Quick question. What offence is it exactly for an online casino to take a deposit from a UK player when they do not hold a UKGC licence?

Is it criminal, if so, anyone know which act of law defines it as a crime?

Cheers

Well offense or not it wont matter no one can stop them if a player wants to deposit. They can only legislate for UK based company's and I never see a time where the UKGC would try bring a prosecution for a casino operating without a license taking deposits from UK players.

Basically if a player makes a deposit - and then maybe trys to use the "No UKGC Licence" as a way to try get deposits back they got no chance in hell. All the UKGC can do is advise to only play at licenced casinos.

Your answers are somewhere in one of those docs. The basis is still The Gambling Act 2005.

Thanks Harry. Bit lazy of me not to look there myself in the first place.

The legislation itself is not the easiest to understand and I'll need to have a good read later.

The comments from deeplay are either naive or uninformed. Do you honestly that UKGC legislation exists purely in an advisory capacity? Of course it doesn't because if it did nobody would pay any attention and we'd all be playing at casinos based out of Gibraltar and Alderney. UK players are covered not because our government wants to protect us but because they want their slice of the revenue.

No I dont think the UKGC exists purely as an advisory capacity. It is though a body that is still evolving. But has no real power to enforce anything for casinos based outside of the UK. As a player we can choose to play at what ever casinos would accept us, no matter if here or abroad and the UKGC can not do a thing about it. As to if thats the right choice or not is a personal point of view. And they are still many casino operators who do not have UKGC license and yet still allow UK players to sign up and play.

They offer zero cover for players choosing to deposit at casinos not licensed in the UK so there would be no protection at all for that. All the UKGC can do is "advise" people to only play at casinos that hold a uk license. Other than that they can influence nothing outside there own borders.
