Mohawks respond to Internet gaming decision

For immediate release

(Kahnaw:ke 14, Tsothohrhk:wa/January 2008) Mohawk Council of Kahnaw:ke Grand Chief Michael Ahrhrhon Delisle, Jr. announced today that he is extremely disappointed with a decision made by the United Kingdoms Department of Culture, Media and Sport, which has failed to include Kahnaw:ke on its list of jurisdictions whose Internet gaming permit holders are allowed to advertise in the U.K.

Given Kahnaw:kes long-standing reputation as the world leader in Internet regulatory compliance and enforcement, it is disheartening to receive word that the Kahnaw:ke Mohawk Territorys efforts will not be afforded the same consideration that has been extended to Tasmania, which has no such history, said Chief Delisle.

Despite having been the first jurisdiction to accept and implement the world-recognized eCOGRA standard, the implementation of a mandatory continuous compliance policy, and our consistent enforcement of what may very well be the worlds most stringent due diligence program, our name has not been added to the U.K.s exclusive white list, he continued.

Kahnaw:ke has concerns regarding the process undertaken by the U.K. authority and has initiated inquiries to ascertain whether the application was afforded fair and objective consideration-which, at this point, we do not believe was the case.

We are keenly disappointed in the U.K.s decision, which ignores the long-standing alliance between our Nations.

We also find it deeply troubling that the actions of our old friends directly conflict with the commitments they made in the United Nations Declaration on the Rights of Indigenous Peoples, to which the UK was a signatory in September, 2007. We are seeking advice as to Kahnaw:kes potential recourses against the UK under Article 20 of the Declaration, which states:

1. Indigenous peoples have the right to maintain and develop their political, economic and social systems or institutions, to be secure in the enjoyment of their own means of subsistence and development, and to engage freely in all their traditional and other economic activities.

2. Indigenous peoples deprived of their means of subsistence and development are entitled to just and fair redress.

Despite this setback, the Mohawks of Kahnaw:ke will remain committed to our established leadership role on the front lines of regulatory enforcement of the Internet gaming industry. We will continue to ensure an environment where fairness, integrity and player protection are paramount.

Compliance is fairly strict in the UK. Regulated means regulated. Companies are heavily fined. AP & UB would have been banished. Kahnawke would probably have been heavily fined for their dealings with that particular issue. They have not shown to be worthy regulators. Within their board, they have a clash of interests, ask Ongame, they have heavy pull at Kahnawke. I would say it's the right move.

How they ultimately handled the Absolute Poker fiasco crystallized my disdain and total lack of respect for the Tribe's gambling endeavors. You ain't entitled to squat inre international moneys or certifications, Chief. Nada.
 
I am going to say they are playing the race card as well it is the first thing I thought as I was reading through the post.

In all honesty it sums up their lack of integrity.

If they were serious about regulation they would of asked pertinent questions as to why they failed in their application and what they had to do to improve and gain entry to the Whitelist.

That is what a responsible organization would of done and it sickens me that they want to promote their own selfish interests under the pretense that it is for their people and now they have been found out they want to play the race card.

They are just damaging their reputation further.

Ongame owner as a 2005/2006 on the board at kanKahnawke. Im trying to check but a lot of the backdated stuff is blocked. It was common knowledge but its out there.

Tasmania connection, because that is half of their outfit. So thanks kanKahnawke, maybe that will get reassessed too. Just like pokernews comitment to a proven cheat. You should have trained him not to out one of his own, but kanKahnawke just as bad.

Last week 16 year old JJProdigy got caught playing 2 accounts in one Tourney. His explaination "damit granny" didn't fly. Party sucked up 140,000 of cheater profit.



I have not broken the affiliate agreement in any way shape or form, so PartyPoker is using good old clause 5.3 to stop paying me simply because they can. If this makes you feel safe, you are being completely illogical. It can and will happen to more people, this I guarantee. You’re not safe at all.

In conclusion, I want to make it clear that I regret what I did, and have done somethings that were unethical. Despite this, PartyPoker’s actions are unreasonable, and their power to take the same actions against you should not be taken lightly. This rampage that PartyPoker is on will certainly not end with me. So whatever you do, be careful.

Yeah high comedy.

Anyway I got a reply from the UK gambling commission and they either do not have or will not divulge the details as to why the Kanhawake Whitelist submission was turned down.

It may be possible to keep digging and get the facts but we can pretty much take it as read, judging by the Kanhawake response, it will have been a failure to meet operational standards required (proper enforced regulation) that was the main reason for non acceptance.
 
