It might be, since a CHEQUE is offered, but you do NOT EVER reveive the amount won, it is the amount received to open one of these MGS "free play" promotions, and winnings are capped to an amount well below the cheque amount, and a deposit and further wagering would be required to make a withdrawal. This would most likely count as misrepresentation, since this should be presented for what it is, a PLAY balance, offering a chance to keep WINNNGS over and above the initial amount. They also misrepresent the process by which "winners" have been selected. Uness they can show that there has been a random selection process to decide who receives the mailers, they have again broken the law.
The problem is that this is the internet, and it is almost impossible to enforce any kind of law until you can pin down some entity to prosecute. Further, you then have to identify a jurisdiction in which any offense has been comitted, and then make sure that the law in this juristidiction has been breached. The casinos are based in Australia, but the servers are in Kahnawake, and the mailers come from somewhere else with little in the way of such laws. They can do this because it is more or less impossible to bring a legal case to make them stop. Where do you take action? Australia, where the decision was made to do this, Kahnawake, where the "product" is supplied from, or wherever, where the mailers come from (usually somewhere like Belize or Curaco, using a third party marketing company).
They would have to clean up this act if they want to get whitelisted though, since they would have to obey quite a few rules based on EU/UK law, rather than the laws of their home country, or the country the mailers are sent from.

I think what he means is "INSPIRED by the Nigerian scam" in how it is presented, but not "like" it in the sense that they get your bank info and drain your account.

On the contrary, many say they get your NETELLER info, and drain your account slowly as you play
