I'm in Switzerland and not affected, still i find this very strange... Has anyone heard about this case where a player was fined?? Sounds very strange to me!

GUTS.COM WILL NO LONGER BE ABLE TO OFFER OUR SERVICES TO GERMAN CUSTOMERS

I regret to inform you that due to a recent verdict in Germany, where a German customer was fined for playing on a foreign online gaming website, Guts.com will no longer be able to offer our services to German customers.
This means that you will no longer be able to send us German players.

For your information: Our German accounts will be locked from 16th February 2015. Until then, players can access their accounts and request withdrawals, which will be processed as quickly as possible. Withdrawals can be requested after the lockdown as well through live chat or email (support@guts.com).

All of us here at Guts are terribly sorry for any inconvenience this has caused and we would like to thank all our German players and affiliates for participating and contributing. We hope to welcome you back in the future. After all, said verdict goes against everything the EU stands for and we do expect the verdict to be overturned. If you have any questions about the recent development regarding German players, please do not hesitate to contact me.

First Betspin, now GUTS :(

Just read the email, so sad. I hope the guy who was persecuted for his blackjack winnings will take it up to a higher court who will then, hopefully, rule out the EU Law. One damn german states attorney takes Guts away for me :oops:

They even took his whole winnings, WTF? Why not make him pay the tax, would be bad enough.

I think GUTS have done the right thing here. They are protecting their German players from being fined as this case may encourage further prosecutions by the authorities. It's worrying that they went after the PLAYER, not the operator, this is something that only a small number of US states can do, and even they seem very reluctant to do this, preferring instead to find and confiscate the money in transit in the hope of making it economically too expensive for operators to continue flouting the law (as they see it).

Other German players could also be at risk until this matter goes before a higher court, and is shown to flout EU laws.

Thats bad::-(
Are redbet, betsafe and casinoeuro allowed to offer their Games to germans?
Or will one of them be the next Casino that closes for germans?

I think the main reason for this is not the judgement of the lowest court but the new law about paying taxes for german players.

It is not flouting EU laws though, individual countries can ban foreign companies from providing services to players from their countries. Italy, Spain Germany, Belgium et al.

"A. whereas gambling is not an ordinary economic activity given its potentially negative health and social impacts, which include: compulsive gambling, the consequences and costs of which are difficult to estimate; organised crime; money laundering; and match-fixing; whereas online gambling may involve a greater risk of addiction than traditional offline gambling, owing, inter alia, to the increased ease of access and the absence of social control, but additional research and data is needed in this regard; notes that, on these grounds, certain internal market rules – including the freedom of establishment, the freedom to provide services and the principle of mutual recognition – do not preclude Member States from determining their own additional measures for the protection of players";

It is easier to fine a player than go after a foreign company and hopefully build up a deterrent to players.

That's unfortunate news for German players. Hopefully, it is something that is only temporary. It would be a shame if this was a permanent move.

Its terrible for the players but I guess there looking after them selfs as well, Last thing they want is there door getting kicked down and all equipment swiped, Thats another fee casinos have (good ones) that goes unnoticed is lawyer fees, & believe me they do not come cheap now says,

Its getting really bad, Years ago there was no such problem, You will not be able to breath soon without being fined.

It may be easier, but the player is effectively the VICTIM here, a victim because the company advertises and provides a service to German players. It would be the same as fining or imprisoning some pensioner who gets conned by a "boiler room" investment scam and ends up sending a large sum of money to a criminal organisation.

Although casinos might not be able to appeal and overturn this, a player might through the use of a "human rights" defence so that governments are forced to protect players from misleading marketing, rather than waiting till they have already been conned by advertising that claims that they can play because it has an EU licence.
