Hi Guys

Sorry if the post is lengthy or I’ve missed anything out.

Wish I had read this forum earlier.

Joined Winner365 casino in good faith, totally believed they had a UKGC licence as they were advertising UK Players, they seemed like a legit set up.

I deposited, was VIP, had an account manager who kept ringing my phone encouraging me to deposit when I had issues depositing.

They have since closed my account and won’t supply me with a list of transactions I made. The reason I asked for these is because the deposits I made don’t match my bank statement and I’ve been charged additional charges on top.

I don’t want to sound like ‘I’m trying to get my deposits back’ but I am now overdrawn. They have taken more out of my account than agreed.

One of the deposits I made was for £200 GBP yet £255.51 GBP has been taken out of my account and additional £11 charge has been taken.

They have had a total of £2100 out of me and I can’t get an answer from finance or live chat. Live chat are rude and just tell me to email.

I have emailed and they have asked for a copy of my bank statement but my bank said if I can prove they have taken more they can do something. They have me the last 4 deposits which don’t match. So I’ve passed this to the bank.

As soon as I mentioned I’d been charged more they wanted a copy of my bank statement but won’t send me a full list of transactions and won’t allow me to see this through my account.

They have told me there closing soon and I’m worried I’m stuck.

Can anyone help?
 
I have just been on live chat as a guest and in short asked if they accept UK players.

She said winner365 is closing at the end of the week and diverted me to Royal Spinz.

She said they have a lot of UK players

Don't think anyone can help, sorry.

They are a rogue group who have fleeced thousands of players like you. The soon the bad posts pile up on Google they close shop and open a new skin. They were also caught running fake games (note that Netent, Microgaming and a few more are now missing on their sites)

So you chose one of the worst places to play. However, please do just a simple Google search in future as you would have seen this in the case of Winner365.

Plus scrolling down on their site would have shown you that they do not have a UKGC license. They'll never have one because they are scammers.

Do you think I should I should report them to fraud watch?

I have contacted the UKGC.

Is there anyway I can get my funds back at all?

There is little else you can do other than report them. Nobody can get to them legally since they run under a Curacao license. Wouldn't surprise tough if that wouldn't be fake too. :rolleyes:

Consider it a lesson learned and promise yourself to do a little more research the next time you want to register a new account. Or you can peruse the accredited list here at CM as those casinos have been properly vetted and in case of any issues you can count on the support from the guys and gals at CM. :) ....However, make sure you only register at casinos with an UKGC licence.

If they took more than authorised, then you should do a chargeback through your bank, especially if they won't explain the extra charges.
If they refuse to give a statement of your account, which legally they have to, then chargeback every transaction as you obviously can't tell which is fraudulent.

Cheers Colin.... you know just as much about the UK regulations and laws. I just don't know the nitty-gritty about when you can make chargebacks in the UK.

Banks can sometimes make it hard but ultimately, if you authorise a £200 payment and they take £255 then its not what you authorised, therefore its now unauthorised. Obviously the retailer (casino) aren't going to refund the difference in this case, so next step is chargeback. Only think I would check is that the extra £55 and £11 charge isn't currency conversion fees (which do seem extremely high) charged by the bank. If the transaction was displayed in £'s though then thats another reason for a CB as you weren't expecting to be charged in a different currency.

Alas you've been scammed by one of the worst criminal casinos ever mooted. GameTech are fraudulent operators and you have no chance of arbitration or them paying you back. You will also notice they use the fraudster's charter licence no. 1668/JAZ which is basically shorthand for saying 'we'll steal your money wherever you live and there's sod-all you can do about it'.

Right chargebacks would be valid BUT the card/banking companies have NO clue as to the fact these payments are unlawful due to being unlicensed and won't spare the time to check this out and investigate it. As soon as you admit making the transactions then to them it's simpler just to validate them on those grounds rather than examine the 'services' you authorized payment for.

To guarantee refunds under Sec 75 you would therefore have to deny making them in the first place, which means that you yourself become a fraudster too in the eyes of the law - these shithole casinos know this, hence why they get away with it.

I have been moaning for years about the fact that banks/payment services should NOT provide services to fund gaming transactions unless the vendor has their licence no. incorporated into the transaction codes given by the financial provider and this is checked before financial services are offered to any casino. I believe Neteller have finally done something similar by letting UK players pay to UKGC licensed sites only.

It was a debit card but one transaction was a credit card.

I’m going to call them now.

My bank doesn’t seem helpful at all, they said I have to wait 30 days before I can dispute it.

Winner365 said I will be committing fraud if I do a chargeback and they will report me for fraud :/ yet they won’t give me a list of transactions as proof.

One idiot did give me the last 4 deposits via live chat which I have (if you want to see) and they don’t match so I’m going to send this to the bank.

So they'll tell your card company that they want to keep their unlawful unlicensed deposits?

Your bank is wrong by the way. The timescale starts from the moment the transactions were made.

I think you'll need to look at the Gaming Act. I'm pretty sure there is some info on the UKGC site too pointing out an operator must be licensed by the UKGC in order to take bets from the UK public.

Thank you all so much! Bank has made a dispute over the amounts based on the last 4 deposits! Winner365 won’t give me anymore than the last 4. I have sent them the information hopefully this can resolved soon! Really appreciate all your responses

The procedure the bank should follow will remove that concern. They should simply post you a sheet of transactions on which you mark all the disputed charges from a certain date. You then sign a form to say this is all honest and true etc. and return it.
