The Casinomeister philosophy:
If the casino operation does not approve in the manner in which the player plays, then they have every right to lock a player's account just so this is outlined in the terms and conditions.
If fraudulent activity is detected (multiple accounts, faked IDs, bogus personal info, etc.) then winnings should be confiscated since these would be considered bogus accounts.
If the player account is legit, the wagering requirements are met, and the terms and conditions are not breached, then winnings should be paid.
Many of these players were told that it's not the games they played but how they played them that cost them their winnings.
I have queried your account and I can confirm the following. The withdrawal that you requested has been cancelled as your casino account has been locked due to promotional abuse. They have advised us that due to suspicious wagering by you on 100 Play Power Poker-Aces and Faces game in particular, the account was closed and will remain closed. Your game play was highly unnatural and improbable for any bona fide player with intent to play with us in future. Similarly, placing all your money on one single bet is also highly unlikely for any serious gambler.
For this reason the account has been locked and will remain locked.
I have assessed your Capital Casino account and the reason that you casino account is locked is because you abused a promotion at our casino and that unfortunately is not allowed. The casino also has the right not to refund you and to lock your account indefinitely.
BONUS FORFEITED .... Please be aware that all Fortune Lounge bonuses are allotted to players in good faith, in order to enrich their gaming experience, and not to be abused for profit. Unfortunately, your recent withdrawal request of $591.50 included a bonus amount that you already received via our promotional offers. We sincerely regret that as a result of this recent activity, we have had no choice but to forfeit your bonus and the winnings derived from it. However, we have refunded your original purchase amount. If you are unclear as to why you have forfeited your bonus please refer to our terms and conditions for more details regarding promotional abuse...
We have reviewed your Fortune Room Casino account and see that
you have made the minimum purchase to receive the maximum sign up
bonus.
We also see that you only made use of French Roulette to meet the
wagering requirements for the bonus.
Your play on French Roulette was based on wagering on Black or Red.
Wagering on Black or Red will result in no loss or win for either the
Player or the Casino.
The main outcome is the increased wagering, meeting the wagering
required on the bonus money with no change to the balance, (unless a
Zero is landed).
Therefore there is no fair chance for the casino to win back the
allocated bonus from the player.
There was no intention to play at the Casino, and only to cashin the
bonus money.
The manner in which you have wagered and met your play through is
considered as Promotional misuse.
The problem with the term "promotional abuse" is that it's too subjective. The casino looks at this sort of behavior as abuse - the player looks at this as "beating the house". Don't get me wrong, the casino has every right in the world to pick and chose who their customers are. But once the casino makes the offer, accepts the bet, and the player plays according to the terms and conditions meeting the wagering requirements, then the casino ought to honor the winnings. It's the casino that is responsible for making the rules. If they make mistakes by forgetting to say that making a single bet on Blackjack is not allowed, then it should be allowed. It is not the responsibility of the player to try and guess what the casino considers "abuse".
Subjective language has no place in enforcing rules. Casinos can enforce policies by disallowing these players access to the casino, or deny bonuses in the future, but it is unacceptable to garnish winnings after the player has met the wagering requirements of the bonus.
We understand that the casino wishes to bring in new players who will remain loyal by them offering bonuses. But the bottom line is that the casino writes the terms for these bonuses, the casino should be expected to write terms that protect it from players they don't want.
I understand that during this period, they was a high level of player fraud. But advantage players are not fraudsters - if you are tuna fishing, you don't kill the dolphines in the tuna net.
Many casino managers compare their operations to those in Vegas stating that "If this player was caught in Vegas card counting, he'd be thrown out. Bonus abusers should be treated the same." If a Vegas casino throws out a player for "card counting", they can plan on being sued for damages. The card counting = bonus abusers analogy doesn't fly, it's a myth. From the Las Vegas Sun:
The Nevada Supreme Court agrees that advantage gambling is legal and can include such techniques as card counting, shuffle tracking and playing slot machines that are paying out more than their fair share.
Nevada's highest court, as well as courts in other gambling states, have ruled advantage gambling is legal since players don't manipulate any cards or machines. Rather, they do nothing more than use normal intelligence much as a bridge player would use while watching other players.
At press time (11 June 2007), all players accused of abuse (not fraud) were paid.
