    Jurisdiction of the interpreted Terms & Condition

    Two questions.

    Should terms & conditions be construed by the location of where the casino operations are, like the UK or from where they are licensed?

    Do you think the terms & conditions should state which authority they will be interrupted from or should players just guess?

    The jurisdiction of a T&C will be the place they are licensed. For example; Betsson is licensed in Malta, they are a public company listed on OMX NASDAQ NORDIC MID CAP LIST. They have offices both in Malta and Sweden. But the jurisdiction for their online casino is in Malta.

    As Kesch said, it is stated in the beginning of a casinos T&C (or should be).


    correct me if Im wrong.

    In your two examples Grande Vegas advises where the terms shall be interrupted, the laws of the UK.

    In the Manhattan Slots term you provided, it doesn't state whether the terms will be construed by the laws of the UK or the licensing authority of Curacao.

    What got me thinking about this was I read Max's Corner last night and here's the quote:

    "The truth of the matter is that under UK law a person in this particular guy's situation is legally classed as a student, there's actual legal precident for this. In other words CWC was fully correct and within their rights to rule on this case as they did. In fact they would have been remiss to have done otherwise."

    Let me be clear I'm not trying to open a healing wound but it did open my eyes to the fact that although a casino might be licensed in another country, for example Curacao the management many times interrupts the T & C's where they operate.

    I honestly thought they had to be construed by the licensed country, maybe I'm wrong. Isn't Curacao Dutch law? I'd need to go look again but I think so.

    Anyhow I guess that's just something else to be on the lookout for if in fact I'm correct.

    I think you'll find that companies are (almost universally) legally bound to operate within the law of the country where they are based -- the registered location of their head office or whatever -- regardless of other considerations such as where a casino might be licenced. I think that alone tells you where the shoe is going to fall when it comes to legal issues, etc.
