LeoVegas Affiliates - intrusive new terms

I've just noticed that Leo Vegas has new terms - actually forcing new terms (you can't log in without accepting them - which is BS in my opinion).

Get this:
You shall permit LeoVegas (or a person on LeoVegas’ behalf) to audit Your books, records, systems, data, marketing communication consents and other materials to ensure compliance with this Agreement.

Oh really??

10.4 Contractual penalty
Notwithstanding anything to the contrary, in case of Your material breach or threatened material breach of any of the provisions of this Agreement or Affiliate Programme as well as any direct violation thereof, You shall be liable to pay a penalty of fifty thousand Euro (€50,000) to Us for each such individual material breach or threatened material breach of this Agreement as provided herein (hereinafter referred to as ‘Penalty’).

Furthermore, without prejudice to the Penalty, We shall be entitled to any seek equitable relief as a remedy for such breach, including injunctive relief concerning any threatened or actual material breach of any of the provisions of this Agreement or the Affiliate Programme as well as any direct violation thereof. For the purpose of this Clause and for avoidance of doubt, a material breach of this Agreement shall mean, without limitation, breach of, non-compliance with or Your non-fulfilment of Your obligations pursuant to the following clauses of these Terms and Conditions: 2.2 (license to use intellectual property), 3.1 (warranties), 4.2 (direct marketing and spam), 4.3 (approved marketing material), 4.4 (approved layouts), 4.5 (marketing compliance), 4.6 (good faith/ethical conduct), 4.8 (Your restrictions), 4.9 (traffic generated through unsuitable medium), 4.10 (manipulation/advising of referred players to the detriment of LeoVegas), 4.11 (confidential information), 4.12 (data protection and privacy), 4.13 (anti money laundering), 4.14 (limitations of advertising), 4.16 (limitations of URLs), 4.15 (trademark infringements), 4.17 (restricted territories), 4.18 (restricted terms). Similarly, material breach of this Agreement pursuant to the foregoing sentence shall, without limitation, also mean any breach of any other parts of this Agreement that cover or otherwise relate to the same subject matter as the previously stated clauses.

The Penalty becomes due as of the moment of the occurrence of the material breach of threatened material breach, and this is not paid on the first demand the late payment interest in the maximum amount provided by laws of Malta shall accrue.

10.5 Remedies
Our rights and remedies in these Terms and Conditions shall not be mutually exclusive, i.e., the exercise of one or more of the provisions of this Agreement shall not preclude the exercise of any other provision.

You acknowledge that We may, without prejudice to any other right available,
a.immediately suspend Your membership of the Affiliate Program; and/ or
b. in Our absolute discretion, not pay You any funds due to You as Fees.

:lolup: So, I guess they have a right to fine me Euro 50,000 if I don't use their marketing material like the content for their reviews? What it they get thrown into the rogue pit? Do I get fined for that two?

The more I read these terms, the more miffed I get. They are intrusive, insulting, manipulative, and rogue in my opinion. And in order for me to check my stats, I have to "agree" to them.

Makes me sorry I ever put them through the Baptism by Fire and placed them on the Accredited Section.
 
I logged in to my LeoVegas account just now and found this gem in my Inbox: (Note, they did not email this to me -- they just quietly slipped it into my Netrefer inbox.)

Dear Affiliate,

Following the update to our Affiliate Partner Terms and Conditions (‘Terms and Conditions’) and our email to you on 1st November where we provided guidance on our UK compliance expectations, please note that we will be pausing your account for new rewards effective immediately until we are 100% certain that you are compliant with applicable legislation in the UK.

Should you provide us with proof of your compliance with our UK guidelines and Terms and Conditions which we deem satisfactory, we will review your account and consider re-opening it.

However, in the event that we discover any assets which breach our Terms and Conditions or UK guidelines, we will also suspend pay-outs for existing customers, in accordance with our one-strike policy in the UK.

Kindly note that notwithstanding the above, you are still required to take down any assets which are not compliant with our Terms and Conditions and applicable legislation in the UK immediately.

Please feel free to get in touch with your affiliate manager with any questions you may have on the above.

In their email from 1 November, they did not ask for a reply. The email "provided guidance" and outlined what is not acceptable. At the time, I thought "okay, fine, no worries here," and went on with my day. I don't use banners, I wasn't promoting any bonuses, and I don't promote them via social media or SMS. And we have the 18+, Please Play Responsibly, and the link to Gambleaware on every page.

If they wanted a reply to their email, they should have asked for one in the first place, instead of sneakily freezing my account.

It's a money grab. They are looking for excuses to close down any affiliate account big or small. Am I right?

Exactly what they are doing - They are watching big fat rogues like Ladbrokes, Gala, Paddy Power, SkyVegas and others get away with Murder. Stealing MILLIONS from Affiliates and nothing is being done or challenged (Respect to Webzcas for taking on Affiliate Edge)

Time for them to get their piece of the pie and STEAL your players who were introduced BEFORE these guidelines came about. Naturally those players have nothing to do with this fiasco. Nevertheless, they will be taken and you will be robbed - and there's f*ck all we can do.

I didn't really have a problem with the fine at the time I got the email , I've been complaint long before the recent fines. What makes me laugh is when they (all affiliate programs) say 'due to recent changes in the law', er, no, the laws have been there for years, the programs just decided to ignore them, now they have been caught its all the affiliates fault. If the laws weren't there, then how were fines handed out, you don't get fined for breaking a law/rule that wasn't there.

As for LV, throw them in the pit. Simple.
 
Just checked my account and lo and behold i have the same message and frozen account.

We are asa and ukgc compliant and have always had a major emphasis on addiction resources. We emailed Leo for them to provide feedback but never heard back.

Very unprofessional and untoward.
 
Weirdly my account is open and no message. Nor did I get any email saying I had to reply (that I remember) so not sure whats going on.

Regardless, screw that shit, they aren't checking my books, so they aint getting promoted. Simple.

Your account will be open - it's the fact you won't get paid for any sign-ups whilst you are not confirmed by them.

Yes, but if theres no message I presume the account isn't paused?

Most of those are accredited, presumably a quick pm to the reps will end in accounts being closed ;)
 
I wonder if this will apply to their super affiliate they have on twitch who streams for them. Im sure they could really screw this guy over big time for a huge cash grab as Im sure he has thousands signed up under him. Or of they see him as too important so they wont bother him
 
I will guarantee that Betway won't do diddly squat, neither will William Hill or Ladbrokes. One of the reasons they aren't accredited.

No, but the others might, having said that I sent casumo some links 3 weeks ago and just checked them and all except one are exactly the same, so they obviously aren't that arsed either.
 
LeoVegas have been in contact with me over the past several weeks asking to see if I will work with them. On light of the above, the answer will be a resounding no.

These terms are ridiculous to the extreme. It seems that many affiliate programs feel they can get their affiliates to bend over in which ever position they desire. What is so bad about these terms are they are trying to 'legally' act criminally.
