Actually, they're not entirely full of it there. Online gambling is illegal for those in Australia. If I remember correctly, their gaming laws ban all online gaming and give a specific exception for Lasseter's to run sites for those outside Australia, but I'm not sure. Maybe a forum member from Australia could confirm this?
 
I think you might be right regarding the legality of the gambling - HOWEVER when the player signed up, deposited and wagered I'm sure they'll have selected Australia as their country and so the casino has no right to confiscate their winnings.

It is the Australian government who should decide whether to do this, not the casino. I'm sure they wont have refunded any losing Australians deposit.
