    WHAT'S IN A CONTRACT?
    To read or not to read? That should not be a question in anyone's mind when one signs up at a casino or enrolls in an affiliate program. Over the past couple of weeks, there have been a number of casinos that are pointing to their contractual terms in their terms and conditions in order to protect themselves from abusive play from players. There is also a lively discussion in our forum about the contractual agreement between webmaster affiliates and Fortune Affiliates. A group of webmasters are claiming that FA has breached their contract; the affiliate managers claim they have not.

    This brings to question, how often do we really read these things? I mean c'mon now -- most players when they read the terms and conditions of a casino promo, only look for certain things - wager through requirements, prohibited games, and prohibited jurisdictions. They don't read much further. Now, I'm not trying to allude that casinos are out there to trick anyone, but when you sign up at a casino - you agree to their terms whether you like it or not.

    Here's one from Club Player - RTG:
    14. DISCLOSURE OF FRAUDULENT ACTIVITIES. If, in Company's sole determination, you are found to have cheated or attempted to defraud the Games, Club Player Casino, or Company in any way including but not limited to game manipulation or payment fraud, or if you make untrue and/or malicious comments with regard to Company's operation, Company reserves the right to publicize your actions together with your identity and email address, as well as to circulate this information to other online gaming sites, banks, credit card companies, and other appropriate agencies. Further, Company may close accounts, and forfeit account balances, that you have at Club Player Casino or at any other Company website, casino and/or business
    So this means if you are posting malicious comments about a casino on the message boards, they have a right to publicize your personal information and circulate this to everyone and their brother. I wonder how many players are aware of this. And I'm not picking on Club Player. In fact, do a Google search on "DISCLOSURE OF FRAUDULENT ACTIVITIES" and you'll be surprised on how many casinos and poker rooms use the same clause.

    The player, by providing their postal address, agrees to accept hardcopy correspondence from the casino at such address, from time to time, and acknowledges that such correspondence may carry conspicuous branding identifying the same with the casino. If the player does not wish to receive hardcopy correspondence to their postal address, they may unsubscribe from such communication by submitting their details here.
    I remember a while back how a player got really irate towards another Fortune Lounge casino that sent him some promotional material in the mail. Seems his in-laws were there watching him open his mail. They didn't take it too well that he was a gambler <gasp! faint!>.

    The question this brings up is whether or not a change in the way affiliates are paid constitutes a breach of contract, or is it merely a "change"? This has become a heated argument in our webmasters section. I would recommend this thread for all casino operators and affiliate managers to bone up on.     A New Yorker was forced to take a day off from work to appear for a minor traffic summons. He grew increasingly restless as he waited hour after endless hour for his case to be heard.

    When his name was called late in the afternoon, he stood before the judge, only to hear that court would be adjourned for the rest of the afternoon and he would have to return the next day.

    "What for?!?!?" he snapped at the judge.

    His honor, equally irked by a tedious day and sharp query, roared out loud: "Twenty dollars contempt of court! That's why!" Then, noticing the man checking his wallet, the judge relented:

    "That's all right. You don't have to pay now."

    The young man replied, "I know. But I'm just seeing if I have enough for two more words."
