Bet365 faces legal action over delay in paying winning punter £54,000

"Bet365, one of the internet’s biggest bookmakers, is facing legal action from a customer over its failure to transfer a £54,000 balance to her bank account despite repeated requests over a period of months. While refusing to release the backer’s winnings on a series of horse racing bets, Bet365 also told her that she would be restricted to a maximum stake of £1 if she wished to..."

FTR we have a very similar case on the PAB books at the moment, the unpaid balance there is £29,000+. To date -- 8 weeks and counting -- the casino people have not responded to this player's PAB.

...and these are the annoying bastards who pester us EVERY SINGLE commercial break during the Euro's Footy matches!

Not to mention every interval and pre-kick off screen during FA Cup, Champions League and Premier League matches on BT Sport. As if putting up with Michael Owen and the rest of BT Sport's commentary isn't torture enough, we get the pleasure of staring at Ray Winstone several times telling us to 'bet in play, naahhhh!'

I bet this will be settled out of court, nothing like this approach to lubricate the constipated process that has currently taken many weeks to transfer the money, a process that should be almost instant. I can't see that Bet365 have a leg to stand on because they have not questioned the legitimacy of the winnings, nor the legitimacy of the customer of source of the initial deposit, both by what they said and their action in raising the maximum bet limit when the customer had lost the first £24,000.

This looks like a case of stalling in the hope that it's played back rather than paid out, and they want this done on the other gaming products, whereas the customer has rightly reacted to the £1 restriction by deciding to take their custom elsewhere.

The article also mentions the photo of you holding up the document and the need for notarization, and branded this as a "scam" designed to put as many obstacles as possible in the way of the punter wanting to receive their winnings.

The industry may well have to repent at leisure, because this BS just escaped into the mainstream media, and this only happened because the customer was jerked around for so long that they went to court.

I have also heard that PayPal got taken to court by an irate customer who fell victim to their practice, shared by other web wallets, of blocking accounts and refusing to give back the customers' own money. The customer not only won, but the judge was critical of Paypal for behaving like this in the first place. This does not bode well for Bet365 in this case.

If that's also a Bet365 case it may be an idea to let the Guardian know that their complaint is not an isolated one against this operator?

Im shocked and appalled at this surprising behavior from such a highly regarded firm like Bet365. From what I read on the guardian article, it does just sound like they are hoping they player will eventually just lose their winnings and dont have to pay out.

Hi people I am the person who submitted a PAB here against bet365 after they refused to pay my betting balance of £29,000 as Max mentioned above. In small detail I won this money over a monthly period with bet365 and i was betting high stakes accross many sport markets, withdrawing my wins, they was paying, doing more deposits and losing, until i had this larger win which came from a long 14fold football acca.

Sadly Max was unable to get anywere dealing with Bet365 as they dont seem to care about online reviews and reputation. So i had no choice but to take legal action. I just want to update use on my situation now. I have a pending court claim and we are due to have this settled in court in 2-3 months finally! Its cost me thousands to pursue this  but my solicitor is confident we will Win in court. Bet365s legal team has presented its defence claiming me to be involved in a syndicate, a syndicate which has apparently deposited 900k and withdrawn over 1Mill. Yes you have read that correct. Im as shocked as you.

Its gonna be very interesting to see what facts they have to support such a crazy accusation as that. I can only guess they have crossed matched my ip address when on public wifi against other players and then it all becomes one big link. For example if i logged onto bet365 when i was at Uni on Monday and someone else does the same on the tuesday it could links us and even at Mac donalds public wifi spot or a airport's wifi or the many other public wifis i have used in the past it will create a long chain of links when other people also use Bet365 and Bet365 is widely used in the UK. During the dispute stage when Bet365 was comminicating to me, times when they stated in writing (after a 2 week investigation on my locked account) that they would send the balance to my bank once i send in my Bank Statement but then decided not too when i sent in my bank statement, I did put it to them that there will be no link to any other account through my Home addresss's IP address and that should be the most important thing but that wasnt good enough.

I hate seeing their commerical everytime im watching football  I wonder if like the first post on this thread has anyone else suffered from non payments from Bet365 lately?

Good on you. Think there has been an increase of punters taking these piss takers to court. They need to be dealt with properly by the judges and forced to pay out in full plus costs and compensation.

I've got a court case in progress just small claims, they have 10 lefts left to respond or else they will be automatically found guilty and will be forced to pay up and effects the credit rating.

Hi what actually isit they are not responding too, isit the start of the claim stage where they must submit acknowledgement or sometime into a claim and they just stopped responding?