Make that 2 accounts, Another site on the network. Had the account over 5 years. Not a big deal, Ive not trusted the network for a while. I would rather send players to AP, at least they have been exposed for what they are.

ANTIGUA 'SURPRISED' AT UK WHITELIST ADVERTISING RULING

Caribbean island government says it met requirements

Departing on a flight to Washington for further talks on the WTO struggle with the United States Trade Representative this week, Antigua's Finance Minister Dr. Errol Cort digressed sufficiently to tell reporters that he was surprised and disappointed by the UK government decision not to grant advertising whitelist status to his country.

Last week the British government's Department of Culture, Media and Sport declined to give Antigua and Kahnawake whitelist status, which would have enabled online gambling companies licensed in those jurisdictions to advertise in the United Kingdom. Tasmania, on the other hand was included, joining respected jurisdictions like Gibraltar, Malta, Alderney and the Isle of Man.

Kahnawake Gaming Commission was more outspoken, hinting that it may seek to take the matter further through the United Nations (see previous InfoPowa report)

Dr. Cort said that the rejection was particularly surprising as an Antiguan delegation is set to meet the UK Minister of Sport next week to discuss the issue. The finance minister disclosed that he will lead a delegation to London next week Thursday, to meet with the UK minister responsible for gaming, and intends to continue discussions with the gaming authorities in the UK in hopes of achieving this goal.

Cort said the delegation hopes to return with a better understanding of what is hindering the process. In earlier statements Cort had said he was confident whitelist status would be achieved after cooperating with the DCMS on its requirements.
 
That is a much more measured and sensible response than that given by Kahnawake.
I think the chances of the Mohawks bringing the case before the UN are virtually Nil but if they do their chances of success will be even less.
A case of the rattle being thrown out of the pram if ever there was.

Maybe they need a new Chief, how does one become chief anyway, are they elected, I have plenty of free time these Days.

I think the whitelist issue was obviously a done deal before the finalised Absolute findings were published, but that has only gone on to prove that the decision not to whitelist is 100% correct.

Clearly it is the race card they are trying to play, when they should be doing something about actually regulating, rather than paying lip service to standards they fail to uphold.
 
My opinion why Kahnawake do not deserve to be on any white list or even allowed to grant a license

1) They are not objective
2) They dont seem to have the players interest at heart.
3) They protect certain companies.
4) Their licensing guidelines have been proven to mean nothing.
5) They rarely respond to queries.
6) They do not offer disclosure of important information.
7) Their is a conflict of interest internally.
8) They do not meet compliance standards.
9) They have hidden behind a cloud of self proclaimed respectability.
10) They are a fake regulator.

KGC seem to have spent AP's fine on some quality PR staff. They are currently sueing the country of India for calling themselves Indians and trying to feed off the Mohawk respectability.
 
Does anyone know which standards that have to be met in order to be whitelisted by the UK Gambling Commission? Have the commision made statements about this?
 
I don't think the definitive requirements and standards are available for public scrutiny although general guidelines are published. I suspect that like most governemental compliance enquiries it remains sealed under the Thirty Year Rule. However, if you wish to delve further you might want to try:

In the UK, the exclusion of Antigua from the Gambling Commissions white-list of approved online advertisers could be overturned following a meeting between ministers of the two nations last week.

According to the Antigua Sun newspaper, Errol Cort, Minister of Finance for the island nation, stated that he believed the chances of a reversal in the decision as favourable.

The Minister headed a delegation that met with Gerry Sutcliffe, the UKs Minister of Sport, in the hope of moving the process along and ensuring that the Gambling Commission had all the information it needed in order to complete its review and approve Antiguas application.

We are extremely encouraged by the reception we received from Minister Sutcliffe and his staff, said Cort.

I was happy to learn that very little stands in the way of our approval for white-listing and I think I can express confidence that this issue will be resolved favourably in the very near future.

Minister Cort stated that he had assembled a team that included well-known legal advisor Mark Mendel and Trevor Mathurin, Deputy Administrator of the Financial Services Regulatory Commission, in order to be able to address the specifics of any questions or concerns that Minister Sutcliffe may have had regarding the Caribbean nations regulatory efforts. The Antiguan delegation also included UK High Commissioner Carl Roberts and Director of Gaming Kaye McDonald.

We are acknowledged global leaders in the regulation of this industry, said McDonald.

Our standards are the highest in the world and we view the white-listing as important to demonstrate our commitment to the highest standards in the supervision and oversight of this dynamic industry.

This meeting shows what governments can accomplish by working cooperatively and openly to resolve issues between them, said Cort.

We appreciate Minister Sutcliffes interest in this matter and look forward to concluding this matter shortly.
