Moneybookers or Betfair?

Hello everyone,

I was advised to visit your site for help. Here is my story (sorry - it is rather long).
I played at Betfair poker and made a deposit via Moneybookers payment system. After a certain period of time I received a message from Moneybookers that my account was blocked due to some fraudulent activity and they requested copies of ID proving documents which were notariously verified. I sent them but a little late as it is quite difficult and expensive to get them in my country, and also because of lack of time. My account there was not reopened and I found out that my funds ($2000) are confiscated. I phoned them several times but invain. Then I wrote them an email that I was going to sue them for illegal confiscation and asked them to send me an official letter proving the fact of that confiscation. Immediately they wrote that long ago they had sent my money to my Betfair account. When I contacted Betfair, they answered after some research that they couldn't find that transaction, they needed transaction logs. Again I called Moneybookers - they answered they would contact Betfair themselves as they DIDN"T WANT TO COMMUNICATE TO ME anymore. Later I called Betfair for this issue - they said nobody had contacted them and promised to contact Moneybookers themselves.
Since that time I didn't receive any replies from Moneybookers or from Betfair - my emails are ignored. I just do not know whom to believe. I tried everything, but it didn't help.

What can you advise me to do? I am too tired of this to think adequately.

Hi there,

The reason why so many gaming companies use moneybookers, is because there is no chance of a chargeback if cash is received via moneybookers. If a gaming co. has been informed that your transaction is dodgy by moneybookers, then they will immediately suspend your account, as would every gaming company. Your issue is not with the gaming company but with moneybookers and I suggest you concentrate your efforts with them!

Can you really sue moneybookers? Can a court condemn them and force them to pay, or are they out of the reach of the law, as online casinos?
What about neteller? I have an account but I am hesitating to use it exactly because of cases like yours.

If you can really sue them and a court can indeed take actions against moneybookers, then immeatelly threaton them with legal action, and imply that you have the money to do it.

It is obvious that they dont give a shit about your case, and you are in a very difficult position. It is they rich they are scared of, as these can ruin their reputation, perhaps take them to court, and can contact personally the persons involved. So try to find the NAMES of the person that made these decisions. Even large banks have to say the names of the managers who made each decision.

Dont feel tired and discouraged, it is exactly what they want you to do. Start doing whatever passes your mind, you will learn more things on the subject from your failured efforts.

Try to seek help from your casino manager. If he doesnt give a shit, blame him. YOU NEED TO BE AGGRESSIVE. Or else, quit the case.

Give more details of your problem here if you can, and keep posting until someone who knows more notices you.

Also try the free legal help some state organisations give to the public. Do not accept denials.

Moneybookers has its registered office in London, so it can be sued in the English courts.

What about the other relevant money transfering companies?

Moneybookers is a registered UK Company, with offices in London (Just below Canary Wharf). Details on their contacts/requirements can be found here :

They are also FSA Regulated. Full details of their FSA registration can be found by going to http://www.fsa.gov.uk/register/firmSearchForm.do and searching for Firm Reference Number 214225

You can approach the FSA with a complaint, but I don't know how far they will go to help non UK/EU Citizens.

Neteller is an Isle of Man Company, but is also FSA Approved (Firm Register Number 229737). Firepay is Firm Reference Number 454852.

Since you are not in the UK, phones and emails will be your only real method of communication. Since Moneybookers agents have said they don't want to deal with you, your best option will be to send a Registered "Return Sugned Receipt" letter to their office :

And ask them for full clarification on your account. You should also have received transaction advice emails for each transaction you performed through them, but ask Moneybookers in your letter to give you a full breakdown of your account activity.

You can sue Moneybookers, but if they sent again the money to betfair, they are out of this matter.
So, go against Betfair for your winnings.
MB is only a payment service (not the source of your income).

Anyway, if you're not a resident, prior to sue a Great Britain based company you must make a deposit covering all the expenses in the event that the complaint becomes irrelevant.

In other words, if you are not rich, they can steal your money if they want to.
