Thank you lanidar- that article almost answers my question- the links in that thread were quite informative- however, it still appears that the law is 'fuzzy' at best on this issue- it appears that in NY at least- promotion of gambling casinos and enticing of people to gamble there is almost clearly illegal even if the casino is offshore or in another country- however, it still appears that the WTO is arguing against the U.S laws-

Still haven't found any clear answer as to wether it is illegal for us poor citizens to gamble online or not in N.Y though- I spose you could be brought to trial as a 'test case' but from what I've been reading- it doesn't look like that is likely- I just wish they'd repeal this prohibition altoether & the government would just regulate it for all states- the ones wanting to gamble ARE gambling already- the few who would take it up if it was legal wouldn't amount to a hill of beaNS amyways- yeah- problem gamblers would crop up, but not that many I don;'t think- oh well-

IMO ...the laws in NY are "FUZZY" at best. Though I wouldn't care to test them personally.

It's pretty doubtful that you would be prosecuted, especially since the law IS unclear. From what I understand, generally the operators are the ones who are pursued, and NOT the players. And if they DO decide to pursue players, my guess is that they'd pursue major bettors.

Besides.. isn't Mohegan Sun within driving range of you..?!?
 
I live in NY. I have played online for a few years. Did I look into the legalities of it before I played? No!

Depends on where you live in NY. Mohegan Sun is 270 miles from me, and I'm in NY. The Mohegan Sun and Foxwoods are in Connecticut. Four hour drive. I think the closest part of NY to the Mo-Sun would be New York City, but it's still at least an hour and then some.
 
there's a couple of casino's not too far but there's nothing like the conveinience of online poker rooms- get me nightly fix lol

How do you declare the winnings from online winnings? What would that fall under? Self employement? Or what?

As I mentioned ... I too live in New York (recently moved over the bridge to New Jersey) and I personally don't know anyone who has claimed any winnings on there tax forms.
I have read in a thread some where that some players do claim profits and deduct online losses.
If I knew where that thread was, I'd post it for you. Sorry.
BUT, I have posted that I do NOT claim any winnings or losses at all.
I know this post could open up a "can of worms" but, these are my personal thoughts.
 
My reason for asking is that I am in kinda a sticky position as I am on dissability. I have to declare anything I earn wether it's $1.00 or $100,00 or whatever. I am able to earnm money- however, I have to show where it comes from- it would look kinda funny if I were to all of sudden start getting an income & not show where it came from. If I claimed income from gambling- I spose I'd have to show receipts & everything? I dunno how any ofd this works- never dealt with anything like this before

Well, like tim5ny- I'm not too far from Foxwood- 4-5 hours- they were talkin bout putting one up north about 2 hours away too- dunno if they have yet or not
 
If I remember correctly, the Pirate of Caribbean 21 was from New York. I don't know how he dealt with his taxes, but I have not heard of him being arrested for gambling online.

Unless you are professional gambler, on the federal tax return your total winnings go on the "other income" line, and you can deduct your losses to the extent of your winnings as itemized deduction.

I have no idea how it works with disability, but there must be other disabled people who gamble.
 
I would think so, with the number of online gamblers which is staggering- you'd think that somehow there was a way to do it- however, like I said, I'm new to this & have no idea. That 'other income'- wouldn't the IRS need recepts or something incase they wanted to do an audit? I haven't worked in 14 years due to dissability (And haven't had to file a return or anything for these 14 years because my income from dissability was so low) & it would look kinda funny if all of a sudden I filed a form stating I earned $100,000.00 (Lol wishful thinking heehee)

I claim my winnings for the tax man in Germany, especially since it is not taxable income. The casinos provide me with an email or document that simply states that I won and cashed out x amount on such and such date. I turn this in with my taxes.

I recently asked Bryan about the legality of playing online poker in NY and NV and he sent me this link and I thank him!

As far as reporting your winnings whether it is $1 or $100,000 I don't think the IRS will care how you got it...just the fact that you are reporting it and paying them would be just fine with them. I don't think it would be totally necessary to report $10 or even $1,000. However, if you win soomething that substantailly adds to your income, something like 15% and up I would say to report it. I am not a lawyer or anything but I am smart enough to know that Uncle Sam is not stupid! If you start paying for some things that could raise some eyebrows, you should account for where it came from or at least report it as income.

But what prompted my post is that if I were to win an online poker tourney for say $15,000 (which I haven't, unfortunately)...would a poker site be able to say to me, "We don't have to pay you because you live in NY and it's illegal to gamble online." Which is interesting, because of course they will take your money...but then they don't have to pay you? haha

I will say this Bryan made a great point, the fact that they advertise online poker rooms on tv in NY would make it seem as though it should be ok to play.

Just my 2 cents. Any thoughts?