When they are sent the court papers from the small claims court, they have a certain amount of working days to return a statement and have several options such as contest it in which case they need to consult a solicitor or internal legal team, agree to pay full amount with charges or make a reasonable offer. If they ignore and go past the expiry date then the courts will automatically deem them as liable for full amount and will instruct enforcement action to collect money and will leave a mark on the individuals or business credit rating.

Just a quick FYI to try to help, in case you aren't aware, if you were correct in your thread of the day you put the claim into court, your timeline is wrong, its 14 days from date of service not date of claim.
The court don't automatically do anything you have said above, you have to apply for default judgement and you have to apply for enforcement (and pay the fee, most likely £77 in your case), just so, if they don't reply you aren't sitting round waiting for them to send the baliffs in! Also, if its paid within 28 days there will be nothing recorded on credit files.

I'm glad you typed all that, was just about to correct that poster myself!

There was a case in Australia against bet365 refusing to pay over $100k to a customer and offering him just $25k instead and changing T&C after his win I found the link:

I cannot believe how shortsighted such a big company can be. Why not offer the winners even 10% increase if they stood before camera and told everyone about their win? Which will benefit the bet365 more, bad publicity or winners on TV?

But what happened to the OP's GBP 54,000 case (this thread dates back to June 2016)? I did a quick Google but nothing came up.

I would really like to know what happened to this Aussie case, too - the vid dates back to 2012, so it should have been heard/settled by now.

I have just received documents from Bet365 and have some information i thought might interest people here.

They stand by their reason for my account closure which says I have links to a third party. They have requested a full bank history from the time I played with them.

WTF does that have to do with me winning sports bets with them? I guess they think i was sharing bets with someone, I was not, but what difference does it make? I know people who are actively in betting syndicates right now and use whatsapp groups to do so, does that mean they are cheating? YOU CAN NOT CHEAT THE SPORT BETTING MARKETS, UNLESS ITS MATCH FIXING, ITS IMPOSSIBLE.

These guys have actually sent me a full Log of my betting history and let me tell you there is many many pages. How on Gods Earth can any sort of 'Party' gain an advantage over the sport markets?? Am i being stupid or does that sound ridiculous?

Guys this is what they are basing their whole argument on, a third party, like i was betting with other people. They have a big team who's sole job is to look into and investigate any big winners and find any flaws they can use to avoid paying. They did a huge investigation into all this and have even stalked my facebook page, they have sent me photos of facebook updates I did when I was travelling in the USA and all sorts. I think at the time too they had people watching my house :eek2: They REALLY REALLY dont like anyone winning from them  Im guessing they have linked my account to a friend somehow who also uses Bet365.com but however they have linked it wether its from an IP address or a link through the Bank, why should it determine the outcome in Court for what we are actually fighting for, (my £29500 Win) A link can have no advantage to me or anyone when im doing my Own bets and therefore my win should be honoured right?

How are these people allowed a license  A license which earns them billions. Im so angry. They creep on my Facebook page and all sorts its very weird over at Bet365.

I would love to take this more public but the Dailymail and The Mirror have ignored my request, I think its because Bet365 own a premier league stadium so they dont want to give bad press towards that and get involved.

I sit here now and wonder would a Judge honestly refuse my Winnings and side with Bet365 because of a supposed Third Party :what:

My legal guy is handling this, I will post any new updates.

I assume you're based in the UK? I preface what I'm about to say, by saying that I'm not that up on UK gambling council legislation, but being an operator on the casino side with a Curaçao licence and having hung out with lots of people who know a lot about UK licensing, (because I want to get a UK licence eventually ) one of the themes UKGC really cares about is 'fair play' with customers.

If it was me, court action would be okay, but it doesn't really hit them where it hurts, which is damage to their reputation with UKGC and thus potentially jeopardising their licence. So I would make a formal complaint to UKGC and if the case has merit, from what I understand this will then be passed through to an independent arbitration service that understands gambling issues and assuming you are in fact innocent, you are likely to see a positive outcome.

I just think you should look carefully at these options,

Recapping
As I said a legal action just means they do or don't give you money with no particular precedent set. Since bet365 have lots of money, there's no real pain for them. However bad standing with the UKGC with could theoretically kill their business... A very different level of pain.

Saying all of this, I've no idea what the real facts are, but this scenario is why the UKGC exists (apart from tax collection)

So I would make a formal complaint to UKGC...

You absolutely have to do this first, otherwise they may not back you at all if you need them further down the line as they have rules about arbitration in cases like this. If you visit their website there are a number of ADR organisations that will take the case for you if it has merits:

Only after you have done this should you consider court action....

It became a mess. Not sure if Bet365 were still in the wrong or not as it seemed there decision was before an inquiry.

The punter was accused of having inside knowledge before the race.

Yeah i read about his inside info as well, however as I see it bet365 refused to pay him before his connection with the race organizers become known...
