Casinos With US Player Restrictions

From what I understand, this interpretation relies on the wording in the new law which prohibits transactions funding "illegal" internet gambling. Because only certain states have expressly made online gambling illegal and not the Federal Government (which has still not amended the 1961 Wire Act), some casinos have limited their player bans to those states.

This seems to me to be the most likely rationale for the *prohibited states* policy we're seeing evolve at the moment at those casinos and poker rooms that have decided against an all out US player ban.

Right on, Jetset. Last week, amongst the hundreds of postings regarding the bill and how it applies to us, it was mentioned that the word "Unlawful" was a moot point because online casino gambling WASN'T unlawful at the FEDERAL level in US. But some STATES have actually DID pass legislation making it unlawful at the STATE level. Soooooo....it seems the casinos that are singling out states that actually made online gambling illegal and that the bill applies to those states.

I happen to live in one of the states. And from what I could
find, the law is very vague and goes back to a wire act, in state,
from 1953. There were amendments to the law in 2000, but
again, very vague. Nothing specific, more along the lines, I cannot
open an internet casino in my state and take money.
Really upset over the whole deal.
Why worry if I live in an illegal state now? Some of the micros
I have been playing at for 5+ years. It was okay to take my
money, illegally for 5 years?
Another interesting note, most of the "banned states" have some
form of casino, riverboat casino, or Indian casino.

The deal is that the states are okay with that form of gaming because all the money and taxes stay where they can spend it, usually in the public school system. It's always about what is good for the children.

And if you look at who funded the election campaigns of the people who banned gambling in those states, you might see their names on there too

In the past years, the states would make online gambling illegal but it was hard to catch the players themselves gambling online. It was hard to enforce and really, it wasn't good public relations to have police/sheriffs breaking into peoples' homes just to try to catch you in the act. So the laws were a moot point anyway and the online casinos knew that.

NOW, the focus is on catching the online casinos/sportsbooks accepting bets from residents of states that made online gambling illegal. Louisiana went further to explicitly make illegal the setting up of a sportsbook/casino illegal.

The bigger universal question is over jurisdictions.....how can a non-US casino be in violation of a US law if the resident him/herself went to the online casino initially to bet? Even if the online casino put legal language into it's terms and condition that the onus is upon the player him/herself to abide by their (players') local laws, why would the online casino be in trouble? The US government is trying to bulldoze it's way over WTO and other countries' laws.

Fortune Lounge

Dear Mark,

It is with deep regret that I inform you that Fortune Lounge will stop accepting bets from our customers in WASHINGTON, as from midday, Eastern Standard Time, on October 13th.

The Safe Ports Act passed by the US Congress on Friday, September 29, makes the transfer or direct processing of money to online gaming institutions illegal in the USA.

The affiliate manager for one of the largest MG groups told me that the ban in the 11 (or 9?) states is done at the Microgaming level, which is beyond their control. He said the plan is to wait a few months and see how things play out in courts, then change their stance if possible.

Re

I heard that microgaming will not be allowing any of its people it liscense to to accept any US players. I got it in an email from one of the MG casinos. Now I cant find the email, grrrrr

As you may know Congress recently passed the Unlawful Gambling Enforcement Act, if this bill is signed into law we will no longer be able to offer real money play to US players, and your Kiwi Casino account will be suspended with any remaining balance returned to you.

We're as frustrated about this as no doubt you are, and ask that you to join us in voicing your disapproval to your local congressman and signing up at Link Removed (Old/Invalid)

Dammit!! Just got this from

Dear xxxxx,

Following the recent passing of the Unlawful Internet Gambling Enforcement Act of 2006 in the United States, we regret to inform you that 32Red Plc will no longer be able to offer, in any manner, internet gambling opportunities to our players who are resident in the USA. As a reputable company, in a reputable jurisdiction, 32Red does have to abide by the laws of overseas countries no matter how unrealistic we may believe them to be. We have had great pleasure in providing online casino and poker services to our American players and look forward to the day when legislation is implemented allowing 32Red Plc to once again provide a service to players in the USA.

As of 09:30 am BST(04:30 EST, 01:30 PST) on Friday 13th October 2006, your account will be closed. Please contact support@32red.com so that we can arrange payment of any outstanding monies to you.

Oops... you guys were posting while I was typing and sipping coffee... sorry...

32Red - predictable really. It's the last of the PLC's that I am aware of so that should in theory mean that no more Total US bans will come unless the software operators intervene. At least for now.

Yeah... 32Red (TTR.L) announced similar to the city this morning:

LONDON (AFX) - 32Red PLC said it has stopped accepting any bets from the United States from today and clarified that the revenue and profit originated from the USA on its casino and poker platforms have been "immaterial" this year so far.

It also said that Betdirect, its sports betting operation, has never accepted bets from the USA and that the vast majority of 32Red's business is sourced from outside the USA.

It said the group will continue to focus on the UK market as part of its ongoing strategic positioning.

As a public listed company it would be wrong for them not to point this out. This is directed at their shareholders.

Press Release from 32Redplc.com

Strategic update

32Red is a UK betting and gaming brand
whose success to date has been founded on
its focus and exposure to the UK. The
Group will continue this approach and the
recent acquisition of Betdirect and the
sponsorship of Premiership football club
Aston Villa underline our ongoing
strategic positioning.

The vast majority of 32Red’s business is
sourced from outside the USA. However, a
limited percentage of revenue has
originated from the USA on our casino and
poker platforms and the profit from this
revenue stream has been immaterial in the
year to date. Betdirect, our UK focussed
sports betting operation, has never
accepted bets from the USA.

Following the changes in US legislation
concerning the Safe Ports Act, 32Red will
no longer accept any bets from the United
States with effect from 9am, Friday 13th
October.

Looks like casino rewards is out too.

 What have they told you? I expect them to block the "illegal" states but the properties are owned by ITS still (I think) which is a "Limited" company and not a PLC so a total withdrawal would be a surprise.

Ah okay - I'm guessing that this is the 11 states then rather than a complete pullout  Still a mystery as to why NY and NJ are included though.

Wow, what is wrong with these MG casinos. They should all be automatically cashing out any remaining balances like Crypto did. At least with the Palace group I received a little warning so I could check my accounts and have a "farewell gaming session". I really expected more from 32 Red. They didn't even send me the email until after they had already locked my account.

Got 2 emails

I just 2 emails

Ruby Fortune and Spin Palace just closed my accounts, BUT.....Im in PA? Im not even in the listed states that arnt allowed to gamble!! They used the same format as the other threads in here.

From CasinoProfitShare (Golden Reef, UK Casino Club, Challenge Casino, Music Hall, Nostalgia):

It is with the deepest regret that I write to inform you that in light of recent legislative changes, our client casino and poker sites will no longer be able to accept transactions from some areas within the United States.

This will come into effect once the Unlawful Internet Gambling Enforcement Act is signed into law by the President, which is expected to happen on Friday 13 th October 2006.

The new ruling applies to all new and existing players residing in the States listed below:

1. Illinois
2. Indiana
3. Louisiana
4. Michigan
5. Nevada
6. New Jersey
7. New York
8. Oregon
9. South Dakota
10. Washington
11. Wisconsin

Once the Bill is signed; our client casinos and poker rooms will no longer be able to accept transactions or wagering from any players residing in the states above.

We will continue to accept deposits and bets from players within the remainder of the United States while we continue to monitor and review the legislative situation.
