CLONIE ADDS TO CASE AGAINST FULL TILT (Update)
6 February 2009
Now Pocket Kings and Tiltproof have been added as
defendants
Pro poker player Clonie Gowen has responded in
determined style to the attempt by Full Tilt Poker's
legal team to have her litigation against the company
and various individuals dismissed; last week she added
two more defendants and seven causes of action in an
amended complaint, along with further details of her
claims, which amount to millions of dollars (see
previous InfoPowa report).
Gowen claims that the defendants are in breach of an
agreement with her through which she claims she is due 1
percent of Full Tilt's considerable profits as payment
for her endorsement and involvement in the company as a
"celebrity representative, promoter and spokesperson."
The defendants' accusation that her claim did not
present sufficient detail has resulted in Gowen adding
information concerning a 2004 telephone conversation
with a senior Full Tilt exec. The poker pro's legal team
has Gowen additionally sumitted claims for accounting,
promissory estoppel, specific performance, declaratory
relief, right of publicity, quantum meruit and negligent
misrepresentation, together with a "minority oppression"
claim - a breach of fiduciary action brought by a
minority shareholder against the majority.
And Pocket Kings and Tiltproof have been added as
defendants in her suit, adding these companies to Full
Tile itself and an all-star list of poker players
associated with Full Tilt, which includes Howard Lederer,
Andy Bloch, Phil Ivey, Chris Ferguson, John Juanda, Phil
Gordon, Erick Lindgren, Erik Seidel, Jennifer Harman,
Mike Matusow, Allen Cunningham, Gus Hansen and Patrik
Antonius.
The legal process will now enter the discovery phase
once defendant's legal team has complied with a 30 day
deadline to either respond to the new information or
launch another motion for dismissal.
