Massive win confiscated. Who is at right, me or the casino?

For what it's (still) worth: Malta is theoretically not a country where a Curaçao operator cannot operate-in. The list of countries that the authorities in Curaçao strictly prohibit, is the following, at the time of writing:

Aruba, Australia, Bonaire, Curacao, France, Iran, Iraq, Netherlands, Saba, Spain, St Maarten, Statia, U.S.A or the U.S.A dependencies, United Kingdom.

Every operator has the right to restrict more countries than just this list of course.

Hi Casinomeister members and operators reps! :)

I need your expertise and knowledge in this matter since I cant to 100% fully understand the laws and regulations.

So, I live in Malta and played at an online casino who turned out to have Curacao licence.

I registered an account and won a very large sum of money the same day and hit withdrawal, the casino requested KYC directly and I sent it and it was approved within an hour. They needed the normal docs and even replied back my winnings will be paid out once KYC was done.

The next day I get an email saying that my account is closed with some copy and paste from their T&C: “We do not promote or operate in your jurisdiction, nor are we authorised to do so.” “ The terms, conditions and disputes are subject to and construed in accordance with the laws of the Netherlands Antilles”. “It is the player’s sole responsibility to inquire about the existing gambling laws and regulations of the given jurisdiction before placing bets on the website.”

My deposit was sent back to my bank account.

I never heard that it was illegal to engage with an online casino with Curacao licence from Malta?

My questions is quite straight forward, if there is any laws in Curacao that you can’t accept players from Malta? Since they refer to those T&C.

The casino don’t seem very keen to pay out and referer to that I broke their T&C by playing from Malta.

Malta was not listed as restricted country in their T&C.

I noticed a lot of streamers live in Malta and they all stream on Curacao casinos?

What do you guys think? I am kind of lost how to take this further? If they have the law on their side its pointless but if they have not, which is the best way to move forward in my case?

Please, anyone can anyone share light to my situation? :)

Many thanks!
Stull waiting for you to submit your PAB. What's the deal? Why the delay?

We never did receive a PAB on this one, and it appears the OP just wandered off within a couple days of the original post. Dontcha hate it when people do that? 😒

Yeah - I almost hate that as much as reading the first 10-15 posts thinking it's a brand new issue, before suddenly realising that the thread is over 20 months old!

My bad
KK

Been there! Worst bit is when you wind yourself up over something in the thread and then realize you've had, like, 20 haircuts since anyone last posted in it.

Hey, I hate to remind us, but when did we last have a haircut @maxd ? :D

About 5 days ago, thank you very much! It's more of weed-cutting exercise but we'll call it a haircut to salvage some dignity. ;)

LOL.. I knew it was all over 10 years ago when I said to the missus one morning "I'm off into town to get a haircut" and she replied acidly "Which one?"

It sounds like you're in a tricky situation with the online casino. Since there are many streamers in Malta who play at Curacao-licensed casinos, it suggests that there might be some ambiguity in the regulations. However, it's crucial to understand that the gambling laws can be complex and vary from one jurisdiction to another.

Ah, the classic casino conundrum! You're navigating a maze more intricate than trying to explain the plot of "Inception" to a cat. Remember, when dealing with Curacao-licensed casinos while in Malta, it's like playing a game of "Where's Waldo?" but with legal documents. Stay sharp, or you might end up more confused than a chameleon in a bag of Skittles! 🌈🦎

It's essential to review the specific terms and conditions of the *snip moron spam* you played at, especially those related to player jurisdiction. If Malta was not listed as a restricted country in their terms, it does raise questions about their actions.
