everyday that poor chat person got asked the same questions i care little about 50 dollars when it come to gaming but it was a matter of principal.i find if a place is being slack and loseing things or not giving a proper reply its best to hit them via social media. They know one bad comment can cost them alot of new players :)

Totally unacceptable, and I agree with another poster here who said that their apology was pathetic (and inaccurate - there is something you can do.)

I would definitely take this further and make the buggers compensate you

BoyleSports money missing

Hi everyone, just came across this thread and I am in The same situation. I won £122.40 from BoyleSports and I made the withdrawal on the 5th of July and it was successfully processed on the 7th July. The 5 working days past and the funds never reached my account, I was advised to phone my bank but they have told me they where never sent any funds. BoyleSports keep fobbing me off and I'm now stuck what to do and with no winnings

Can anyone please help me out

Cut the crap and go straight to a small claims court threat. This should have been a one off, and shouldn't be something that would ever happen again to another player. It suggests there is more going on than Boyle Sports are prepared to admit to, and they were trying to pass the blame onto the banks as a stalling tactic. Funny how they suddenly "found the money" the second Nicola took it to the next level and started the process of issuing formal court proceedings, followed by a string of apologetic excuses that more or less was an admission that it was their error, and that they didn't do what they should have done to resolve it. If true, they should have learned from their shortcomings, and how close they came to being taken to court, and so they should have done things properly the next time such an issue occurred. They seem to have assumed that you think you are the only person this has ever happened to, and they will probably say this if you ask them, but now that you are here you know that this has happened before, and that they accepted they should have acted differently and resolved the issue from their end.

Even if it genuinely does take 10 days before they can act (as claimed before), a threat of court action at this stage still gives them plenty of time to resolve the matter beforehand. What you don't want is to be strung along for 6 months with them giving out a rash of excuses and broken promises, only to find that all along they would only ever respond to a threat that meant something.

They could simply be incompetent, or they could be struggling with limited funds and need to stall as many payments as they can get away with in the expectation that things will improve over time. It could also be down to their payment processor seeing them as a "bad risk", and thus they won't process player withdrawals "on credit", but insist on them having a minimum level of money held by the processor before they will process payments to players, or indeed forward deposits from players.

There should also have been a rep all over this story reassuring players that this was an incredibly rare problem and that it had been traced, fixed, and would not reoccur. Instead, not a peep on this thread, just an inadequate apology to the player concerned, and no real explanation as to why.

My reply email

Hi,

I'm sorry but I am not prepared to wait even longer for my winnings. I have gave BoyleSports the chance by waiting the required 3-5 days, I have even sent in 2 sets of bank statements to show that my winnings had not been paid in. I have also contacted my bank upon BoyleSports request to make sure it wasn't a problem at their end. I've phoned, I've love chatted and I have got no further forward. I've also googled this and noticed it's not the first time it's happened to a customer of yours.

So as of tomorrow I am placing a sanction against BoyleSports to the small claims court in Glasgow. I hoped we could avoid this but it's clear to me that BoyleSports have no idea how to treat their customers properly.

Regards

Paul

I plan to take this to the small claims court tomorrow morning and file the relevant paperwork

not sure if its different in scotland but civil procedure rules would require you to send a letter before action before starting court action so I wouldn't do that just yet, as you will likely lose the fee you pay :(

What would this letter need to state?, never done this before so need all the help I can get

Details of the claim mainly and what you expect them to do, and a date, usually 14 days, you expect it doing by (in this case paying you). You need to check it is required in Scotland as I'm not sure as the rules are different.

I believe Boylesports are based in Ireland, I would also check you can start an action in the UK.

Honestly though, they aren't going to rip you off, for the amount involved I would hassle them till they pay, and send the letter if needed.

I would do a google search for a small claims template, fill in your details and the problem and just email them it and say actions been took already, At this time they do not know you have not actually sent it off and hopefully they will get there arss in gear

This should hopefully get them to take this matter seriously as they will realise that the other case you Googled was only resolved by that player initiating court action after waiting through 6 months of BS.

However, a formal "Letter before Action" is not the same as sending this email. This is the letter that formally states you are taking court action, and why. It should also offer one last opportunity for them to settle, hence the 7 days.

It's 7 days from them receiving this letter when you should be off down the court house with the paperwork, rather than tomorrow.

Nicola may be the best person to help, as she has already gone through this process with Boyle sports, and they quickly paid up before it got anywhere near a court. Whatever formal notice she sent them clearly worked, and they found her money as a result.

This 7 day timescale between letter of action and registering the claim, added to the time already past, should give them more than the 10 days they claimed they needed to start a trace on the money.

You should also gather evidence proving that you gave them the correct details for them to use in making this payment, because if they can show that the problem is down to you giving them incorrect payment details, the fault would be yours. If you have previously received money from them with these same details, this should be enough to show that the details you gave them are not the cause of the problem.

I have deposited using my bank card and the bank card the withdrawal should have been made to was the same one, so the problem is definetly with BoyleSports... Do you happen to know how I can get in contact with Nicola?
