The betting company has scammed me. I need the evidence to provide ukgc. So I made my subject access request for all information. I waited for a month and they refused to provide me with my subject access request fully and also said that I can complain to the Info commisor if i like and all further emails will be blocked.

I checked the information commissioner website and they will just tell the organisation to provide it what if they refuse again??

I am waiting for all transaction history, bet history, conversation history and all emails as well.

I made a fair request i gave them 3 months to provide this.

What’s the casino? Also under gdpr in the U.K. they cannot refuse you what your asking.

This advice from the ICO below looks watered down to when I had to use them [a diff matter to gambling ] back in about 2011.
Does seem a bit open and loose, ask the firm to solve it...then what?

I see there was a high court case in 2016 which states a business can refuse a SAR if the 'dominant' purpose is litigation. However if they ignore the ICO I can't see the ukgc approving, as it looks like the casino is aiming to hide faults in their conduct.

So personally I would go down the route of contacting the ICO, then if need be contact the ukgc, and you could always contact your MP, if they're of the helpful kind to raise the matter. It can't be right, given it's a regulated industry..

Step 2 – Report your concerns to the ICO
If you’ve complained to an organisation and you still do not receive any response, or remain unhappy with their handling of your subject access request, you can

.

We cannot:

  • act as your representative;
  • award compensation; or
  • punish an organisation for breaking the law (apart from in the most serious cases).
However, if we think the organisation has not responded to your request as it should have done, we can give them advice and ask them to solve the problem.

You should raise your concerns with us within three months of your last meaningful contact with the organisation.

Remember to send us copies of all the key documents you have to support your complaint, which you kept as evidence.

You can also seek to enforce your rights through the courts. If you decide to do this, we strongly advise you to seek independent legal advice first.
