Exclamation TEXAS BILL INTRODUCED BANNING GAMBLING

A Bill has just been referred to the Texas Committe on Jurisprudence(see texas legislature on-ine)

This is a copy of the email I sent Represenative PENA(the Chairmans)I urge Texas residents to send their represenatives and Mr. Pena and email if you disagree with the proposed legislation.

Here's a copy of what I sent:

"Is this Bill aimed at Gambling Establishments physically located in our State? The Bill is vague.

I noticed that it is listed under MORAL issues.

I do not see that the act of playing poker or skill-games for money or prizes is any different than playing the State Lotto, or going to the Horse or Dog Races.

You have more chance playing a skill game or poker and winning than you do playing the Lotto.

So, to say this is a Moral issue or is in the best interest of Citizens, while allowing them spend their money on the Lottery, Betting on Horses and Dog Races is just RIDICULOUS.

If you want to deny Gambling then do not allow ANY FORM OF GAMBLING. Do away with the Lotto, Horses and Dogs. Citizens lose millions on these forms of "legal gambling".

YOU CAN'T HAVE YOUR CAKE AND EAT IT TOO"(end of email)

Obviously, it is in the States interest to keep the Lotto, Horses and Dog Racing, as it is a big money maker for the State. Therefore, the law making these forms of gambling have been written to benefit the STATE. The Bill proposed on 1/31 clearly is on the heels of recent U.S. action as Texas has no individual bill regarding online gambling. It is interesting to note that the Bill is so vague that it does not specifically state online gambling is illegal. Like most Texas statues, it is vague and the true enforceability left to the courts.

Also, unreleated to gambling, a bill has been introduced giving Residents to use excessive force, including shooting a person that enters their habitate, stealing their property etc.. when they fear for their safety.

I have a problem with the Bill in that it provides no guidelines what so ever. There have been cases of children, teens that have been shot for cutting through someones yard or Toliet papering there trees, etc.
There are alot of crazy people out their that have no common sence. The statute should include what is considered a Habitat(does it include a yard). It should stipulate that the intruder had a weapon and failed to leave when requested. Even the police have to announce "stop or I'll shoot.

Texas passes Laws that are vague and relies on the Courts to determine whether or not they are enforceable.
I would hate for young people or indivduals with no criminal intent for entering a yard or private property(not the residence itself, of couse) to be shot , and then the Homeowner sent to Jail because the court finds he was not in what they consider, "in danger for his life" as the individual was not armed.

I read all proposed Bills regarding Criminal Law and Procedure because I truly believe that in this country YOU ARE GUILTY UNTIL YOU PROVE YOURSELF INNOCENT." Have you ever wondered why the State or U.s. Government doesn't have to pay the defendants legal expenses if he is found to be not guilty? If they did, prosecutors would only file/try cases that they could legimately win. I am speaking mostly in regard to City and County. The Cities and Counties make lots of money charging people with Misdemeanor crimes and in Texas there are no public defenders, you have to pay for an attorney even if you can't afford one when it is a Misdemeanor charge. Most of the cases never go to trial, they are mostly plea bargained. The County collects the fine, the lawyer gets money and you get screwed.

I will now get off my soap box but urge everyone to take an interest by reading proposed u.s. and state legislation, you can sign up for alerts for areas of the law you are interested in. Voice your opinion. We have become a POLICE STATE in my opinion.

JEEZ..I thought gambling was already illegal in Texas. Isn't there only one licensed casino in the state?

I always hear the stories of the police constantly raiding the poker games. Still some of the finest card players throughout history have come out of the state of Texas.

It's a lot harder to get a 'right' back, than to give it up originally.

I have read elsewhere that the US average for lawyers fees is $4300+-.

wording of the proposed Texas Bill

REO, you are right the current Texas law makes it illegal to own a gambling establishment or take, arrange, bets between people and taking a fee.

The proposed Bill mentions "electronic gaming machines" well obviously most machines in casinos are electronic. I think they are eluding to electronic internet gaming but the Bill does qualify the meaning as is extremely vague.

This is why I played dumb in my email and asked if it referred to Gambling Establishment in our State.

I love how these JOKERS make laws that benefit themselves. They must think we are all idiots when they say gambling is a moral issue corrupting the family and the like and then allow gambling within the STATE.

I see so many people cash their paycheck and buy 100s of lotto tickets scratching them before they even leave the store. Now thats sad!!!!the chance of winning anything is probably a trilliion to 1

TEXAS BILL INTRODUCED BANNING GAMBLING

I live in Texas and my understanding is the bill is once again dealing with those 8 liner machines that are everywhere, supposedly for tickets only or coupons but actually result in payoffs if the owner of the location knows you :>). It's a cat and mouse game that goes on year after year. There will be big raids, smashing the machines, television cameras, then it's back to business as usual.

Rep. Pena has actually been fighting for the rights of Indian tribes in Texas to establish casinos as is done in Louisiana.
