Hi... This is Kenneth .

As I'm reading the replys , I felt I need to respond and answer to few points that were brought up.

FIRST, I made an additional deposit ( on top of the 11K I had on my balance ) due to the request of the support team
( and I will be more then happy to share their email request with you all ). THE reason they asked me to make a deposit
were due to the fact they wanted to process withdrawal to my moneybookers account and they wanted my info to be recorded
in their cashier system in order to process my wihtdrawal ( which they processed the 2000 GBP but refused to processed the remaning)

Second, I never refused to the settlement offered by MAX 100%. Just to be clear, I asked for some extra time to check my rights
and obviously 48 hour time frame were not a fair time limit for me to check all my rights with Gambling commission.

Do you think it still gives the casino the right to turn down Max's settlement and hide behind some unreasonable reason
for me not responding to accept their offer within 48 hours ?

That can't be serious and as you all can understand, Smartlive never really planned to honor Max's ruling...
they just being UNFAIR and refuse to close this matter...

From what I recall this is total BS: they made the offer (at my request), the offer had a time limit, you ignored the time limit -- as I remember it no mention was made of "checking your rights" or whatever -- and the offer expired. As I recall you even came back and said "no, I cannot accept such an offer". Of course you changed your mind later but that's another part of the story.

AFAIC this is yet another attempt to distort the truth in order to gain sympathy for your cause. That's an abuse of your posting rights and I won't have it: I am adding you to the "Moderated" group meaning your posts will have to be approved by a moderator/Admin before they will appear on the forums. Furthermore I am updating the thread title to better reflect the true nature of this dispute. Like the man said "speak bullshit, expect pain".

I'll check the case details on Monday to get everything right and I'll set the record straight then.

Oh, I've gone back to my records on the case and here is the chronology and details related to the payout offer that was made to the OP:

  • Thursday 31 May: after discussions with the casino people I told the OP of the payout offer details and made it clear that the deadline for his decision was the following Monday, 04 June.
  • same day: the OP replied with thanks for the offer but suggested I look at more stuff related to his case, ignored the offer deadline.
  • Friday 01 June: I thanked him for his reply, said the new info would be added to the case file but would not affect the current status, reiterated that the offer deadline was 04 June.
  • same day: OP replied "I have no choice but to refuse to your deal", clearly refuting his recent statement that "I never refused to the settlement offered by MAX 100%". He further mentioned that he had engaged a solicitor "which help me to be paid in full". He said absolutely nothing about "extra time to check my rights", then or ever.
  • same day: I replied as follows and told him he was free to post about his case if he fairly and honestly represented the facts:
Thank you for your prompt reply and decision regarding the settlement offer. I will inform the casino accordingly. Effective immediately your PAB case is closed here at Casinomeister.
  • Monday 04 June: the OP thanked me for my involvement in the case, briefly discussed what he intended to post on the forums.
  • Friday 08 June: I heard from the casino people who said they'd been discussing the matter with the OP directly and had extended the settlement offer to Tuesday 12 June.
  • Later in June: I was discussing another matter with the casino people and they mentioned that the OP had not responded to the extended deadline after which they had effectively closed the book on the case.

So, as I said, the OP is (again) misrepresenting the case facts to suit his purpose which continues to be to apply pressure to the casino for payments his is neither owed or due. At this point the OP has repeatedly violated the Casinomeister Posting Rules regarding "personal agenda" and "exploiting forum membership". As such he will remain in the "Moderated Users" group for the foreseeable future.
