Unless they're making up the rules as they go....like trying to say that since you breached the T&C in the beginning, you wouldn't be eligible for any further bonuses, and if that was the fact, then you wouldn't be entitled to any winnings from it.
This looks pretty rogue. They did nothing about a breach of terms the first time, because the player lost. I am sure that this player would have been allowed to continue depositing, and losing on Roulette, without comment.

However, they should have LOCKED the account after the first deposit, win OR lose.

The second deposit, on a zero balance, broke no rules, for THAT deposit at least. However, despite the fact the player did NOT try the "abusinve strategy" again, but played SLOTS, the games with no real chance of beating WR unless by pure luck (as opposed to "abusive" play). They sat back and allowed deposits 2 and 3, only voiding on a big win.
Clearly, this player could have deposited even more, and played within the rules, but could never, ever, win because of the ability of the casino to suddenly "remember" that a restricted game was played the first time. This shows that the casino was happy to take more and more from a player who made this error the first time, but would be able to ensure the player would never be allowed to make an overall win, thus making this a completely unfair situation (only the casino stood a chance of winning).

This is why Playtech are so ill thought of, they take advantage of such situations, rather than operate a fair and consistent policy for all.

What gets me is the tone that's used in replying to this player. This isn't the time for the typical canned casino responses, which seem very much out of place in this extraordinary situation.
We sincerely apologize for any inconvenience caused, Andrew. We regret to inform you that your withdrawal has been declined.
Um, I'd say having $42K confiscated is a little bit more than an "inconvenience." Not a good choice of words under the circumstances.
Your cooperation regarding this matter is highly appreciated, Andrew.
sarcastic response: "Oh yes, because you appreciate it so much I'll just let you take my huge $42K win. You don't even need to explain why you're taking this action. Anything I can do to help!"

As far as the merits of this complaint, I'd have to agree the casino is on very shaky ground here. It doesn't seem justified to use the violation of the T&Cs from the first deposit to void the valid winnings from a subsequent deposit, as long as the balance was zeroed out before the second deposit was made.

Jeez, you submitted it yesterday (a Sunday I might add) and I'm just prepping it now!

I understand your concern but (a) you've got to give these things some time and (b) getting a reply isn't really up to me, it's up to the casino. After I submit your case to them I wait, just like you.

If they're quick on the uptake -- many are -- then we hear back quickly. If not -- it happens -- then after a reasonable time I prod them again ... and again and again as necessary.

When I hear something relevant from them then I pass it on to you. So you see, it's not exactly a coffee-and-a-smoke kind of thing.

If I received such an ugly email from any casino's financial dept., I'd assume it is no use to try and get any more clarification there. It's like when shopping on eBay - if seller dismisses your complaint, you do not continue wasting time with him, you take it up to ebay or paypal. Just IMHO, of course.

    FDL,

No harm trying to get things resolved although it may take quite a lot of time and might get you nowhere. The fact is that there are many players out there who dont know how to seek help if they chalk up a sizable win. The fact that the casino doesnt even give a reason for withholding winnings means that they probably know they are in the wrong and if the player doesnt find an avenue for complaint they might just get away with it.

There have been instances where CM was able to negotiate with the casinos concerned for a much bigger amount than $42K so it never hurts to try if you know you are being screwed. I hope andrewoll is successful in getting the $42K.
