Ivy affiliates and legal action (Resolved)

I have advertised Ivy affiliates for just over 1 year.

A couple of days ago they basically sent me a very short email saying thank you for my services but they no longer require them and closed my affiliate account. They took my affiliate commissions and all the sign ups over the past year which is quite a few players.

Casandra and the compliance team will not response to emails at all.

The manner they have done this is absolutely outrageous.

It states their office is out of London so I will be speaking to a lawyer over the next coming days on how to move forward with this.

To just do this and not even respond to any emails is truly unbelievable.

So just a warning to others about this group..

I will keep the thread update as I plan to purse this legally.
 
I think Nicola had issues with them with late payment or non-payment of commission.

I've always been paid on time by them and haven't had any issues.

You'll no doubt find that it's in the terms that they can do this unfortunately. Whether those terms are legally 'fair' is another matter.

Only issues I had was non responses some times. They paid me on the same date every month.

But it seems that they wait til you build up a decent sized base and then just close it and take everything.
 
Funny enough, these guys were brought up at a meeting yesterday morning.

We have outstanding commission going back most months to the beginning of this year. Despite showing reports the minimum payout target has far been exceeded, they claim it has not been met. Dead end just like last time.

Secondly, Temple Nile was added to the affiliate site towards the end of last month. 20+ FTDs and was told on Monday we're not going to be paid for them because the link was added too early. The codes were available on the site ffs! These 20 odd players have now been detagged, but I've kept copies of the monthy report.

Time to remove them from the front page I think, not nice being messed around again

My colleague has been in touch with Jennifer this morning and advised that we are currently working on having this issue sorted. We are in touch with our licensor getting more insights into this case.

We will be in touch with Jennifer shortly with a follow up email.

We have already replied to your colleague explaining that Temple Nile was officially launched and made available for all affiliates on November 5th. We have sent a newsletter announcing the release of the brand.

I can confirm that there were no tracking URLs available on affiliates' account prior to November 5th. Therefore any commission was existed prior to the official release of the brand is due to a misunderstanding and cannot be accounted as commission since the brand was in beta testing and was not officially available for the affiliate database.

The only traffic that was rightfully brought by affiliates from November 5th will be reflected in the affiliate platform.

I want to post something that happened this morning.

Ivy affiliates contacted us this morning after they were given my complaints from other forum admins. They stated they were looking into our issue suddenly.

I instantly had a feeling because I know personally this was done in an attempt to rip us off. To go into my twitch channel and look at the viewlist as I felt they would be going through my videos or something to try and find something to use as a defense.

Low and behold, there was a user in there named Nancy. Now usually the only people in the viewer list are people who follow me or are bored looking for content. I thought hmm ok maybe.

Well I click on the persons profile and it brought me to an account that they followed and were not followed by anyone aside from the casino section. So now im getting very concerned. The only way this person could have found my channel when offline is to know my name directly and be guided to my channel by someone.

I went to the 17 videos I have saved on my channel of me streaming and looked at the viewer count. Over the next 4 hours each video dating months back increased by one view. Someone was going through all my videos.

And just like magic. Not long after I get this response from an admin from another site stating exactly what I knew they were going to attempt

There WERE tracking links as I logged into my Ivy a/c immediately after their e-mail, the same as it seems she did and found them all ready to generate before 5 Nov. I didn't put mine up until Monday though so didn't jump the gun, but they were there!

Wish I hadn't as big red minus on them already which (as this lot bundle the brands :mad: ) has wiped out my earnings so far this month on Spinrider, Miami Dice etc!

To be fair I vaguely recall seeing that links or the site wouldn't go live until the 5th.

Wish I hadn't as big red minus on them already which (as this lot bundle the brands :mad: ) has wiped out my earnings so far this month on Spinrider, Miami Dice etc!

