Dear Darren,

My company’s claim is not groundless as you will find out. ITC have four days to complete payment before we commence court proceedings in the ‘Civil Courts' to recover the monies owed.

Just so I am extremely clear on the matter, I will not be involving the police for the monies owed to my company. As I am unable to see or identify any detagging of the players we have referred to your casino properties.

However, the police will be informed concerning the detagging of players that occurred to numerous affiliate accounts, particularly during the month of February 2017. You will find there is nothing vexatious about this as Warren and Stuart Ferster fully well know.

Changes to a contract are supposed to be agreed on by both sides, not unilaterally changed by one side for their own benefit.
 
Also Dave, their supposed defence of being located in Curacao is to put it politely hogwash. Particularly when Mr Justice Morgan ruled that any revenues generated by the following:

Ended up in the coffers of ITC in Manchester. Just out of interest, I wonder if ITC are paying VAT ( Sales Tax ) on those revenues?

Firstly, whether the agreement is licensed in Curacao or Timbuktu if it is used for UK residents/consumers it must meet the standards required by statute HERE! and secondly, that would include fairness of terms and mutual changes. The unilateral changes would be unlikely to concur with what's deemed 'fair' here especially if leading to significant pecuniary disadvantage to one party.

It's just the first parry by them for what's ahead.

I have a lot planned. They are going to be busy as well. Interestingly the UK Gambling Commission have also been looking at my site. I wonder if that is to do with their close relationship with AffPower? You know, the same AffPower that accept UK players but do not have a UKGC license.

There is also some evidence that their possible associates are trying to gain a legitimate UKGC License, I believe Nicola reported this to the UKGC as the application is ongoing, but concerns that it's related to A$$power.
 
Sue Harley is a Director at the UKGC used to work at Ladbrokes in Rayners Lane when I was based in Gibraltar. I have the former Ladbrokes eGaming MD John O Reilly as a connection on Linked In, plus other former Ladbrokes colleagues who are still in touch with Sue. I'll see if I can touch base with her concerning AffPower.

If you are an affiliate, please share this video and subsequent videos to be released in the coming weeks on all available channels. I believe the court action I will be commencing against ITC next week, will be the first such action taken against the owner of an affiliate program for introducing retroactive player quotas.

I hope to set a legal precedent in the coming weeks/months which will further strengthen the position of iGaming Affiliates.

It sucks you are going to have to spend time and possibly money to get this sorted. When all these guys need to do, is be honest and pay you. Do they really believe they are going to win in court? They are going to get double slaughtered. They will have to pay what is owed to you. And then they are going to pay for a lawyer ..which we all know isnt cheap and most likely theirs and your court costs.

This is also not solely about monetary punishment. This will ruin a large portion of their reputation. Once people see a court found them guilty, there is no going back. That will stick with them forever. Its too bad you are dealing with someones pride instead of common sense.

Will they be able to survive after all is said and done? Probably, because when it comes to money, there are always people who dont care about reputation. But either way, it will harm them. Especially after this case is sorted, more affiliates may come forward to claim what is theirs. Which is the best casino scenario for all of us and the worst case scenario for them.

Unfortunately County Courts do not set legal precedents but if you were to win the case, it can be used by others in further proceedings to bolster the case.

No, that's correct, but the cases can be used as references in other similar ones.
 
Ah diddums, looks like my videos have upset people in Israel. What a surprise. Looks like our Israeli friends went on a dislike frenzy earlier this month. Boo Hoo!

Indeed someone from Israel on the 18th September went through pretty much all my channel's videos and disliked them all. HAHA. I accept that as a badge of honour. :D
