Further investigating your case I have learned that not only you knew about the bonus terms, you also agreed to them. Attached is the chat transcript.
We had a failure in one of the game providers, we are not countable for content providers, thereof we have removed the games from the casino.
The agent was kind enough and offered you 3000 in bonus in which you agreed upon, you knew the terms and conditions of this free bonus.

bit of a long story but i never deposited once after i heard the netent pirate fiasco.

During a netent game of Jack Hammer 3rd of April I was winning after free spin game 3000 plus with 177 spins to go i was automatically logged off.
They said they discussed this with netent and they said it was a bug. lying through their teeth.
not to cut my losses they offered me a compensation package.

Since I was in the region of 3000 euros loss with the netent game they offered me 300 euros for 10 weeks equalling 3000 euros I have lost.
The only issue I had to play through 36000 what is left and the original 300 euros would be deducted the rest would be mine.

in between that time in the 5th week i actually won 11k with their requirements but they offered me 100 euros in its place.
and cancelled my winnings claiming teh max i could win is a 100

I am not naïve I would never accept that the standard bonus terms as the gesture of 300euros x 10 weeks =3000 becomes bogus compensation .

Also they should never accept players from the uk as they have no license though they have a copy of my passport

They are obviously not trustworthy and have demonstrated that .
so i asked the commission of curcao to look into all these disputes.

Sorry Keith, but just to have such "compensation" deal offered..... "compensation" :eek: :rolleyes: ..... would have me running for the hills as i would have known that it will be time spent in vain and they will come up with another excuse.

A legitimate casino would have told you that a game malfunction (you don't get 200FS on JH, no matter how many scatters you have) voids winnings.....everybody has that in their T&C's. They would have also given you a full report from the game provider, which in your case did not happen.

Sadly, Curacao will get you nowhere, everybody here knows that. :rolleyes:

Pointless. the civil justice system in their licensing country is probably 2 men in stained white tropic suits smoking fat cigars and sitting behind an outside foldaway table, having cold drinks fetched by a young rent boy while listening disinterestedly to your futile pleas...

This I why Bryan gives rating points for kosher and decent licensing authorities like Kahnawake and UK etc.

In my defense i was not aware of the rule breaking and having the psych of gambler i couldn't lose as least i thought.I fell for it. so i hope other players don't fall into the trap. also like to say thanks to Brian for helping me .

I have written several times. Not a peep. I told them that all deposits of any players playing these games need to be refunded, and that the casino owners should be held liable - or at least the licensing jurisdiction since they have enabled theft. They have not responded.

It just goes to show that no one really gives a flying rats ass.

To that end, is there any way you could inform the card companies/banks and processors that a fraudulent counterfeit product is being purchased, and provide them evidence for retrieval of transactions? Cut the blood supply off, the parasite starves.

took to my credit card supplier they turned it down.when i told them it was like talking a different language.you played the game but there were fradulent but you played the games.

But at the moment they are under pressure from a couple of Dutch MPs (Ronald Van Raak and Andre Bosman) who have realised just how inefficient and uncaring the Curacao regulator really is and have been taking it to task. I'll dig around to see if can locate addresses for these two politicians and perhaps link them to this thread as an example of how bad this regulator is.

After all, this reflects poorly on the homeland as well as the island.

Tell the bank you will take the matter up with the Financial Conduct Authority and the Ombudsman. You may have played the games, but this isn't the point, you are an unwitting victim of a criminal fraud, the games were "bent", pirated and altered copies of the real thing. The money ended up in the pockets of organised crime, rather than a legitimate business. It's the same as if you had bought what was advertised as a Sony TV, and actually received some crappy unbranded knock-off that didn't even work properly and failed after you had watched 300 programs, and the vendor blamed the TV broadcasters.

Thanks for the advice i think barclayscards have taken to the dispute to peak point were they give me a decision in writing, its a farce as they have already said its not in my favour. no harm on pushing your points though.

This is merely the first stage.

The problem you might be having is that Barclaycard, along with other providers, not treat gambling deposits as "cash advance", which is their way to wriggle out of joint responsibility under the consumer credit act. Instead, they would probably view this as a "chargeback", a separate VISA scheme for both credit and debit cards, but where there is no overriding legislation about the rights of the customer. Instead, it's more of a discretionary thing for the bank, they listen to the story, and have to weigh up the competing interests of the customer and the merchant. What they are probably not grasping is the fact that these games are not genuine, and this has recently come to light, but now we have had confirmation from the game provider that these are unauthorised "pirate" games, and as well as this, they seem to be "bent" in some way and are not necessarily offering a fair game to the player.

This is what you will need to make clear when taking the complaint further, this is NOT simply a case of someone who has had a bad run at the casino, and is now questioning the fairness of the games with no supporting evidence.

It's ironic that the one time Bryan is more or less TELLING players to do the unthinkable and issue chargebacks, the banks are having none of it - even though casinos have suffered damage from bogus chargebacks as part of player frauds.

latest update on claiming money back .
i contacted Bar***card and refused cashback on grounds of it not having an valid section 75 scenario or angle. i phone the ombudsman but they said i had to fill out forms which i will do.

I also realised i used my bank direct debit card also (visa) for transactions
My bank says it be a waste of time to claim because they can easily get the money back and also again the scenario is difficult to place in valid section. i got the impression if i said they stole my money i would get it. But the fact that i deposited many times it would prove difficult to set up a case.

so again if any advice would be appreciated.

That's because they treat the deposits as a cash advance, not credit for a purchase.

As for the debit card, this would be a VISA chargeback, and the bank are assuming they are a legitimate business who will dispute the chargeback when they say they can easily get the money back.

The issue is not that you deposited many times, it's that you were duped for quite a while into believing that legitimate games were being offered and that you had a fair chance. It's the fact that it was discovered to be fake games not authorised by the game supplier that makes this a case of you having been a victim of misrepresentation. You could try the consumer protection legislation to convince the bank, as this would normally cover this kind of thing, but since the business is offshore, and is also breaking UK law by taking your bets without having a UK license, you are pursuing them through the bank and the VISA chargeback system because you cannot pursue them in the normal manner.

It seems the bank do not understand the difference between losing on legitimate games, and having your money stolen through deception through the use of fake games, which have also been found to be untrustworthy.

I wish you luck, Do not let the bank flog you off, Its easy for them to say no can do, Tell them that you spoke to your local papers that they allowed you to keep spending at a crooked place, They can see where the moneys going and its got to be real dodgy and nothing was flagged up, Any think is worth a try in this day,
 
S**t like this winds me up! It is bad enough to lose when you are playing a fair game, but losing and then get to know you never had a chance in the first place...