Well thats ok they will obviously have removed those negative amounts as they weren't counted - plus you are clearly lying as the links weren't available so you couldn't have done anything you said :eek::eek:
So Ivy affiliates are saying 2 affiliates, who have no record of lying about anything like this, are suddenly making things up. Sounds legit :laugh:
 
We´ve also not been paid from i think April on wards. The payments just stopped. We´ve given a notice about this two times but it´s not gone anywhere. It´s just been "will look in to this" with no updates. It´s a shame , we could promote Ivy a lot more but the issues listed above combined with our own issue of not getting paid is keeping us from giving them better positions. The affmanager of ours has been quite challenging to work with.
 
Updating on the matter of us: Seems that some staff of Ivy , maybe the affmanager saw our messages here and looked in to it. They said the payments from the period of time had been bounced back by wrong banking details of us.

It´s quite strange as we use the exact same details for every other affiliate program and they´ve not had issues with it. Maybe that´s just us but i find it strange that they never approached us that our payments our bouncing back to them. Although the situation from our understanding was being solved for quite some time? Either way , trying second bank account now and will update if the commissions are received. As a bonus , we were moved to a lower %/ tiered revshare percentage because we´ve not sent them enough FTD´s in the previous months. If there only could be a reason why we basically stopped sending them FTD´s....
 
We provided the admin of affiliate guard dog screenshots and copies of all emails between us and them proving we complied to their ID request. It showed the email headers with date and time stamps of everything between us since the beginning. This was done last week.

No apology, no restoring of our account, no response. Nothing.

Its a very straight forward case. It should never have happened in the first place. But when the proof was provided to them it should have taken all of 5 minutes to quickly apologize and restore everything.

Pretty shocking behavior. Hopefully their investors do a google search of them and find all these complaints.

Hello. It is now Nov 19th and there has been no responses from you guys anywhere at all. You tried to claim you gave us some compliance form we broke. I forwarded all emails and the actual email you sent us to the admins at AFG showing you asking for nothing but ID and not any other type of compliance like you claim.

So when you say you will be in touch shortly, what does shortly mean exactly? Surely 10 days is not shortly to anyone that I know.

We are looking forward to this long awaited email you are supposedly sending.

Is there a reason why you arent responding to the AFG/LCB admins? I was just told by Melissa over there that you arent replying to them.
 
@BillyBonanza Feel your pain here.

I resubmitted all outstanding invoices the other day from the previous 10 months. Once again, IVY are the only payments outstanding for the month :(
 
Latest update is they said as long as mark my threads as updated and resolved they will reopen my accounts and pay me my commission owing. I told them I will update the threads when all are true, the account reopened and commission paid. This email was sent to me approx 1 week ago.

They reopened the account but have not paid outstanding commissions. I have emailed them twice in the past week for commissions to be paid. No responses

No one is responding to any emails to you guys or paying back dated commission since you agreed to reopen our accounts.
 
Well I guess this was never about not being compliant and it was just an outright tactic to take my players and not pay commission.

As all of you know who work with these guys, their deal is no negative carry over. They are now trying to say they do and this is why I wont be getting any commission owing.

Finally after weeks of not responding they send us this silly email

I have pulled out the Payment report for your account. The reason why you haven’t been paid is because you have a winner in September ( -£531.91). This amount is dragging the whole commission down.


Once this is cleared, you will receive the commission generated in the coming months.

I guess they forgot they even have it advertised on their home page there is no negative carry over. Very unfortunate they are deciding to come up with any lie to not pay us. Whats even worse is I have the email saved where we discussed the deal when we first started working for them and they know without question we have always been on revenue share with no negative carry over the past year.

They of course are trying to claim their recent releases go on the default structured program. Well I have the email saved that we agreed 40% for all. So have fun with that

OK, just wondered where my commission from November was.
I was paid on 10 October for September's OK.
October I finished minus 500-odd so obviously no payment.
November made 350-ish.

IT IS CLEAR TO ME TOO NOW THAT IVY AFFILIATES MUST BE RUNNING NCO CONTRARY TO PREVIOUS BEHAVIOUR.

They also bundle brands which is not usual behaviour. I can live with that, but NCO?? Do one. :mad:

P.S. - The initial thread here was about late payments and CC Action. The NCO issue is a quite recent and separate phenomenon so if you believe you are getting NCO when you shouldn't I have a new thread here with their NCO terms:
